僱員/工友顧己及人的相關條文

都快要入行1年多，今晚就拿起書本看看，又上DOJ的elegislation.gov.hk溫故知新。

首先，僱員跟工友是很類近的CONCEPT, 但又不完全相同 – 這是主要香港現時 (2022) 有關職安健的相關法規有兩大條例，N條子例 (N是很多的意思了)。

第509章 《職業安全及健康條例》
Cap. 509 Occupational Safety and Health Ordinance

Section 2 條例的目的

本條例的目的是 ——
(a) 確保在工作中的僱員的安全及健康；
(b) 訂明會有助於使僱員的工作地點變得對該等僱員更加安全和健康的措施；
(c) 改善適用於在工作地點使用或存放的若干危險工序、作業裝置及物質的安全及健康標準；
(d) 一般地對僱員的工作環境的安全和健康方面作出改善。
基本上，”僱員” 是Cap. 282  [第282章 《僱員補償條例》] 之外，另一條有相關 “字眼” 的條例。
而Cap 509 適用的範圍是 “工作地點” : 這一點很重要! 要知 “工作地點”的定義就要好好看原文了。
第59章 《工廠及工業經營條例》
Cap. 59 Factories and Industrial Undertakings Ordinance
顧名思義，這條例主要應用在”工廠” 及 “工業經營” : 這一點同樣很重要! 但要知定義也是要好好看原文了。
今日要分享 (或重溫的不是兩條條例及其子例的應用範圍)，而是 “顧己及人” 的相關條文。因此，開場白亦差不多了。
以下將會列出相關對用適用的條文:

一般性責任條款

Cap509 Section 8 : 工作中的僱員須照顧其他人並須與僱主合作
Employees at work to take care of others and to co-operate with employer

(1)任何在工作中的僱員 ——
(a)須在合理地切實可行範圍內，照顧在其工作地點並有可能因其在工作中的作為或不作為而受影響的人(包括僱員本身)的安全及健康；及
(b)對於本條例或任何其他條例為確保安全或健康而施加於其僱主或任何其他人的任何規定，須在合理地切實可行範圍內，盡量在所需的情況下與其僱主或該等其他人合作以使該等規定得以遵守。
(2)任何僱員如沒有遵守第(1)款，即屬犯罪，一經定罪，可處第3級罰款。
(3)任何僱員如蓄意地沒有遵守第(1)款或明知而沒有遵守第(1)款或罔顧後果地沒有遵守第(1)款，即屬犯罪，一經定罪，可處第5級罰款及監禁6個月。

 

(1)An employee while at work—
(a)must, so far as reasonably practicable, take care for the safety and health of persons (including the employee) who are at the employee’s workplace and who may be affected by the employee’s acts or omissions at work; and
(b)as regards any requirement imposed in the interests of safety or health on the employee’s employer or any other person by this or any other Ordinance, must, so far as reasonably practicable, co-operate with the employer or other person so far as may be necessary to enable the requirement to be complied with.
(2)An employee who fails to comply with subsection (1) commits an offence and is liable on conviction to a fine at level 3.
(3)An employee who fails to comply with subsection (1) intentionally, knowingly or recklessly commits an offence and is liable on conviction to a fine at level 5 and to imprisonment for 6 months.

一般性責任條款

Cap59 6B : 受僱的人的一般責任
General duties of persons employed

(1)工業經營的每名受僱的人，於工作時均有責任 ——
(a)為他本人的健康及安全採取合理的謹慎措施，及為會因他工作時的作為或不作為而受影響的其他人的健康及安全採取合理的謹慎措施；及
(b)在本條例為確保工業經營中受僱的人的健康及安全，而施加於工業經營的東主或任何其他人的責任或規定方面，在有需要的範圍內盡量與東主或該等其他人合作，使該責任或規定得以執行或遵從。
(2)任何人違反第(1)款的規定，即屬犯罪，可處第4級罰款。

(3)在工業經營中受僱的人無合理辯解而故意於工作時作出任何相當可能危及他本人或他人的事情，即屬犯罪，可處第5級罰款及監禁6個月。

(1)It shall be the duty of every person employed at an industrial undertaking while at work—
(a)to take reasonable care for the health and safety of himself and of other persons who may be affected by his acts or omissions at work; and
(b)as regards any duty or requirement imposed on a proprietor of the industrial undertaking or on any other person by this Ordinance for securing the health and safety of persons employed at the industrial undertaking, to co-operate with him so far as is necessary to enable that duty or requirement to be performed or complied with.
(2)A person who contravenes subsection (1) commits an offence and is liable to a fine at level 4.

(3)A person employed at an industrial undertaking who wilfully and without reasonable excuse does anything while at work likely to endanger himself or other persons commits an offence and is liable to a fine at level 5 and to imprisonment for 6 months.

第59A章 《工廠及工業經營規例》
Cap. 59A FACTORIES AND INDUSTRIAL UNDERTAKINGS REGULATIONS

Section 21 受僱的人的職責  Duties of persons employed

(1)受僱於任何工業經營中的人，不得故意干擾或不當地使用為確保受僱於該工業經營的人的健康、安全或福利而依據本條例提供的工具、器具、設施或其他物件，而凡有為確保健康或安全而根據本條例提供給上述的人使用的工具或器具，該人須予以使用。
(2)(由1989年第71號第13條廢除)
(1)No person employed in an industrial undertaking shall wilfully interfere with or misuse any means, appliance, convenience or other thing provided in pursuance of the Ordinance for securing the health, safety or welfare of the persons employed in the industrial undertaking, and where any means or appliance for securing health or safety is provided for the use of any such person under the Ordinance, he shall use the means or appliance.

第59I章 《建築地盤(安全)規例》
Cap. 59I Construction Sites (Safety) Regulations

38I. 配戴安全帶的責任 Duty to wear safety belt

每名在建築地盤工作並獲提供安全帶的人，每當為其本人或為其他人的安全而需要使用安全帶時，均須配戴安全帶，並須保持將安全帶一直繫於穩固的繫穩物。

Every person working on a construction site who has been provided with a safety belt shall wear it and keep it attached to a secure anchorage whenever the use of the belt is necessary for his own or any other person’s safety.

 

Section 48. 安全頭盔 Safety helmets

(2) 任何人如無配戴着適當的安全頭盔，則不得進入建築地盤。
(2) No person shall enter a construction site unless he is wearing a suitable safety helmet.

Section 71. 其他人所犯的罪行 Offences by other persons

(1) 任何人違反第31(2)、38I或48(2)條，即屬犯罪，一經定罪，可處第3級罰款。
