REGULATIONS [\u4fd7\u7a31CS(S)R]\u300a\u5efa\u7bc9\u5730\u76e4( \u5b89\u5168) \u898f\u4f8b\u300b\u7684\u898f\u7bc4.<\/p>\n<p>\u5728 CS(S)R \u7684 <strong>Regulation 38A<\/strong>\u53ca<strong>38AA<\/strong>\u5206\u5225\u6307\u51fa Contractor (\u627f\u5efa\u5546) \u53ca Other contractors (\u5176\u4ed6\u627f\u5efa\u5546) \u90fd\u5177\u6709\u4e0b\u5217\u7684<strong>\u4e00\u822c\u6027\u8cac\u4efb\u689d\u6b3e<\/strong> (General Duties):<\/p>\n<ul>\n<li><strong>identify<\/strong> the hazardous conditions of persons working at a height in the construction site;<br \/>\n\u627e\u51fa\u5728\u5efa\u7bc9\u5730\u76e4\u5167\u9ad8\u8655\u5de5\u4f5c\u7684\u4eba\u7684\u5371\u96aa\u72c0\u6cc1<\/li>\n<li><strong>rectify<\/strong> any hazardous conditions of persons working at a height in the construction site; and<br \/>\n\u7cfe\u6b63\u4efb\u4f55\u5728\u5efa\u7bc9\u5730\u76e4\u5167\u9ad8\u8655\u5de5\u4f5c\u7684\u4eba\u7684\u5371\u96aa\u72c0\u6cc1<\/li>\n<li><img loading=\"lazy\" decoding=\"async\" class=\"size-thumbnail wp-image-6500 alignright\" src=\"https:\/\/tommykwan.com\/blog\/wp-content\/uploads\/2020\/11\/work-platform-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" srcset=\"https:\/\/tommykwan.com\/blog\/wp-content\/uploads\/2020\/11\/work-platform-150x150.jpg 150w, https:\/\/tommykwan.com\/blog\/wp-content\/uploads\/2020\/11\/work-platform-100x100.jpg 100w\" sizes=\"auto, (max-width: 150px) 100vw, 150px\" \/><strong>safeguard<\/strong> any person working at a height in the construction site against all hazardous conditions.<br \/>\n\u9632\u6b62\u4efb\u4f55\u5728\u5efa\u7bc9\u5730\u76e4\u5167\u9ad8\u8655\u5de5\u4f5c\u7684\u4eba\u9047\u5230\u5404\u7a2e\u5371\u96aa\u72c0\u6cc1<\/li>\n<li>shall ensure that, so far as is reasonably practicable, suitable and adequate <strong>safe access to and egress<\/strong> from every place of work on the site is provided and properly maintained.<br \/>\n\u5728\u5efa\u7bc9\u5730\u76e4\u5167\u6bcf\u500b\u5de5\u4f5c\u5730\u65b9\uff0c\u63d0\u4f9b\u9069\u7576\u548c\u8db3\u5920\u7684\u5b89\u5168\u9032\u51fa\u53e3\uff0c\u4e14\u9808\u59a5\u70ba\u7dad\u4fee\u6bcf\u500b\u5de5\u4f5c\u5730\u65b9\u7684\u5b89\u5168\u9032\u51fa\u53e3<\/li>\n<li>shall take suitable and adequate steps to ensure that, so far as is reasonably practicable, no person gains access to any place on the site where any hazardous conditions are present.<br \/>\n\u63a1\u53d6\u9069\u7576\u548c\u8db3\u5920\u7684\u6b65\u9a5f\uff0c\u4ee5\u78ba\u4fdd\u6c92\u6709\u4eba\u5f97\u4ee5\u9032\u5165\u5efa\u7bc9\u5730\u76e4\u5167\u4efb\u4f55\u6709\u5371\u96aa\u72c0\u6cc1\u7684\u5730\u65b9<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>\u91dd\u5c0d \u300c<strong>\u9632\u6b62\u58ae\u4e0b\u300d\u7684\u90e8\u5206, CS(S)R <\/strong>\u7684<strong> Regulation 38B (1) \u53ca (1A) <\/strong>\u5206\u5225\u6307\u51fa\u5efa\u7bc9\u5730\u76e4\u7684\u627f\u5efa\u5546 (contractor responsible for any construction