Proprietor of relevant industrial undertaking not to employ, etc. relevant person who does not have relevant certificate<br \/>\n\u6709\u95dc\u5de5\u696d\u7d93\u71df\u7684\u6771\u4e3b\u4e0d\u5f97\u50f1\u7528\u6c92\u6709\u6709\u95dc\u8b49\u660e\u66f8\u7684\u6709\u95dc\u4eba\u58eb\u7b49\u7b49<\/h5>\n<div>\n<div id=\"ID_1438413603469_004\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1) In this\u00a0<span class=\"nowrap\">section\u2014<\/span><\/div>\n<div class=\"hklm_def\">\n<ul>\n<li class=\"hklm_term\">appointed day (\u6307\u5b9a\u65e5\u671f) means the day appointed under subsection (17);<\/li>\n<li class=\"hklm_term\">certificate (\u8b49\u660e\u66f8) means a certificate referred to in subsection (2);<\/li>\n<li class=\"hklm_term\">equivalent document (\u540c\u7b49\u6587\u4ef6) means a document recognized by the Commissioner for the purposes of <span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">section 6BA(7<span class=\"nowrap\">)(<\/span>a)<\/a><\/span>\u00a0as being equivalent to a person\u2019s relevant certificate;\u00a0(Added\u00a0<span class=\"hklm_ref nowrap\"><a class=\"hklm_ref source-note nowrap\">22 of 2014 s. 41<\/a><\/span>)<\/li>\n<li class=\"hklm_term\"><strong>relevant certificate (\u6709\u95dc\u8b49\u660e\u66f8)<\/strong>, in relation to a relevant person employed at a relevant industrial undertaking, means the certificate issued to the person in respect of his attendance at the relevant safety training course which relates to that undertaking;<\/li>\n<li class=\"hklm_term\">relevant industrial undertaking (\u6709\u95dc\u5de5\u696d\u7d93\u71df) means an industrial undertaking the subject of a notice under subsection (2);<\/li>\n<li class=\"hklm_term\"><strong>relevant person (\u6709\u95dc\u4eba\u58eb)<\/strong>, in relation to a relevant industrial undertaking, means a person the subject of a notice under subsection (2) in the case of that undertaking;<\/li>\n<li class=\"hklm_term\"><strong>relevant safety training course (\u6709\u95dc\u5b89\u5168\u8a13\u7df4\u8ab2\u7a0b)<\/strong>, in relation to a relevant person, means the safety training course the subject of a notice under subsection (2) in the case of the class of persons to which that person belongs.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603500_004\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) The Commissioner may, by notice in the <strong>Gazette<\/strong>, <strong>or<\/strong> by <strong>notice in writing <\/strong>published in such other manner as the Commissioner thinks fit, <strong>recognize a safety training\u00a0<\/strong><span class=\"nowrap\"><strong>course<\/strong>\u2014<br \/>\n\u8655\u9577\u53ef\u85c9<strong>\u61b2\u5831\u516c\u544a\u6216<\/strong>\u4ee5\u5176\u8a8d\u70ba\u9069\u7576\u7684\u5176\u4ed6\u65b9\u5f0f\u767c\u5e03\u7684<strong>\u66f8\u9762\u516c\u544a<\/strong>\uff0c<strong>\u627f\u8a8d<\/strong>\u7b26\u5408\u4ee5\u4e0b\u8aaa\u660e\u7684\u67d0\u9805<strong>\u5b89\u5168\u8a13\u7df4\u8ab2\u7a0b<\/strong><br \/>\n<\/span><\/div>\n<div id=\"ID_1438413603500_012\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) for a class of\u00a0<span class=\"nowrap\">persons <strong>\u70ba<\/strong> \u2014<\/span>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(i) <strong>employed