{"id":6261,"date":"2020-11-09T19:55:13","date_gmt":"2020-11-09T11:55:13","guid":{"rendered":"https:\/\/tommykwan.com\/blog\/?p=6261"},"modified":"2020-12-14T16:34:28","modified_gmt":"2020-12-14T08:34:28","slug":"labelling-requirements-and-exemption-of-dangerous-substance-in-cap59ab","status":"publish","type":"post","link":"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/labelling-requirements-and-exemption-of-dangerous-substance-in-cap59ab\/","title":{"rendered":"Labelling requirements and exemption of dangerous substance in Cap59AB"},"content":{"rendered":"[Ref <a href=\"https:\/\/www.elegislation.gov.hk\/hk\/cap59AB!en-zh-Hant-HK?INDEX_CS=N\" target=\"_blank\" rel=\"noopener noreferrer\">Cap 59AB<\/a>]\n<blockquote><p>According to <strong>Cap59AB 7<\/strong> Exempt containers<br \/>\nRegulations 5 and 6 do not apply to a container that\u2014<\/p>\n<p>(a) is clearly labelled in English AND Chinese with particulars that are substantially the same as those<br \/>\nprescribed by regulation 8 and that holds a substance that was supplied to the industrial undertaking in that container; OR<br \/>\n(b) is inside a package that is labelled in accordance with regulation 5 or 6, as the case may be, or in accordance with the Dangerous Goods (General) Regulations (Cap. 295 sub. leg. B);<br \/>\n\u5df2\u6309\u7167\u7b2c5 \u6216 6 \u689d( \u8996\u5c6c\u4f55\u60c5\u6cc1\u800c\u5b9a) \u52a0\u4ee5\u6a19\u7c64\uff0c\u6216\u5df2\u6309\u7167\u300a\u5371\u96aa\u54c1( \u4e00\u822c) \u898f\u4f8b\u300b( \u7b2c295 \u7ae0\uff0c\u9644\u5c6c\u6cd5\u4f8bB)<br \/>\nOR<br \/>\n(c) holds a substance\u2014<\/p>\n<ul>\n<li>(i) produced in the industrial undertaking<br \/>\n\u5728IU\u4e2d\u751f\u7522<\/li>\n<li>(ii) not intended to be used in the industrial undertaking; and<br \/>\n\u4e0d\u64ec\u5728IU\u4e2d\u4f7f\u7528\uff1b\u53ca<\/li>\n<li>(iii) intended to be supplied elsewhere in that container;<br \/>\n\u64ec\u7528\u8a72\u5bb9\u5668\u76db\u8f09\u7740\u5728\u5225\u7684\u5730\u65b9\u4f9b\u61c9\uff1b\u6216<br \/>\nOR<\/li>\n<\/ul>\n<p>(d) holds <strong>less than 125 millilitres<\/strong> of\u2014<\/p>\n<ul>\n<li>(i) a <strong>listed substance<\/strong> that is <strong>not classified<\/strong> in column 2 of the First Schedule as <strong>explosive<\/strong>, <strong>toxic<\/strong>, <strong>corrosive<\/strong> or<strong> flammable<\/strong>; OR<\/li>\n<li>(ii) a <strong>dangerous mixture<\/strong> that is not an explosive, corrosive or flammable mixture and that does <strong>not contain more than<\/strong> 1 per cent by weight (<strong>1%\/w<\/strong>) of any <strong>toxic<\/strong> substance or substances.<\/li>\n<\/ul>\n<\/blockquote>\n<p>&nbsp;<\/p>\n<blockquote><span class=\"su-highlight\" style=\"background:#fbfb62;color:#000000\">&nbsp;Required particulars \u67095 \u6a23\u91ce~&nbsp;<\/span>\n<p>According to<strong> Cap59AB 8<\/strong>\u00a0Required particulars (\u898f\u5b9a\u8a73\u60c5):<br \/>\nThe particulars required by regulations 5 and 6 relating to a listed substance are as follows\u2014<\/p>\n<ol>\n<li>(a) the<strong> chemical<\/strong> <strong>name<\/strong> OR <strong>common name<\/strong> of the substance (\u5316\u5b78\u540d\u7a31\u6216\u666e\u901a\u540d\u7a31);<\/li>\n<li>(b) the<strong> classification<\/strong> of