site) <strong>\u53ca<\/strong>\u4efb\u4f55\u76f4\u63a5\u63a7\u5236\u4efb\u4f55\u5efa\u7bc9\u5de5\u7a0b\u7684\u627f\u5efa\u5546 (any contractor who has direct control over any construction work) \u9808\u63a1\u53d6&#8221;\u8db3\u5920\u7684\u6b65\u9a5f&#8221; (adequate steps) \u9632\u6b62\u8a72\u5730\u76e4\u5167\u6709\u4efb\u4f55\u4eba\u5f9e\u9ad8\u5ea6\u4e0d\u5c11\u65bc2 \u7c73\u4e4b\u8655\u58ae\u4e0b ;<\/p>\n<p>Regulation <strong>38B (2)<\/strong> \u898f\u5b9a:<\/p>\n<blockquote><p><strong>&#8220;\u8db3\u5920\u7684\u6b65\u9a5f&#8221;<\/strong> <strong>(adequate steps) <\/strong>\u5305\u62ec\u8a2d\u7f6e\u3001\u4f7f\u7528\u53ca\u7dad\u4fee\u4ee5\u4e0b\u4e00\u9805\u6216\u591a\u65bc\u4e00\u9805\u5b89\u5168\u8a2d\u5099 \u2014<br \/>\n(a) \u5de5\u4f5c\u5e73\u53f0\uff1b<br \/>\n(b) \u8b77\u6b04\u3001\u5c4f\u969c\u3001\u5e95\u8b77\u677f\u53ca\u570d\u6b04\uff1b<br \/>\n(c) \u5b54\u6d1e\u7684\u8986\u84cb\u7269\uff1b<br \/>\n(d) \u6728\u677f\u8def\u53ca\u8def\u5f91\u3002<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p>Regulation <strong>38B (3) <\/strong>\u898f\u5b9a:<\/p>\n<p>Paragraphs<strong> (1)<\/strong> and<strong> (1A)<\/strong> shall <strong>not apply<\/strong> to any opening, corner, break or edge exposed <strong>in the course of demolition operations<\/strong> if adequate precautions have been taken to prevent any person from being exposed to the risk of falling therefrom.<\/p>\n<p>\u51e1\u5df2\u63a1\u53d6\u8db3\u5920\u7684\u9810\u9632\u63aa\u65bd\uff0c\u4ee5\u9632\u6b62\u4efb\u4f55\u4eba\u6709\u5f9e\u5728\u62c6\u5378\u5de5\u7a0b\u4e2d\u66b4\u9732\u51fa\u4f86\u7684\u5b54\u6d1e\u3001\u89d2\u4f4d\u3001\u88c2\u53e3\u6216\u908a\u7de3\u58ae\u4e0b\u7684\u5371\u96aa\uff0c\u7b2c(1)\u53ca(1A)\u6b3e\u4e26\u4e0d\u9069\u7528\u65bc\u8a72\u7b49\u5b54\u6d1e\u3001\u89d2\u4f4d\u3001\u88c2\u53e3\u6216\u908a\u7de3\u3002<\/p>\n<p>&nbsp;<\/p>\n<p>\u53e6\u5916, Regulation <strong>38B (4)<\/strong> \u898f\u5b9a:<\/p>\n<p>Every <strong>working platform<\/strong> (other than a suspended working platform), <strong>guard-rail<\/strong>, barrier, <strong>toe-board<\/strong>, fence, <strong>covering for an opening<\/strong>,<strong> gangway or run<\/strong> provided for the purpose of paragraphs (1) and (1A) shall <strong>comply<\/strong> <strong>with<\/strong> the provisions of the <strong>Third Schedule<\/strong> applicable to it.<\/p>\n<p>\u70ba\u65bd\u884c\u7b2c(1) \u53ca(1A) \u6b3e\u800c\u8a2d\u7f6e\u7684\u6bcf\u4e00\u5de5\u4f5c\u5e73\u53f0( \u540a\u8239\u9664\u5916)\u3001\u8b77\u6b04\u3001\u5c4f\u969c\u3001\u5e95\u8b77\u677f\u3001\u570d\u6b04\u3001\u5b54\u6d1e\u7684\u8986\u84cb\u7269\u3001\u6728\u677f\u8def\u6216\u8def\u5f91\uff0c\u9808\u7b26\u5408<strong>\u9644\u88683<\/strong> \u5167\u9069\u7528\u65bc\u8a72\u7b49\u5b89\u5168\u8a2d\u5099\u7684\u689d\u6587\u3002<\/p>\n<p>&nbsp;<\/p>\n<p>\u800c\u5728 <a href=\"https:\/\/www.labour.gov.hk\/eng\/public\/os\/A\/RM_Sites.