509 Occupational Safety and Health Ordinance<\/h5>\n<p>Section 2 \u689d\u4f8b\u7684\u76ee\u7684<\/p>\n<div class=\"hklm_leadIn\">\u672c\u689d\u4f8b\u7684\u76ee\u7684<span \/>\n\u800cCap 509 \u9069\u7528\u7684\u7bc4\u570d\u662f &#8220;\u5de5\u4f5c\u5730\u9ede&#8221; : \u9019\u4e00\u9ede\u5f88\u91cd\u8981! \u8981\u77e5 &#8220;\u5de5\u4f5c\u5730\u9ede&#8221;\u7684\u5b9a\u7fa9\u5c31\u8981\u597d\u597d\u770b\u539f\u6587\u4e86\u3002<\/div>\n<div><\/div>\n<h5>\u7b2c59\u7ae0 \u300a\u5de5\u5ee0\u53ca\u5de5\u696d\u7d93\u71df\u689d\u4f8b\u300b<br \/>\nCap. 59 Factories and Industrial Undertakings Ordinance<\/h5>\n<div>\u9867\u540d\u601d\u7fa9\uff0c\u9019\u689d\u4f8b\u4e3b\u8981\u61c9\u7528\u5728&#8221;\u5de5\u5ee0&#8221; \u53ca &#8220;\u5de5\u696d\u7d93\u71df&#8221; : \u9019\u4e00\u9ede\u540c\u6a23\u5f88\u91cd\u8981! \u4f46\u8981\u77e5\u5b9a\u7fa9\u4e5f\u662f\u8981\u597d\u597d\u770b\u539f\u6587\u4e86\u3002<\/div>\n<div><\/div>\n<div>\u4eca\u65e5\u8981\u5206\u4eab (\u6216\u91cd\u6eab\u7684\u4e0d\u662f\u5169\u689d\u689d\u4f8b\u53ca\u5176\u5b50\u4f8b\u7684\u61c9\u7528\u7bc4\u570d)\uff0c\u800c\u662f &#8220;\u9867\u5df1\u53ca\u4eba&#8221; \u7684\u76f8\u95dc\u689d\u6587\u3002\u56e0\u6b64\uff0c\u958b\u5834\u767d\u4ea6\u5dee\u4e0d\u591a\u4e86\u3002<\/div>\n<div>\u4ee5\u4e0b\u5c07\u6703\u5217\u51fa\u76f8\u95dc\u5c0d\u7528\u9069\u7528\u7684\u689d\u6587:<\/div>\n<div><\/div>\n<h3>\u4e00\u822c\u6027\u8cac\u4efb\u689d\u6b3e<\/h3>\n<h4>Cap509 Section 8 : \u5de5\u4f5c\u4e2d\u7684\u50f1\u54e1\u9808\u7167\u9867\u5176\u4ed6\u4eba\u4e26\u9808\u8207\u50f1\u4e3b\u5408\u4f5c<br \/>\nEmployees at work to take care of others and to co-operate with employer<\/h4>\n<p>(1)\u4efb\u4f55\u5728\u5de5\u4f5c\u4e2d\u7684\u50f1\u54e1 \u2014\u2014<br \/>\n(a)\u9808\u5728\u5408\u7406\u5730\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\uff0c\u7167\u9867\u5728\u5176\u5de5\u4f5c\u5730\u9ede\u4e26\u6709\u53ef\u80fd\u56e0\u5176\u5728\u5de5\u4f5c\u4e2d\u7684\u4f5c\u70ba\u6216\u4e0d\u4f5c\u70ba\u800c\u53d7\u5f71\u97ff\u7684\u4eba(\u5305\u62ec\u50f1\u54e1\u672c\u8eab)\u7684\u5b89\u5168\u53ca\u5065\u5eb7\uff1b\u53ca<br \/>\n(b)\u5c0d\u65bc\u672c\u689d\u4f8b\u6216\u4efb\u4f55\u5176\u4ed6\u689d\u4f8b\u70ba\u78ba\u4fdd\u5b89\u5168\u6216\u5065\u5eb7\u800c\u65bd\u52a0\u65bc\u5176\u50f1\u4e3b\u6216\u4efb\u4f55\u5176\u4ed6\u4eba\u7684\u4efb\u4f55\u898f\u5b9a\uff0c\u9808\u5728\u5408\u7406\u5730\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\uff0c\u76e1\u91cf\u5728\u6240\u9700\u7684\u60c5\u6cc1\u4e0b\u8207\u5176\u50f1\u4e3b\u6216\u8a72\u7b49\u5176\u4ed6\u4eba\u5408\u4f5c\u4ee5\u4f7f\u8a72\u7b49\u898f\u5b9a\u5f97\u4ee5\u9075\u5b88\u3002<br \/>\n(2)\u4efb\u4f55\u50f1\u54e1\u5982\u6c92\u6709\u9075\u5b88\u7b2c(1)\u6b3e\uff0c\u5373\u5c6c\u72af\u7f6a\uff0c\u4e00\u7d93\u5b9a\u7f6a\uff0c\u53ef\u8655\u7b2c3\u7d1a\u7f70\u6b3e\u3002<br \/>\n(3)\u4efb\u4f55\u50f1\u54e1\u5982\u84c4\u610f\u5730\u6c92\u6709\u9075\u5b88\u7b2c(1)\u6b3e\u6216\u660e\u77e5\u800c\u6c92\u6709\u9075\u5b88\u7b2c(1)\u6b3e\u6216\u7f54\u9867\u5f8c\u679c\u5730\u6c92\u6709\u9075\u5b88\u7b2c(1)\u6b3e\uff0c\u5373\u5c6c\u72af\u7f6a\uff0c\u4e00\u7d93\u5b9a\u7f6a\uff0c\u53ef\u8655\u7b2c5\u7d1a\u7f70\u6b3e\u53ca\u76e3\u79816\u500b\u6708\u3002<\/p>\n<p>&nbsp;<\/p>\n<div