the substance as stated in column 2 of the First Schedule; (\u7269\u8cea\u7684\u5206\u985e)<\/li>\n<li>(c) the <strong>symbol<\/strong> or symbol<strong>s<\/strong>\u00a0specified in respect of that classification in column 2 of the Second Schedule;\u00a0(\u7b26\u865f)<\/li>\n<li>(d) the<strong> indication of the particular risk<\/strong> or risks inherent in the substance as stated in the Third Schedule opposite the number or numbers specified in respect of the substance in column 3 of the First Schedule (\u56fa\u6709\u5371\u96aa\u60c5\u6cc1\u7684\u6307\u793a)<\/li>\n<li>(e) the<strong> indication of the safety precautions<\/strong> <strong>required<\/strong> in respect of the substance as stated in the Fourth Schedule opposite the number or numbers specified in respect of that substance in column 4 of the First Schedule. (\u9808\u63a1\u53d6\u7684\u5b89\u5168\u63aa\u65bd\u7684\u6307\u793a)<\/li>\n<\/ol>\n<\/blockquote>\n<p>&nbsp;<\/p>\n<blockquote><p>According to<strong> Cap59AB 9<\/strong> Form and size of labelling (\u6a19\u7c64\u7684\u683c\u5f0f\u53ca\u5927\u5c0f):<\/p>\n<p>(1) A container that is required to be labelled under regulation 5 or 6 shall be labelled in accordance with this regulation.<br \/>\n(2) The <strong>container<\/strong> shall be labelled\u2014<\/p>\n<ul>\n<li>(a) in English AND Chinese (\u4e2d\u6587<strong>\u53ca<\/strong>\u82f1\u6587) ;<\/li>\n<li>(b) in the form prescribed by the Second Schedule (\u4f9d\u7167<strong>\u9644\u88682<\/strong> \u6240\u8a02\u660e\u7684<strong>\u683c\u5f0f<\/strong>); AND<\/li>\n<li>(c) in such a way that the particulars prescribed by regulation 8 <strong>can be read easily<\/strong> when the container is placed as it may normally be expected to be placed (\u7b2c8\u689d\u6240\u8a02\u660e\u7684\u8a73\u60c5<strong>\u80fd\u6613\u65bc\u770b\u898b<\/strong>)<\/li>\n<\/ul>\n<p>(3) The particulars prescribed by regulation 8 shall be <strong>clearly and indelibly marked<\/strong> and shall <strong>stand out sharply from their background<\/strong>\u00a0 \u7b2c8 \u689d\u6240\u8a02\u660e\u7684\u8a73\u60c5\u9808\u4e0d\u80fd\u6d88\u9664\u7684\u65b9\u5f0f\u6e05\u6670\u5730\u6a19\u660e\uff0c\u4e26\u9808\u9bae\u660e\u5730\u7a81\u51fa\u65bc\u80cc\u666f\u4e2d \u2014<\/p>\n<ul>\n<li>(a) on a part of the container reserved for that purpose (which part shall the purposes of these regulations be treated as a label) \u5bb9\u5668\u4e0a\u9810\u7559\u7684\u90e8\u5206; <strong>OR<\/strong><\/li>\n<li>(b) on a label that is securely fixed to the container with its entire back in contact with the container \u6a19\u7c64\u80cc\u9762\u5b8c\u5168\u7dca\u8cbc\u5bb9\u5668\u8005; <strong>OR<\/strong><\/li>\n<li>(c) where it is not reasonably practicable to comply with sub-paragraphs (a) and (b), on a label attached in some other suitable manner<\/li>\n<\/ul>\n<p>(4) The <strong>dimensions of the label<\/strong> shall be as follows\u2014<\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"42\"><\/td>\n<td width=\"192\">Capacity of container<\/td>\n<td width=\"198\">Dimensions of label<\/td>\n<\/tr>\n<tr>\n<td width=\"42\">a)<\/td>\n<td width=\"192\">3 litres or less<\/td>\n<td width=\"198\">not less than 50 mm \u00d7 75<\/p>\n<p>mm<\/td>\n<\/tr>\n<tr>\n<td width=\"42\">b)<\/td>\n<td