at an industrial undertaking specified in column 1 of <span class=\"hklm_ref \"><a class=\"hklm_ref no-href\"><strong>S<\/strong>chedule 4<\/a><\/span><\/strong>; and<br \/>\n<strong>\u53d7\u50f1\u65bc<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">\u9644\u88684<\/a><\/span>\u7b2c1\u6b04\u6307\u660e\u7684\u5de5\u696d\u7d93\u71df<\/strong>\uff1b\u4e26<\/li>\n<li class=\"hklm_num no_heading_follows\">(ii) belonging to the persons specified opposite the undertaking in column 2 of that\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">Schedule<\/a><\/span>; and<br \/>\n\u5c6c\u5728\u8a72<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">\u9644\u8868<\/a><\/span>\u7b2c2\u6b04\u76f8\u5c0d\u65bc\u8a72\u5de5\u696d\u7d93\u71df\u4e4b\u8655\u6307\u660e\u7684\u4eba\uff0c\u7684\u4e00\u985e\u4eba\u58eb\u800c\u8a2d\u7684\uff1b\u53ca<\/li>\n<\/ul>\n<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) in respect of which a certificate is issued to a person who attends the course.<br \/>\n\u4fee\u8b80\u8a72\u8ab2\u7a0b\u7684\u4eba\u6703\u5c31\u8a72\u8ab2\u7a0b\u7372\u767c\u7d66\u8b49\u660e\u66f8\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603500_042\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(3) A certificate issued to a person who attends a safety training course which is subsequently recognized under subsection (2) shall, unless otherwise provided in the notice under that subsection recognizing the course, for the purposes of this Ordinance have the same effect as a certificate issued to a person who attends the course on or after the day on which the course is so recognized.<br \/>\n\u5982\u4efb\u4f55\u4eba\u4fee\u8b80\u67d0\u9805\u5b89\u5168\u8a13\u7df4\u8ab2\u7a0b\u800c\u7372\u767c\u7d66\u8b49\u660e\u66f8\uff0c\u800c\u8a72\u8ab2\u7a0b\u5176\u5f8c\u6839\u64da\u7b2c(2)\u6b3e\u65bc\u67d0\u65e5\u7372\u627f\u8a8d\uff0c\u5247\u5c31\u672c\u689d\u4f8b\u800c\u8a00\uff0c\u8a72\u4efd\u8b49\u660e\u66f8\u5177\u6709\u8207\u4efb\u4f55\u4eba\u5728\u8a72\u65e5\u6216\u5176\u5f8c\u4fee\u8b80\u8a72\u8ab2\u7a0b\u800c\u7372\u767c\u7d66\u7684\u8b49\u660e\u66f8\u76f8\u540c\u7684\u6548\u529b\uff1b\u4f46\u5982\u6839\u64da\u8a72\u6b3e\u767c\u5e03\u4ee5\u627f\u8a8d\u8a72\u8ab2\u7a0b\u7684\u516c\u544a\u53e6\u6709\u8a02\u5b9a\uff0c\u5247\u5c6c\u4f8b\u5916\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603516_005\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(4) Where the Commissioner is satisfied that a relevant person has undergone\u00a0<span class=\"nowrap\">training\u2014<br \/>\n\u5982\u8655\u9577\u4fe1\u7d0d\u67d0\u6709\u95dc\u4eba\u58eb\u5df2\u901a\u904e\u7b26\u5408\u4ee5\u4e0b\u8aaa\u660e\u7684\u8a13\u7df4<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413603516_013\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) equivalent to the training provided by a relevant safety training course; and<br \/>\n\u76f8\u7b49\u65bc\u7531\u6709\u95dc\u5b89\u5168\u8a13\u7df4\u8ab2\u7a0b\u6240\u63d0\u4f9b\u7684\u8a13\u7df4\uff1b\u53ca<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413603516_021\" class=\"hklm_paragraph\">\n<div class=\"hklm_num no_heading_follows\">(b) of a standard not less than the standard of the training provided by that course,<br \/>\n\u6240\u9054\u6a19\u6e96\u4e26\u4e0d\u4f4e\u65bc\u8a72\u8ab2\u7a0b\u6240\u63d0\u4f9b\u7684\u8a13\u7df4\u6240\u9054\u6a19\u6e96\uff0c<\/div>\n<\/div>\n<div class=\"hklm_continued\"><span class=\"nowrap\">then \u5247\u00a0\u2014<\/span><\/div>\n<div id=\"ID_1438413603516_035\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(i) the Commissioner may issue or cause to be issued to the person a certificate in the same terms as the certificate that would have been issued to the person if he had attended that course; and<br \/>\n\u8655\u9577\u53ef\u5411\u8a72\u4eba\u767c\u7d66\u6216\u5b89\u6392\u5411\u8a72\u4eba\u767c\u7d66\u8b49\u660e\u66f8\uff0c\u8a72\u8b49\u660e\u66f8\u7684\u689d\u6b3e\u8207\u5018\u82e5\u8a72\u4eba\u4fee\u8b80\u8a72\u8ab2\u7a0b\u5247\u672c\u6703\u767c\u7d66\u7684\u8b49\u660e\u66f8\u76f8\u540c\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(ii) the certificate so issued shall, for the purposes of this Ordinance, have the same effect as a certificate issued to a person who has attended that course.<br \/>\n\u5c31\u672c\u689d\u4f8b\u800c\u8a00\uff0c\u5982\u6b64\u767c\u7d66\u7684\u8b49\u660e\u66f8\u5177\u6709\u8207\u767c\u7d66\u4fee\u8b80\u8a72\u8ab2\u7a0b\u7684\u4eba\u7684\u8b49\u660e\u66f8\u76f8\u540c\u7684\u6548\u529b\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603531_013\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\"><strong>(5)<\/strong> On and after the appointed day, every <strong>proprietor<\/strong> of a relevant industrial\u00a0<span class=\"nowrap\">undertaking\u2014<br \/>\n\u81ea\u6307\u5b9a\u65e5\u671f\u7576\u65e5\u958b\u59cb<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413603531_021\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a)<strong> shall not employ<\/strong> at the undertaking a <strong>relevant person who has not been issued a relevant certificate<\/strong> or whose relevant certificate has expired;<br \/>\n\u4efb\u4f55\u6709\u95dc\u5de5\u696d\u7d93\u71df\u7684<strong>\u6771\u4e3b\u5747\u4e0d\u5f97<\/strong>\u65bc\u8a72\u5de5\u696d\u7d93\u71df\u4e2d<strong>\u50f1\u7528\u672a\u7372\u767c\u7d66\u6709\u95dc\u8b49\u660e\u66f8<\/strong>\u6216\u6240\u6301\u7684\u6709\u95dc\u8b49\u660e\u66f8\u7684\u6709\u6548\u671f\u5df2\u5c46\u6eff\u7684<strong>\u6709\u95dc\u4eba\u58eb<\/strong>\uff1b<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) in the case of a relevant person employed at the <span class=\"nowrap\">undertaking\u2014 <\/span>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(i) immediately before that day who has not been issued a relevant certificate or whose<strong> relevant certificate has expired,<\/strong> shall <strong>cease to continue to emplo<\/strong>y the person at the undertaking<strong> on the expiration of 1 month after that day<\/strong> unless, before that expiration, the person has been issued a relevant certificate;<br \/>\n\u5982\u4efb\u4f55\u6709\u95dc\u4eba\u58eb\u65bc\u7dca\u63a5\u6307\u5b9a\u65e5\u671f\u4e4b\u524d\u53d7\u50f1\u65bc\u4efb\u4f55\u6709\u95dc\u5de5\u696d\u7d93\u71df\uff0c\u800c\u4ed6\u4e26\u672a\u7372\u767c\u7d66\u6709\u95dc\u8b49\u660e\u66f8\u6216\u6240\u6301\u7684<strong>\u6709\u95dc\u8b49\u660e\u66f8\u7684\u6709\u6548\u671f\u5df2\u5c46\u6eff<\/strong>\uff0c\u5247\u9664\u975e\u8a72\u4eba\u5728\u8a72\u65e5\u671f\u5f8c1\u500b\u6708\u5167\u7372\u767c\u7d66\u6709\u95dc\u8b49\u660e\u66f8\uff0c\u5426\u5247\u8a72\u5de5\u696d\u7d93\u71df\u7684<strong>\u6771\u4e3b\u9808\u5728\u8a72\u65e5\u671f\u5f8c1\u500b\u6708\u5c46\u6eff\u6642\u505c\u6b62<\/strong>\u65bc\u8a72\u5de5\u696d\u7d93\u71df<strong>\u7e7c\u7e8c\u50f1\u7528\u8a72\u4eba<\/strong>\uff1b<\/li>\n<li