Employers to ensure safety and health of employees<\/h4>\n<p>(1) Every employer must, so far as reasonably practicable, ensure the<strong> safety and health at work of all<\/strong> the employer\u2019s <strong>employees<\/strong>.<br \/>\n(2) The cases in which an employer fails to comply with subsection (1) include (but are not limited to) the following\u2014<\/p>\n<ul>\n<li>(a) a failure to<em> provide<\/em> or <em>maintain<\/em> <strong>plant and systems of work<\/strong> that are, so far as reasonably practicable, safe and without risks to health;<\/li>\n<li>(b) a failure to make arrangements for ensuring, so far as reasonably practicable, safety and absence of risks to health in connection with the <strong>use<\/strong>, <strong>handling<\/strong>, <strong>storage<\/strong> or <strong>transport<\/strong> of<strong> plant or substances<\/strong>;<\/li>\n<li>(c) a failure to provide such<strong> information<\/strong>, <strong>instruction<\/strong>, <strong>training<\/strong> and <strong>supervision<\/strong> as may be necessary to ensure, so far as reasonably practicable, the safety and health at work of the employer\u2019s employees;<\/li>\n<li>(d) as regards any workplace under the employer\u2019s control\u2014\n<ul>\n<li>(i) a failure to maintain the workplace in a condition that is, so far as reasonably practicable, safe and without risks to health; or<\/li>\n<li>(ii) a failure to <em>provide<\/em> or<em> maintain<\/em> <strong>means of access to and egress from<\/strong> the workplace that are, so far as reasonably practicable, safe and without any such risks;<\/li>\n<\/ul>\n<\/li>\n<li>(e) a failure to <em>provide<\/em> or <em>maintain<\/em> a <strong>working environment<\/strong> for the employer\u2019s employees that is, so far as reasonably practicable, safe and without risks to health.<\/li>\n<\/ul>\n<p>(3) An employer who fails to comply with subsection (1) commits an offence and is liable on conviction to a fine of $200,000.<br \/>\n(4) An employer who fails to comply with subsection (1) intentionally, knowingly or recklessly commits an offence and is liable on conviction to a fine of $200,000 and to imprisonment for 6 months.<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<blockquote>\n<h4>7.
