Prohibition against eating, drinking and smoking<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<h5>Offences and Penalties<\/h5>\n<ul>\n<li>16(1) The <strong>proprietor<\/strong> of an industrial undertaking in respect of which regulation 5 or 6 is contravened commits an offence and is liable to a fine of $50,000.<\/li>\n<li>16 (2) A<strong> proprietor<\/strong> who contravenes regulation 11 commits an offence and is liable to a fine of $50,000.<\/li>\n<li>16 (3) A <strong>proprietor<\/strong> who contravenes regulation 12 commits an offence and is liable to a fine of $50,000.<\/li>\n<li>17 <strong>Any person<\/strong> who contravenes regulation 13, 14 or 15 commits an offence and is liable to a fine of $10,000.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>\u7576\u7c21\u55ae\u4e86\u89e3\u5de6 Proprietor \u53ca Persons employed \u7684\u8cac\u4efb\u8207\u5176\u9055\u53cd\u7f70\u5247, \u4e0b\u9762\u5c31\u662f\u6bd4\u8f03\u8a73\u7d30\u7684\u4f8b<\/p>\n<p>&nbsp;<\/p>\n<blockquote><p><strong>Cap 59AB 5<\/strong> Container holding<a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-dangerous-substance-%e5%8d%b1%e9%9a%aa%e7%89%a9%e8%b3%aa-dangerous-mixture-%e5%8d%b1%e9%9a%aa%e6%b7%b7%e5%90%88%e7%89%a9-listed-substance\/\" target=\"_blank\" rel=\"noopener noreferrer\"> <strong>listed substance<\/strong><\/a> to be labelled:<\/p>\n<p>(1) Subject to regulation 7, <strong>every <\/strong>container holding a listed substance to which these regulations apply shall be <strong>labelled<\/strong> in accordance with regulation 9 with the particulars prescribed by regulation 8 relating to that substance.<br \/>\n\u9664\u7b2c7 \u689d\u53e6\u6709\u898f\u5b9a\u5916\uff0c\u6bcf\u500b\u76db\u8f09\u672c\u898f\u4f8b\u6240\u9069\u7528\u7684\u5217\u8f09\u7269\u8cea\u7684\u5bb9\u5668\uff0c\u5747\u9808\u6309\u7167\u7b2c9 \u689d\u7684\u898f\u5b9a\u52a0\u4ee5\u6a19\u7c64\uff0c\u6a19\u7c64\u4e0a\u9808\u5217\u660e\u7b2c8 \u689d\u6240\u8a02\u660e\u7684\u95dc\u65bc\u8a72\u7269\u8cea\u7684\u8a73\u60c5\u3002<\/p>\n<p>(2) Paragraph <strong>(1) does not apply<\/strong> to a container holding a listed substance where\u2014<\/p>\n<ul>\n<li>(a) it is impossible or not reasonably practicable to comply with paragraph (1) in respect of that container; <strong>and<br \/>\n\u898f\u5b9a\u4e26\u4e0d\u53ef\u80fd\u6216\u4e26\u4e0d\u662f\u5408\u7406\u5207\u5be6\u53ef\u884c<br \/>\n<\/strong><\/li>\n<li>(b) a notice in respect of that listed substance is displayed <strong>in accordance with regulation 10<\/strong> giving the particulars prescribed by regulation 8 relating to that substance.<br \/>\n<strong>\u5df2\u6309\u7167\u7b2c10 \u689d<\/strong>\u7684\u898f\u5b9a<strong>\u5c55\u793a<\/strong>\u8a72\u5217\u8f09\u7269\u8cea\u7684<strong>\u544a\u793a\uff0c\u8a72\u544a\u793a\u4e26\u8f09\u6709\u7b2c8 \u689d\u6240\u8a02\u660e\u7684<\/strong><strong>\u8a73\u60c5\u3002<\/strong><\/li>\n<\/ul>\n<\/blockquote>\n<p>&nbsp;<\/p>\n<blockquote><p><strong>Cap 59AB 6<\/strong> Container holding <a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-dangerous-substance-%e5%8d%b1%e9%9a%aa%e7%89%a9%e8%b3%aa-dangerous-mixture-%e5%8d%b1%e9%9a%aa%e6%b7%b7%e5%90%88%e7%89%a9-listed-substance\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>dangerous mixture<\/strong><\/a> to be labelled:<\/p>\n<p>(1) Subject to regulation 7, <strong>every<\/strong> container holding a dangerous mixture to which these regulations apply shall be<strong> labelled <\/strong>in accordance with regulation 9 with the trade name of that mixture and\u2014<\/p>\n<ul>\n<li>(a) where the mixture contains more than 1 per cent by weight of any <strong>toxic<\/strong> substance or substances, with the particulars <strong>prescribed by regulation 8 relating to each toxic substance that exceeds 0.2 per cent of the weight of the mixture<\/strong>;<br \/>\n\u5247\u9808\u5c31\u6bcf\u7a2e\u91cd\u91cf\u8d85\u903e\u6df7\u5408\u7269\u91cd\u91cf\u767e\u5206\u4e4b\u96f6\u9ede\u4e8c\u7684\u6709\u6bd2\u7269\u8cea\u5217\u660e\u7b2c8 \u689d\u6240\u8a02\u660e\u7684\u8a73\u60c5\uff1b<\/li>\n<li>(b) where the mixture contains more than 10 per cent by weight of any <strong>harmful<\/strong> substance or substances, with the particulars <strong>prescribed by regulation 8 relating to each harmful substance that exceeds 1 per cent of the weight of the mixture;<\/strong><br \/>\n\u9808\u5c31\u6bcf\u7a2e\u91cd\u91cf\u8d85\u903e\u6df7\u5408\u7269\u91cd\u91cf\u767e\u5206\u4e4b\u4e00\u7684\u6709\u5bb3\u7269\u8cea\u5217\u660e\u7b2c8 \u689d\u6240\u8a02\u660e\u7684\u8a73\u60c5\uff1b<\/li>\n<li>(c) where the mixture contains such a proportion of any other listed substance or substances as makes that mixture a corrosive, explosive, flammable, irritant or oxidizing mixture, with the particulars prescribed by regulation 8 relating to each such substance, but if the<br \/>\nmixture contains more than one listed substance that is classified in column 2 of the First Schedule as corrosive, flammable, irritant or oxidizing, it is sufficient for the container to be labelled with the particulars <strong>prescribed by regulation 8 relating to the substance in each such classification that is the most dangerous.<\/strong><br \/>\n\u9808\u5c31\u6bcf\u7a2e\u8a72\u7b49\u5217\u8f09\u7269\u8cea\u5217\u660e\u7b2c8 \u689d\u6240\u8a02\u660e\u7684\u8a73\u60c5\uff0c\u4f46\u5982\u8a72\u6df7\u5408\u7269\u542b\u6709\u591a\u65bc\u4e00\u7a2e\u5728\u9644\u88681 \u7b2c2 \u6b04\u4e2d\u88ab\u5206\u985e\u70ba\u8150\u8755\u6027\u3001\u6613\u71c3\u3001\u523a\u6fc0\u6027\u6216\u52a9\u71c3\u7684\u5217\u8f09\u7269\u8cea\uff0c\u5247\u5bb9\u5668\u4e0a\u53ea\u9808\u6709\u5c31\u6bcf\u7a2e\u8a72\u7b49\u5206\u985e\u4e2d\u5c6c\u6700\u5371\u96aa\u7684\u7269\u8cea\u5217\u660e\u7b2c8 \u689d\u6240\u8a02\u660e\u7684\u8a73\u60c5\u7684\u6a19\u7c64\u5373\u53ef\u3002<\/li>\n<\/ul>\n<p>(2) Paragraph <strong>(1)<\/strong> does <strong>not apply<\/strong> to a container holding a dangerous mixture where\u2014<\/p>\n<ul>\n<li>(a) it is impossible or not reasonably practicable to comply with paragraph (1) in respect of that container; and<\/li>\n<li>(b) a notice in respect of that dangerous mixture is displayed in accordance with regulation 10 giving the trade name of that mixture and the particulars that, but for this paragraph, would be required to be labelled on the container.<\/li>\n<\/ul>\n<\/blockquote>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<blockquote><p><strong>Cap 59AB 11<\/strong> Safety information, training and precautions:<\/p>\n<p>A proprietor of a specified industrial undertaking shall, so far as is reasonably practicable,\u2014<br \/>\n(a) <strong>make available to every<\/strong> <strong>person employed<\/strong> in the undertaking who works with or is likely to come into contact with a dangerous substance to which these regulations apply <strong>adequate information<\/strong> about any conditions necessary to ensure that the