class=\"hklm_num no_heading_follows\">(ii) on or after that day whose relevant certificate expires during the course of his employment, shall cease to continue to employ the person at the undertaking on the expiration of 1 month after the expiration of the certificate unless, before the expiration of that month, the person has been issued a relevant certificate.<br \/>\n\u5982\u4efb\u4f55\u6709\u95dc\u4eba\u58eb\u5728\u6307\u5b9a\u65e5\u671f\u6216\u4e4b\u5f8c\u53d7\u50f1\u65bc\u4efb\u4f55\u6709\u95dc\u5de5\u696d\u7d93\u71df\uff0c\u800c\u5176\u6709\u95dc\u8b49\u660e\u66f8\u7684\u6709\u6548\u671f\u5728\u5176\u53d7\u50f1\u671f\u9593\u5c46\u6eff\uff0c\u5247\u9664\u975e\u8a72\u4eba\u5728\u8a72\u8b49\u660e\u66f8\u7684\u6709\u6548\u671f\u5c46\u6eff\u5f8c1\u500b\u6708\u5167\u7372\u767c\u7d66\u6709\u95dc\u8b49\u660e\u66f8\uff0c\u5426\u5247\u8a72\u5de5\u696d\u7d93\u71df\u7684\u6771\u4e3b\u9808\u5728\u8a72\u8b49\u660e\u66f8\u6709\u6548\u671f\u5c46\u6eff\u5f8c1\u500b\u6708\u5c46\u6eff\u6642\u505c\u6b62\u65bc\u8a72\u5de5\u696d\u7d93\u71df\u7e7c\u7e8c\u50f1\u7528\u8a72\u4eba\u3002<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603547_013\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(6) A certificate shall expire\u00a0<span class=\"nowrap\">on \u8b49\u660e\u66f8\u2014<\/span><\/div>\n<div id=\"ID_1438413603547_021\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) the day specified in the certificate, being a day not less than 1 year, and not more than 3 years, after the day on which the certificate was issued;<br \/>\n\u7684\u6709\u6548\u671f\u5728\u8b49\u660e\u66f8\u6307\u660e\u7684\u65e5\u671f\u5c46\u6eff\uff0c\u800c\u8a72\u65e5\u671f\u9808\u662f\u8b49\u660e\u66f8\u767c\u51fa\u7576\u65e5\u5f8c1\u5e74\u81f33\u5e74\u671f\u9593\u5167\u7684\u67d0\u65e5\uff1b<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413603547_029\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(b) <strong>if no<\/strong> such day is <strong>specified<\/strong>, on the expiration of <strong>3 years after the day<\/strong> on which the certificate was <strong>issued.<\/strong><br \/>\n<strong>\u5982\u6c92\u6709\u6307\u660e\u5c46\u6eff\u65e5\u671f<\/strong>\uff0c\u5247\u5176<strong>\u6709\u6548\u671f\u5728\u5176\u767c\u51fa\u7576\u65e5\u5f8c3\u5e74\u5c46\u6eff<\/strong>\u4e4b\u6642\u5c46\u6eff\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603547_036\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\"><strong>(7)<\/strong> On and after the appointed day, it shall be the duty of every relevant person employed at a relevant industrial undertaking who has been issued a relevant certificate which has not expired\u00a0<span class=\"nowrap\">to\u2014<br \/>\n\u6bcf\u540d\u53d7\u50f1\u65bc\u6709\u95dc\u5de5\u696d\u7d93\u71df\u4e26\u5df2\u7372\u767c\u7d66\u6709\u95dc\u8b49\u660e\u66f8(\u800c\u8a72\u8b49\u660e\u66f8\u7684\u6709\u6548\u671f\u672a\u5c46\u6eff)\u7684\u6709\u95dc\u4eba\u58eb\uff0c\u81ea\u6307\u5b9a\u65e5\u671f\u958b\u59cb<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413603563_005\" class=\"hklm_paragraph\">\n<ul>\n<li><strong>(a) carry