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Reference Manual for Inspection Reports on Construction Sites<\/a> \u7684 <strong>C-141 to C-157<\/strong> \u5c31\u662f\u5beb\u51fa<strong>CS(S)R Schedule 3 (\u9644\u88683) \u7684\u5167\u5bb9<\/strong>\u00a0 :<\/p>\n<p>C-141 \u6307\u51fa, \u8a72\u7b49\u6b65\u9a5f\u5305\u62ec\u4f46\u4e0d\u9650\u65bc<strong>\u8a2d\u7f6e<\/strong>\u3001<strong>\u4f7f\u7528<\/strong>\u53ca<strong>\u7dad\u4fee (provision, use and maintenance):<\/strong><\/p>\n<ol>\n<li>\u5de5\u4f5c\u5e73\u53f0 (working platforms)\n<ul>\n<li>\u6728\u677f\u8def\u53ca\u8def\u5f91 (gangways and runs)<\/li>\n<\/ul>\n<\/li>\n<li>\u8b77\u6b04 (guard-rails)<\/li>\n<li>\u5e95\u8b77\u677f (toe-boards)<\/li>\n<li>\u5c4f\u969c (barriers)<\/li>\n<li>\u570d\u6b04 (fences)<\/li>\n<li>\u5b54\u6d1e\u7684\u8986\u84cb\u7269 (coverings for openings)<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<h5>\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u53ca\u8def\u5f91\u7684<span style=\"color: #ff0000;\">\u95ca\u5ea6<\/span>\u00a0 (<span style=\"color: #ff0000;\">Width<\/span> of working platforms, gangways and runs)<\/h5>\n<ol>\n<li>C-142<br \/>\nThe width of any working platform, gangway or run shall be <strong>not less than 400 millimetres.<br \/>\n<\/strong>\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u6216\u8def\u5f91\u7684<strong>\u95ca\u5ea6<\/strong>\u4e0d\u5f97\u5c0f\u65bc<strong>400 \u6beb\u7c73<\/strong><\/li>\n<li>C-143<br \/>\nThe width of any <strong>gangway or run<\/strong> used <strong>for<\/strong> the<strong> movement of materials<\/strong> shall be<strong> not less than 650 millimetres.<\/strong><br \/>\n\u7528\u65bc\u642c\u904b\u7269\u6599\u7684\u6728\u677f\u8def\u6216\u8def\u5f91\u7684<strong>\u95ca\u5ea6<\/strong>\u4e0d\u5f97\u5c0f\u65bc<strong>650 \u6beb\u7c73<\/strong><\/li>\n<li>C-144<br \/>\nWhere it is <strong>impracticable by reason of limitations of space<\/strong> to provide a working platform, gangway or run of the width of either not less than 400 millimetres or, for the movement of materials, not less than 650 millimetres, then the working platform, ganway or run shall be <strong>as wide as is reasonably practicable.<\/strong><br \/>\n\u51e1\u56e0\u7a7a\u9593\u7684\u9650\u5236\u4ee5\u81f4\u8a2d\u7f6e\u4e0d\u5c0f\u65bc400 \u6beb\u7c73\u6216\u4e0d\u5c0f\u65bc650\u6beb\u7c73(\u7528\u65bc\u642c\u904b\u7269\u6599) \u95ca\u5ea6\u7684\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u6216\u8def\u5f91\u4e0d<br \/>\n\u5c6c\u5207\u5be6\u53ef\u884c\uff0c\u5247\u8a72\u7b49\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u6216\u8def\u5f91<strong>\u9808\u5728\u5408\u7406\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\u76e1\u91cf\u5bec\u95ca<\/strong>\u3002<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<h5>\u5de5\u4f5c\u5e73\u53f0\u7b49<span style=\"color: #ff0000;\">\u4ee5\u593e\u677f\u7b49\u92ea\u5bc6<\/span> (Working platforms, etc. to <span style=\"color: #ff0000;\">be closely boarded<\/span>, etc.)