proprietor (東主), contractor (承建商) 是F&IUO [Cap.59 2] 釋義中的用詞;

employer (僱主), occupier (佔用人) and person responsible (負責人) 則是 OSHO [Cap.509 3] 釋義中的用詞
According to Cap.59 2:
  • proprietor (東主) in relation to any industrial undertaking or notifiable workplace includes the person for the time being having the management or control of the business carried on in such industrial undertaking or notifiable workplace and includes a body corporate and a firm and also the occupier of any industrial undertaking or notifiable workplace and the agent of such occupier; (Amended 50 of 1985 s. 2; 71 of 1989 s. 2) 東主(proprietor)就任何工業經營或應呈報工場而言，包括當其時管理或控制在該工業經營或應呈報工場中進行的業務的人，亦包括法人團體、商號，以及任何工業經營或應呈報工場的佔用人及此等佔用人的代理人；(由1985年第50號第2條修訂；由1989年第71號第2條修訂)

 

  • contractor (承建商), in relation to construction work, means any person or firm engaged in carrying out construction work by way of trade or business, either on his own account or pursuant to a contract or arrangement entered into with another person, including the State or any public body; (Added 52 of 1973 s. 2. Amended 54 of 2000 s. 3) 承建商 (contractor)就建築工程而言，指以經營生意或業務方式從事建築工程的人或商號，而該人或商號是本身獨立從事該建築工程的或是為依據與別人(包括“國家”或任何公共機構)所訂的合約或安排而從事該建築工程的；(由1973年第52號第2條增補。由2000年第54號第3條修訂)

 

 

According to Cap.509 3:
  • employer (僱主) means a person who employs natural persons under contracts of employment or apprenticeship; 僱主(employer)指根據僱傭合約或學徒合約僱用自然人的人；

 

  • occupier (佔用人), in relation to any premises or workplace, includes a person who has any degree of control over the premises or workplace and, in particular, includes a person to whom subsection (5) or (6) applies; 佔用人(occupier)就任何處所或工作地點而言，包括具有對該處所或工作地點有任何程度控制權的任何人，並尤其包括第(5)或(6)款適用的人；
    • (5) A person who, under a lease or contract, has an obligation for—
      任何人如根據任何租契或合約就以下事宜承擔責任 ——
      • (a) the maintenance or repair of premises; or
        處所的維修或修葺；或
      • (b) the safety of, or the absence of risks to health arising from the condition or use of, any plant or substance located on premises,
        任何置於處所的作業裝置或物質的安全或沒有因任何置於處所的作業裝置或物質的狀況或使用而對健康產生的危險，

        is taken to be an occupier of the premises for the purposes of this Ordinance.
        則就本條例而言，該人被視為該處所的佔用人。

    • (6) A person who, under a lease or contract, has an obligation to provide, maintain or repair a means of access to, or egress from, premises is taken to be an occupier of the premises for the purposes of this Ordinance.
      任何人如根據任何租契或合約就提供、維修或修葺進出處所的途徑而承擔責任，則就本條例而言，該人被視為該處所的佔用人。
    • (7) Subsections (5) and (6) do not apply to persons in their capacity as occupiers of domestic premises.
      第(5)及(6)款不適用於屬住宅處所佔用人身分的人。

 

  • person responsible (負責人), in relation to a workplace, has the meaning given by subsection (2); 負責人(person responsible)就任何工作地點而言，具有第(2)款給予該詞的涵義；
    Subsection (2) : For the purposes of this Ordinance, the person responsible for a workplace is the employer of the employees who are employed to carry out work there, or if the employer does not exercise any degree of control over the relevant part or aspect of the workplace, means the occupier of the workplace.
    就本條例而言，工作地點的負責人是受僱於該工作地點工作的僱員的僱主；如該僱主並沒有對該工作地點的有
    關部分或方面行使任何程度的控制權，則工作地點的負責人指該工作地點的佔用人。