id=\"ID_1438412862648_004\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">\n<div id=\"PROV_ID_1438403290225_003_SECTION_1\" class=\"hklm_main\" lang=\"en\">\n<div class=\"blgm wrapping-ancestor hklm_part\">\n<div id=\"ID_1438403290225_003\" class=\"hklm_section\">\n<div id=\"ID_1438412860339_004\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1)An employee while at\u00a0<span class=\"nowrap\">work\u2014<\/span><\/div>\n<div id=\"ID_1438412860339_012\" class=\"hklm_paragraph\">\n<div class=\"hklm_num no_heading_follows\">(a)must, so far as reasonably practicable, take care for the safety and health of persons (including the employee) who are at the employee\u2019s workplace and who may be affected by the employee\u2019s acts or omissions at work; and<\/div>\n<\/div>\n<div id=\"ID_1438412860339_020\" class=\"hklm_paragraph\">\n<div class=\"hklm_num no_heading_follows\">(b)as regards any requirement imposed in the interests of safety or health on the employee\u2019s employer or any other person by this or any other Ordinance, must, so far as reasonably practicable, co-operate with the employer or other person so far as may be necessary to enable the requirement to be complied with.<\/div>\n<\/div>\n<\/div>\n<div id=\"ID_1438412860355_005\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2)An employee who fails to comply with subsection (1) commits an offence and is liable on conviction to a fine at level 3.<\/div>\n<\/div>\n<div id=\"ID_1438412860355_013\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(3)An employee who fails to comply with subsection (1) intentionally, knowingly or recklessly commits an offence and is liable on conviction to a fine at level 5 no_heading_follows\">(1)\u5de5\u696d\u7d93\u71df\u7684\u6bcf\u540d\u53d7\u50f1\u7684\u4eba\uff0c\u65bc\u5de5\u4f5c\u6642\u5747\u6709\u8cac<span class=\"nowrap\">\u4efb\u00a0\u2014<\/span>\u2014<\/div>\n<div id=\"ID_1438413603438_005\" class=\"hklm_paragraph\">\n<div class=\"hklm_num no_heading_follows\">(a)\u70ba\u4ed6\u672c\u4eba\u7684\u5065\u5eb7\u53ca\u5b89\u5168\u63a1\u53d6\u5408\u7406\u7684\u8b39\u614e\u63aa\u65bd\uff0c\u53ca\u70ba\u6703\u56e0\u4ed6\u5de5\u4f5c\u6642\u7684\u4f5c\u70ba\u6216\u4e0d\u4f5c\u70ba\u800c\u53d7\u5f71\u97ff\u7684\u5176\u4ed6\u4eba\u7684\u5065\u5eb7\u53ca\u5b89\u5168\u63a1\u53d6\u5408\u7406\u7684\u8b39\u614e\u63aa\u65bd\uff1b\u53ca<\/div>\n<\/div>\n<div no_heading_follows\">(b)\u5728\u672c\u689d\u4f8b\u70ba\u78ba\u4fdd\u5de5\u696d\u7d93\u71df\u4e2d\u53d7\u50f1\u7684\u4eba\u7684\u5065\u5eb7\u53ca\u5b89\u5168\uff0c\u800c\u65bd\u52a0\u65bc\u5de5\u696d\u7d93\u71df\u7684\u6771\u4e3b\u6216\u4efb\u4f55\u5176\u4ed6\u4eba\u7684\u8cac\u4efb\u6216\u898f\u5b9a\u65b9\u9762\uff0c\u5728\u6709\u9700\u8981\u7684\u7bc4\u570d\u5167\u76e1\u91cf\u8207\u6771\u4e3b\u6216\u8a72\u7b49\u5176\u4ed6\u4eba\u5408\u4f5c\uff0c\u4f7f\u8a72\u8cac\u4efb\u6216\u898f\u5b9a\u5f97\u4ee5\u57f7\u884c\u6216\u9075\u5f9e\u3002<\/div>\n<\/div>\n<\/div>\n<div