<\/h5>\n<ol>\n<li>C-145<br \/>\nEvery working platform, gangway and run shall be<strong> closely boarded<\/strong> or <strong>planked.<\/strong><br \/>\n\u6bcf\u4e00\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u6216\u8def\u5f91\u9808\u4ee5<strong>\u593e\u677f<\/strong>\u00a0\/\u00a0<strong>\u6728\u677f\u92ea\u5bc6<\/strong><\/li>\n<li>C-146<br \/>\n<strong>Interstices of open metal work<\/strong> forming every working platform, gangway or run where there is no risk of persons below the platform or gangway or run being struck by materials or articles falling through the platform, gangway or run shall <strong>not exceed 4 000 square millimetres in area.<\/strong><br \/>\n\u7d44\u6210\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u53ca\u8def\u5f91\u7684<strong>\u6709\u5b54\u7684\u91d1\u5c6c\u7269<\/strong>\uff0c\u5728\u6c92\u6709\u4eba\u6703\u906d\u7a7f\u904e\u8a72\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u53ca\u8def\u5f91\u58ae\u4e0b\u7684\u7269\u6599\u6216<br \/>\n\u7269\u54c1\u64ca\u4e2d\u7684\u60c5\u6cc1\u4e0b\uff0c\u4efb\u4f55<strong>\u5b54<\/strong>\u7684<strong>\u9762\u7a4d\u5747\u4e0d\u5f97\u8d85\u903e4 000 \u5e73\u65b9\u6beb\u7c73\u3002<\/strong><\/li>\n<li>C-147<br \/>\nThe boards or planks of every working platform, ganway or run where there is no risk of persons below the platform, gangway or run being struck by materials or articles falling through the platform, gangway or run shall be so secured as to prevent their moving and be so placed that the <strong>space between adjacent boards or planks does not exceed 25 millimetres.<\/strong><br \/>\n\u7d44\u6210\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u53ca\u8def\u5f91\u7684\u593e\u677f\u6216\u6728\u677f\uff0c\u5728\u6c92\u6709\u4eba\u6703\u906d\u7a7f\u904e\u8a72\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u53ca\u8def\u5f91\u58ae\u4e0b\u7684\u7269\u6599\u6216\u7269\u54c1<br \/>\n\u64ca\u4e2d\u7684\u60c5\u6cc1\u4e0b\uff0c\u9019\u4e9b\u593e\u677f\u6216\u6728\u677f\u7684\u7a69\u56fa\u7a0b\u5ea6\u9808\u8db3\u4ee5\u9632\u6b62\u5176\u79fb\u52d5\uff0c\u800c<strong>\u76f8\u9130<\/strong>\u7684<strong>\u593e\u677f<\/strong>\u6216<strong>\u6728\u677f\u4e4b\u9593\u7684\u7a7a\u9593\u4e0d\u5f97\u8d85\u903e25<\/strong><br \/>\n<strong>\u6beb\u7c73\u3002<\/strong><\/li>\n<\/ol>\n<h5>\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u53ca\u8def\u5f91\u7684<span style=\"color: #ff0000;\">\u593e\u677f\u53ca\u6728\u677f<\/span> (<span style=\"color: #ff0000;\">Boards and planks<\/span> in working platforms, gangways and runs)<\/h5>\n<ol>\n<li>C-148<br \/>\nEvery board or plank forming part of a working platform, gangway or run shall be of <strong>sound construction<\/strong>, <strong>adequate strength<\/strong> and <strong>free from patent defect.