substance will be safe and without risk to the health of persons employed in the undertaking;<\/p>\n<p>(b) <strong>ensure<\/strong> that <strong>every person employed<\/strong> in the undertaking who is or may be exposed to a dangerous substance to which these regulations apply\u2014<\/p>\n<ol>\n<li>(i) is <strong>trained<\/strong> in AND <strong>observes<\/strong> <strong>safety precautions<\/strong> relating to that substance;<\/li>\n<li>(ii) is instructed in the <strong>purpose<\/strong>, <strong>proper use<\/strong> and<strong> limitations<\/strong> of any protective clothing or equipment provided; AND<\/li>\n<li>(iii) is instructed in the <strong>health hazards<\/strong> associated with exposure to that substance;<\/li>\n<\/ol>\n<p>(c) make arrangements, including arrangements for <strong>adequate supervision<\/strong>, to prevent a dangerous substance to which these regulations apply from causing bodily injury to any person employed in the undertaking.<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<blockquote><p><strong>Cap 59AB 12<\/strong> Protective clothing and equipment<br \/>\nA proprietor of a specified industrial undertaking shall, so far as is reasonably practicable,\u2014<br \/>\n(a) <strong>provide every person employed<\/strong> in the undertaking who works with or is likely to come into contact with a dangerous substance to which these regulations apply with such <strong>protective clothing and equipment<\/strong> as are appropriate to prevent that substance causing bodily injury to that person;<br \/>\n(b) <strong>ensure<\/strong> that such protective clothing and equipment are <strong>fully and properly used<\/strong> by every such person;<br \/>\n(c) ensure that such protective clothing and equipment are <strong>maintained in good repair and are thoroughly cleansed after<\/strong> <strong>each occasion when they are used<\/strong> and, where any <strong>goggles, spectacles, face shield, respirator or mouth piece<\/strong> is provided under this regulation, that it is thoroughly cleansed and<strong> disinfected<\/strong> after each occasion when it is used; AND<br \/>\n(d)<strong> provide<\/strong> suitable<strong> storage facilities<\/strong> for such protective clothing and equipment.<\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<blockquote><p><strong>Cap 59AB 13<\/strong> Safety precautions to be taken and use of protective clothing<br \/>\nEvery person employed in a specified industrial undertaking where there is any dangerous substance to which these regulations apply shall, so far as is reasonably practicable,\u2014<br \/>\n(a) <strong>follow<\/strong> the <strong>safety instructions<\/strong> given and the procedures set by the proprietor of the industrial undertaking regarding that substance; \u4f9d\u5faa\u5b89\u5168\u6307\u793a<br \/>\n(b) <strong>observe<\/strong> the<strong> safety precautions<\/strong> stated on the label of the container holding that substance or on the notice displayed near that substance; \u9075\u5b88\u5b89\u5168\u63aa\u65bd<br \/>\n(c) <strong>take<\/strong> such <strong>other precautions<\/strong> as are reasonable to prevent that substance from causing bodily injury to himself or others;\u00a0 \u63a1\u53d6\u5176\u4ed6\u5408\u7406\u9810\u9632\u63aa\u65bd<br \/>\n(d) make <strong>full and proper use<\/strong> of the <strong>protective clothing and equipment<\/strong> (if any) provided by the proprietor of the industrial undertaking;
