General duties (of proprietor and persons employed) in F&IUO (Cap.59 Sec 6A and 6B)

6A. General duties of a proprietor
東主的一般責任(1) It shall be the duty of every proprietor of an industrial undertaking to ensure, so far as is reasonably practicable, the health and safety at work of all persons employed by him at the industrial undertaking.
工業經營的每位東主,均有責任在合理切實可行範圍內,盡量確保其在工業經營中僱用的所有的人健康及工作安全。(2) Without prejudice to the generality of a proprietor’s duty under subsection (1), the matters to which that duty extends include in particular—
在不損害第(1)款所訂的東主責任的概括性的原則下,該責任所擴及的事項尤其包括以下各項
- (a) the provision and maintenance of plant and systems of work that are, so far as is reasonably practicable, safe and without risks to health;
設置及保持在合理切實可行範圍內盡量是安全和不會危害健康的工業裝置及工作系統;- (b) arrangements for ensuring, so far as is reasonably practicable, safety and absence of risks to health in connection with the use, handling, storage and transport of articles and substances;
作出有關的安排,以在合理切實可行範圍內盡量確保在使用、搬運、貯存和運載物品及物質方面,安全和不致危害健康;- (c)the provision of such information, instruction, training and supervision as is necessary to ensure, so far as is reasonably practicable, the health and safety at work of all persons employed by him at the industrial undertaking;
提供所需的資料、指導、訓練及監督,以在合理切實可行範圍內盡量確保其在工業經營中僱用的所有的人健康及工作安全;- (d) so far as is reasonably practicable as regards any part of the industrial undertaking under the proprietor’s control, the maintenance of it in a condition that is safe and without risks to health and the provision and maintenance of means of access to and egress from it that are safe and without such risks; and
對於任何由東主控制的工業經營部分,在合理切實可行範圍內盡量保持該部分處於安全和不會危害健康的狀況,以及提供和保持進出該部分的安全和不會危害健康的途徑;及- (e) the provision and maintenance of a working environment for all persons employed by him at the industrial undertaking that is, so far as is reasonably practicable, safe, and without risks to health.
為其在工業經營中僱用的所有的人提供及保持在合理切實可行範圍內盡量是安全和不會危害健康的工作環境。(3) Subject to subsection (4), a proprietor of an industrial undertaking who contravenes this section commits an offence and is liable to a fine of $500,000.
除第(4)款另有規定外,任何工業經營的東主違反本條的規定,即屬犯罪,可處罰款$500,000。(Amended 40 of 1997 s. 2)(4) A proprietor of an industrial undertaking who contravenes this section wilfully and without reasonable excuse commits an offence and is liable to a fine of $500,000 and to imprisonment for 6 months. (Amended 40 of 1997 s. 2)
任何工業經營的東主無合理辯解而故意違反本條的規定,即屬犯罪,可處罰款$500,000及監禁6個月。(Added 71 of 1989 s. 5. Amended 81 of 1993 s. 3)
6B. General duties of persons employed
受僱的人的一般責任(1) It shall be the duty of every person employed at an industrial undertaking while at work—
工業經營的每名受僱的人,於工作時均有責任
- (a) to take reasonable care for the health and safety of himself and of other persons who may be affected by his acts or omissions at work; and
為他本人的健康及安全採取合理的謹慎措施,及為會因他工作時的作為或不作為而受影響的其他人的健康及安全採取合理的謹慎措施;及
- (b) as regards any duty or requirement imposed on a proprietor of the industrial undertaking or on any other person by this Ordinance for securing the health and safety of persons employed at the industrial undertaking, to co-operate with him so far as is necessary to enable that duty or requirement to be performed or complied with.
在本條例為確保工業經營中受僱的人的健康及安全,而施加於工業經營的東主或任何其他人的責任或規定方面,在有需要的範圍內盡量與東主或該等其他人合作,使該責任或規定得以執行或遵從。(2) A person who contravenes subsection (1) commits an offence and is liable to a fine at level 4.
任何人違反第(1)款的規定,即屬犯罪,可處第4級罰款。(Amended 40 of 1997 s. 3)(3) A person employed at an industrial undertaking who wilfully and without reasonable excuse does anything while at work likely to endanger himself or other persons commits an offence and is liable to a fine at level 5 and to imprisonment for 6 months.
在工業經營中受僱的人無合理辯解而故意於工作時作出任何相當可能危及他本人或他人的事情,即屬犯罪,可處第5級罰款及監禁6個月。(Amended 81 of 1993 s. 4; E.R. 2 of 2019)(Added 71 of 1989 s. 5)

- Cap. 59 F&IUO 的 Section 6A 及 6B 分別列出 東主 (proprietor) 和 受僱人 (persons employed) 的一般性責任條款 (General duties, GDs)。
- IU 的 東主的 GD 有4條Subsection: Subsection (1) 講既是東主要在 so far as is reasonably practicable (在合理切實可行範圍內), 確保所有僱員的健康及工作安全, 而 Subsection (2) 則進一步指出5大範圍東主要做到
- 工業裝置及工作系統 : provision and maintenance of plant and systems
- 工作環境 : provision and maintenance of a working environment
- 提供和保持進出該部分 : provision and maintenance of means of access to and egress from
- 使用、搬運、貯存和運載物品及物質方面 : use, handling, storage and transport of articles and substances – arrangements
- 資料、指導、訓練及監督 : information, instruction, training and supervision (IITS) – provision
Subsection (3), (4) 講罰則, Subsection (4) 指出如果東主無合理辯解而故意違反本條 (without reasonable excuse commits an offence)的規定,可處罰款五十萬 ($500,000)及監禁6個月。
- IU 的 受僱人的 GD 有3條Subsection: Subsection (1) (a) 指出受僱人本身有責任 take reasonable care for the health and safety of himself and of other who may be affected by his acts or omissions persons at work, 而 Subsection (1) (b) 指出 受僱人要 so far as is necessary co-operate with proprietor or any other person by this Ordinance for securing the health and safety of persons employed to enable that duty or requirement to be performed or complied with.
Subsection (2), (3) 講罰則, Subsection (3)指出如無合理辯解而故意於工作時作出任何相當可能危及他本人或他人的事情,可處第5級罰款及監禁6個月。