<\/strong><br \/>\n\u593e\u677f\u6216\u6728\u677f\u9808<strong>\u69cb\u9020\u826f\u597d<\/strong>\uff0c<strong>\u6709\u8db3\u5920\u7684\u5f37\u5ea6<\/strong>\uff0c\u4e14<strong>\u7121\u660e\u986f\u6b20\u59a5\u4e4b\u8655<\/strong><\/li>\n<li>C-149<br \/>\nEvery board or plank forming part of a working platform, gangway or run shall be of a<strong> thickness<\/strong> capable of <strong>affording adequate security<\/strong> having <strong>regard to the distance between the supports<\/strong> and be <strong>not less than 200 millimetres in width<\/strong> and<strong> not less than 25 millimetres in thickness<\/strong> OR <strong>not less than 150 millimetres in width when<\/strong> the board or plank <strong>exceeds 50 millimetres in thickness.<\/strong><br \/>\n\u5728\u9867\u53ca\u652f\u6301\u7269\u4e4b\u9593\u7684\u8ddd\u96e2\u4e0b\uff0c\u5176\u539a\u5ea6\u80fd\u5920\u63d0\u4f9b\u8db3\u5920\u7684\u5b89\u5168\u4fdd\u969c\uff0c\u5176<strong>\u95ca\u5ea6<\/strong>\u4e0d\u5f97\u5c0f\u65bc<strong>200 \u6beb\u7c73<\/strong>\u800c<strong>\u539a\u5ea6<\/strong>\u4e0d\u5f97\u5c0f\u65bc<strong>25<\/strong><br \/>\n<strong>\u6beb\u7c73<\/strong>\uff1b<strong>\u6216<\/strong>\u5982\u8a72\u593e\u677f\u6216\u6728\u677f\u7684<strong>\u539a\u5ea6\u8d85\u903e50 \u6beb\u7c73<\/strong>\uff0c\u5247\u5176<strong>\u95ca\u5ea6\u4e0d\u5f97\u5c0f\u65bc150 \u6beb\u7c73<\/strong><\/li>\n<li>C-150<br \/>\nEvery board or plank forming part of a working platform, gangway or run shall <strong>not protrude beyond its end support<\/strong> to a distance exceeding<strong> 150 millimetres<\/strong> unless it is sufficiently secured to prevent tipping.<br \/>\n\u4f5c\u70ba\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u53ca\u8def\u5f91\u7d44\u6210\u90e8\u5206\u7684\u593e\u677f\u6216\u6728\u677f\uff0c\u9664\u975e\u7d93\u5145\u5206\u5730\u7a69\u56fa\u4ee5\u9632\u6b62\u50be\u659c\uff0c\u5426\u5247\u4e0d\u5f97\u4f38\u51fa\u5176\u672b\u7aef\u652f<br \/>\n\u6301\u7269\u8d85\u903e150 \u6beb\u7c73\u4e4b\u5916<\/li>\n<li>C-151<br \/>\nEvery <strong>board or plank<\/strong> forming part of a working platform, gangway or run shall <strong>rest securely<\/strong> and <strong>evenly<\/strong> on its supports.<br \/>\n\u4f5c\u70ba\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u53ca\u8def\u5f91\u7d44\u6210\u90e8\u5206\u7684<strong>\u593e\u677f\u6216\u6728\u677f<\/strong>\uff0c \u9808<strong>\u7a69\u56fa\u548c\u5e73\u5766\u5730\u64f1\u5728\u5176\u652f\u6301\u7269\u4e0a\u3002<\/strong><\/li>\n<li>C-152<br \/>\nEvery<strong> board or plank<\/strong> forming part of a working platform, gangway or run shall <strong>rest on at least 3 supports<\/strong> unless, taking into account the distance between the supports and the thickness of the board or plank the conditions are such as to prevent undue or unequal sagging.<br \/>\n\u4f5c\u70ba\u5de5\u4f5c\u5e73\u53f0\u3001\u6728\u677f\u8def\u53ca\u8def\u5f91\u7d44\u6210\u90e8\u5206\u7684<strong>\u593e\u677f\u6216\u6728\u677f<\/strong>\uff0c \u9808<strong>\u64f1\u5728\u81f3\u5c113 \u500b\u652f\u6301\u7269\u4e0a<\/strong>\uff0c\u9664\u975e\u5728\u9867\u53ca\u652f\u6301\u7269\u4e4b\u9593\u7684\u8ddd<br
