Day 1 : Road to be a RSO – 滅火器(消防安全措施)

Recently, I have applied for the assistant safety office from a renowned franchised bus company. To me, the reason why I wanna to become a member in the safety team is simply: I love bus industry. However, I am not sure if they give me the offer in 2023. Actually, I do really want to be a RSO. I remember that I kept writing blog and reading books and doing revision during the time when I was applying for the Cadet program with Cathay Pacific. What a shame, I did not do it for a while after I enter this company as a ASO in a construction site.

In 2023, I have to re-ignite my passion and motivation at work – 總之做合法、合情、合理的事, 對的事, 話知比人炒柒我! Indeed, it is time to advance my communication skills and management skills – manage downstream and mange upstream as well.

On the other hand, try to review my legislation knowledge in OSH as much as possible!

一般工作地點 Cap 509A S10(1): Commissioner may require additional fire safety measures

OSHR-11- 工作地點負責人必須提供滅火器(指明的數量和類型)，並放置在可供隨時取用的位置

OSHR-12- 滅火器必須保持在有效的狀況

OSHR-13- 必須提供兩桶沙，並放置在可供隨時取用的位置 (指明的位置)

 

消防安全措施 “fire safety measure”  Cap509A S2
means any installation or equipment manufactured, used or designed to be used for the purposes of—

(a) extinguishing, preventing or limiting a fire or the effects of a fire; or
(b) giving warning of a fire; or
(c) providing access to any premises or place for the purposes of extinguishing, preventing or limiting a fire or the effects of a fire;
Cap509A S11 Offence to damage or interfere with fire safety measures provided at workplace
(1) 任何人如 ——
(a) 損毀或干擾在工作地點所在的處所內提供的消防安全措施；或
(b) 作出任何事情，阻止該等措施用作消防安全措施，即屬犯罪，一經定罪，可處第5級罰款。
(2) 任何人如被裁定犯第(1)款所訂的罪行，並已證明他蓄意、明知或罔顧後果地犯該罪行，則法庭除可判處該款訂明的罰款之外，亦可另判處該人不超過6個月的監禁，或可判處該人不超過6個月的監禁，以代替該款訂明的罰款。
工廠 (應呈報工場)  Cap59V S6 – Fire fighting 滅火
FP-11 to FP-13
(1)
處長可藉書面通知規定任何應呈報工場的東主，除該工場已有的防火裝置或設備外，尚須在該工場設置及保持與該工業經營的規模、類型及性質相符的滅火設施，該等設施須放置在可供隨時取用的位置。

根據本條發出的通知書，須詳細指明須設置及保持的滅火設施，以及遵從該通知書的規定的時間。
(3)
任何應呈報工場的東主獲送達本條規定的通知書後，須遵從該通知書的規定。

任何人不得故意更改、損害、阻礙或以其他方法損壞按照本條設置的任何滅火設施。
(5)
在本條中，保持 (maintain) 指保持有效狀況、有效操作狀態及維修良好。
Cap59V S14 – Offences
(1)
The proprietor of any notifiable workplace who contravenes regulation 6(3), 7(3) or 9(1) commits an offence and is liable to a fine at level 5.

(2)
Where in respect of any notifiable workplace regulation 9(2), 10(1) or (2), 11 or 12 is contravened, the proprietor of the notifiable workplace commits an offence and is liable to a fine at level 5.

(3)
Any person who contravenes regulation 7(2) and any proprietor of a notifiable workplace who contravenes regulation 7(4) commits an offence and is liable to a fine at level 3.

Any person who contravenes regulation 5(2) or 6(4) commits an offence and is liable to a fine at level 5.

The proprietor of any notifiable workplace who contravenes regulation 8(1) commits an offence and is liable to a fine of $200,000 and to imprisonment for 6 months.

負責建築地盤的承建商須使設置在建築地盤的所有走火通道及滅火器具保持良好狀況，並免受阻礙。
(1A)
任何直接控制任何建築工程的承建商須使設置在正進行該建築工程的地方的所有走火通道及滅火器具保持良好狀況，並免受阻礙。
(2)
任何人不得故意更改、損害、阻礙或以其他方法損壞上述走火通道或滅火器具。

(1)
Any contractor who—
(a)
contravenes any of the provisions of regulation 4A(1) or (1A), 5(1) or (2), 8, 9(1) or (2), 10(1) or (2), 20(1) or (2), 31(1) or (3), 32(1) or (2), 33, 34(1) or (2), 35(1) or (3), 36, 38(1), (2), (3), (5) or (6), 38A(1), (2) or (3), 38AA(1), (2) or (3), 38B(1) or (1A), 38C, 38D, 38E(1) or (2), 38F(1) or (4), 38G(1) or (2), 39(1) or (2), 40(1), 41, 41A, 42, 43, 44(1) or (2), 45(1) or (2), 46(1) or (1A), 47(1), (1A), (2) or (3), 48(1) or (1A), 49(1), (1A), (2), (3) or (4), 50, 51(1) or (2), 52(1), (1A) or (2), 52A(1), (1A) or (2), 53(2), 54(1) or (1A), 55, 56(1), 57, 58, 59, 61(1), (2), (4), (5) or (6), 62, 63, 64, 65(2), 66(1) or 67(1), (2) or (3); or

fails to comply with any requirement under regulation 61(3),
shall be guilty of an offence.

A person guilty of an offence under paragraph (1) shall—

(g)
in respect of a contravention of regulation 36, 38A(2) or (3), 38AA(2) or (3), 38B(1) or (1A), 38C, 38D, 38G(1) or (2) be liable, where the offence was committed without reasonable excuse, to a fine of $200,000 and to imprisonment for 12 months and in any other case to a fine of $200,000.