no_heading_follows\">(2)\u4efb\u4f55\u4eba\u9055\u53cd\u7b2c(1)\u6b3e\u7684\u898f\u5b9a\uff0c\u5373\u5c6c\u72af\u7f6a\uff0c\u53ef\u8655\u7b2c4\u7d1a\u7f70\u6b3e\u3002<\/div>\n<div class=\"hklm_content\">\n<div class=\"hklm_sourceNote\">(\u7531<span class=\"hklm_ref \"><a class=\"hklm_ref source-note\">1997\u5e74\u7b2c40\u865f\u7b2c3\u689d<\/a><\/span>\u4fee\u8a02)<\/div>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603438_028\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(3)\u5728\u5de5\u696d\u7d93\u71df\u4e2d\u53d7\u50f1\u7684\u4eba\u7121\u5408\u7406\u8faf\u89e3\u800c\u6545\u610f\u65bc\u5de5\u4f5c\u6642\u4f5c\u51fa\u4efb\u4f55\u76f8\u7576\u53ef\u80fd\u5371\u53ca\u4ed6\u672c\u4eba\u6216\u4ed6\u4eba\u7684\u4e8b\u60c5\uff0c\u5373\u5c6c\u72af\u7f6a\uff0c\u53ef\u8655\u7b2c5\u7d1a\u7f70\u6b3e\u53ca\u76e3\u79816\u500b\u6708\u3002<\/div>\n<div class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1)It shall be the duty of every person employed at an industrial undertaking while at\u00a0<span class=\"nowrap\">work\u2014<\/span><\/div>\n<div id=\"ID_1438413603391_027\" class=\"hklm_paragraph\">\n<div class=\"hklm_num no_heading_follows\">(a)to take reasonable care for the health and safety of himself and of other persons who may be affected by his acts or omissions at work; and<\/div>\n<\/div>\n<div id=\"ID_1438413603407_006\" class=\"hklm_paragraph\">\n<div class=\"hklm_num no_heading_follows\">(b)as regards any duty or requirement imposed on a proprietor of the industrial undertaking or on any other person by this Ordinance for securing the health and safety of persons no_heading_follows\">(1)\u53d7\u50f1\u65bc\u4efb\u4f55\u5de5\u696d\u7d93\u71df\u4e2d\u7684\u4eba\uff0c\u4e0d\u5f97\u6545\u610f\u5e72\u64fe\u6216\u4e0d\u7576\u5730\u4f7f\u7528\u70ba\u78ba\u4fdd\u53d7\u50f1\u65bc\u8a72\u5de5\u696d\u7d93\u71df\u7684\u4eba\u7684\u5065\u5eb7\u3001\u5b89\u5168\u6216\u798f\u5229\u800c\u4f9d\u64da\u672c\u689d\u4f8b\u63d0\u4f9b\u7684\u5de5\u5177\u3001\u5668\u5177\u3001\u8a2d\u65bd\u6216\u5176\u4ed6\u7269\u4ef6\uff0c\u800c\u51e1\u6709\u70ba\u78ba\u4fdd\u5065\u5eb7\u6216\u5b89\u5168\u800c\u6839\u64da\u672c\u689d\u4f8b\u63d0\u4f9b\u7d66\u4e0a\u8ff0\u7684\u4eba\u4f7f\u7528\u7684\u5de5\u5177\u6216\u5668\u5177\uff0c\u8a72\u4eba\u9808\u4e88\u4ee5\u4f7f\u7528\u3002<\/div>\n<\/div>\n<div belt<\/strong><\/h4>\n<p>\u6bcf\u540d\u5728\u5efa\u7bc9\u5730\u76e4\u5de5\u4f5c\u4e26\u7372\u63d0\u4f9b\u5b89\u5168\u5e36\u7684\u4eba\uff0c\u6bcf\u7576\u70ba\u5176\u672c\u4eba\u6216\u70ba\u5176\u4ed6\u4eba\u7684\u5b89\u5168\u800c\u9700\u8981\u4f7f\u7528\u5b89\u5168\u5e36\u6642\uff0c\u5747\u9808\u914d\u6234\u5b89\u5168\u5e36\uff0c\u4e26\u9808\u4fdd\u6301\u5c07\u5b89\u5168\u5e36\u4e00\u76f4\u7e6b\u65bc\u7a69\u56fa\u7684\u7e6b\u7a69\u7269\u3002<\/p>\n<p>Every person working on a construction site who has been provided with a safety belt shall wear it and keep it attached to a secure anchorage whenever the use of the belt is necessary for his own or any