width=\"192\">exceeding 3 litres<\/p>\n<p>but not exceeding 50 litres<\/td>\n<td width=\"198\">not less than 75 mm \u00d7 100<\/p>\n<p>mm<\/td>\n<\/tr>\n<tr>\n<td width=\"42\">c)<\/td>\n<td width=\"192\">exceeding 50 litres<\/p>\n<p>but not exceeding 500 litres<\/td>\n<td width=\"198\">not less than 100 mm \u00d7 150<\/p>\n<p>mm<\/td>\n<\/tr>\n<tr>\n<td width=\"42\">d)<\/td>\n<td width=\"192\">exceeding 500 litres<\/td>\n<td width=\"198\">not less than 150 mm \u00d7 200<\/p>\n<p>mm<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>(5) The size of any symbol required to be shown on the label shall be not less than one-tenth of the area of the label and shall not in any case be less than 100 mm2.<br \/>\n\u51e1\u898f\u5b9a\u5728\u6a19\u7c64\u4e0a\u6a19\u660e\u7684\u7b26\u865f\uff0c\u5728\u4efb\u4f55\u60c5\u6cc1\u4e0b\u5747\u9808\u4e0d\u5c0f\u65bc100 \u5e73\u65b9\u6beb\u7c73<br \/>\n(6) A container is not labelled in accordance with this regulation if it bears particulars that do not relate to its contents and those particulars appear in a way that is confusing or misleading.<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<blockquote><p>According to <strong>Cap59AB 10<\/strong> Form and place of notice (\u544a\u793a\u7684\u683c\u5f0f\u53ca\u5730\u9ede)<br \/>\nA notice in respect of a <a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-dangerous-substance-%e5%8d%b1%e9%9a%aa%e7%89%a9%e8%b3%aa-dangerous-mixture-%e5%8d%b1%e9%9a%aa%e6%b7%b7%e5%90%88%e7%89%a9-listed-substance\/\" target=\"_blank\" rel=\"noopener noreferrer\">dangerous substance<\/a> is displayed in accordance with this regulation if (and only if)\u2014<br \/>\n(a) it is in English AND Chinese (\u4e2d\u6587\u53ca\u82f1\u6587);<br \/>\n(b) it identifies the container or containers holding that substance (\u80fd\u8b58\u5225\u76db\u8f09\u8a72\u7269\u8cea\u7684\u5bb9\u5668);<br \/>\n(c) it clearly and indelibly sets out the particulars prescribed by regulation 8 (\u4e0d\u80fd\u6d88\u9664\u7684\u65b9\u5f0f\u6e05\u6670\u5730\u5217\u51fa\u7b2c8 \u689d\u6240\u8a02\u660e\u7684\u8a73\u60c5);<br \/>\n(d) it is in a conspicuous place near the<a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-dangerous-substance-%e5%8d%b1%e9%9a%aa%e7%89%a9%e8%b3%aa-dangerous-mixture-%e5%8d%b1%e9%9a%aa%e6%b7%b7%e5%90%88%e7%89%a9-listed-substance\/\" target=\"_blank\" rel=\"noopener noreferrer\"> dangerous substance<\/a> (\u986f\u773c\u7684\u5730\u65b9); and<br \/>\n(e) the size of any symbol required to be shown is not less than one-tenth of the area of the notice (\u5176\u5927\u5c0f\u9808\u4e0d\u5c0f\u65bc\u544a\u793a\u9762\u7a4d\u7684\u5341\u5206\u4e4b\u4e00)<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<div class=\"embed-container\">\n<blockquote class=\"wp-embedded-content\" data-secret=\"TeSLTsNMvI\"><p><a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-dangerous-substance-%e5%8d%b1%e9%9a%aa%e7%89%a9%e8%b3%aa-dangerous-mixture-%e5%8d%b1%e9%9a%aa%e6%b7%b7%e5%90%88%e7%89%a9-listed-substance\/\">What&#8217;s \u201cdangerous substance\u201d (\u5371\u96aa\u7269\u8cea), \u201cdangerous mixture\u201d (\u5371\u96aa\u6df7\u5408\u7269), \u201clisted substance\u201d (\u5217\u8f09\u7269\u8cea)?<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute;