with the person<\/strong> the certificate or an equivalent document while at work at the undertaking; (Amended <span class=\"hklm_ref nowrap\"><a class=\"hklm_ref source-note nowrap\">22 of 2014 s. 41<\/a><\/span>)<br \/>\n\u5747\u6709\u8cac\u4efb\u5728\u81ea\u5df1\u65bc\u8a72\u5de5\u696d\u7d93\u71df\u5de5\u4f5c\u6642\uff0c<strong>\u651c\u5e36<\/strong>\u8a72\u8b49\u660e\u66f8\uff0c\u6216\u651c\u5e36\u540c\u7b49\u6587\u4ef6\uff1b<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413603563_013\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(b) produce the certificate upon demand\u00a0<span class=\"nowrap\">by \u5747\u6709\u8cac\u4efb\u5728\u4ee5\u4e0b\u4eba\u58eb\u8981\u6c42\u4e0b\u51fa\u793a\u8a72\u8b49\u660e\u66f8\u2014<\/span>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(i) subject to paragraph (c), the proprietor of the undertaking or an agent of the proprietor authorized by the proprietor for the purpose; or<br \/>\n\u9664(c)\u6bb5\u53e6\u6709\u898f\u5b9a\u5916\uff0c\u8a72\u5de5\u696d\u7d93\u71df\u7684\u6771\u4e3b\u6216\u8a72\u6771\u4e3b\u70ba\u6b64\u76ee\u7684\u800c\u6388\u6b0a\u7684\u6771\u4e3b\u4ee3\u7406\u4eba\uff1b\u6216<\/li>\n<li class=\"hklm_num no_heading_follows\">(ii) subject to paragraph (d), an occupational safety officer;<br \/>\n\u9664(d)\u6bb5\u53e6\u6709\u898f\u5b9a\u5916\uff0c\u8077\u696d\u5b89\u5168\u4e3b\u4efb\uff1b<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413603563_036\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\"><strong>(c)<\/strong> if unable to comply with a demand under paragraph\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(b<span class=\"nowrap\">)(<\/span>i)<\/a><\/span>, make a\u00a0<span class=\"nowrap\">statement\u2014<br \/>\n\u5728\u672a\u80fd\u9075\u5f9e\u6839\u64da<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(b)(i)<\/a><\/span>\u6bb5\u63d0\u51fa\u7684\u8981\u6c42\u51fa\u793a\u8a72\u8b49\u660e\u66f8\u7684\u60c5\u6cc1\u4e0b<br \/>\n<\/span><\/li>\n<\/ul>\n<div id=\"ID_1438413603563_044\" class=\"hklm_subparagraph\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(i) subject to subparagraph (ii), in a register kept by the proprietor of the undertaking under subsection (8), that he has been issued the certificate and the certificate has not expired and containing such other particulars as are required by the register; and<br \/>\n(\u9664\u7b2c(ii)\u7bc0\u53e6\u6709\u898f\u5b9a\u5916)\u5747\u6709\u8cac\u4efb\u5728\u8a72\u5de5\u696d\u7d93\u71df\u7684\u6771\u4e3b\u6839\u64da\u7b2c(8)\u6b3e\u5099\u5b58\u7684\u7d00\u9304\u518a\u5167\u4f5c\u51fa\u4ed6\u5df2\u7372\u767c\u7d66\u8b49\u660e\u66f8\u800c\u8a72\u8b49\u660e\u66f8\u7684\u6709\u6548\u671f\u672a\u5c46\u6eff\u7684\u8072\u660e\uff0c\u800c\u8a72\u8072\u660e\u9808\u5305\u542b\u7d00\u9304\u518a\u6240\u898f\u5b9a\u7684\u5176\u4ed6\u8a73\u60c5\uff1b\u800c<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413603578_007\" class=\"hklm_subparagraph\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(ii) if and only if he has not made a like statement in that register on the day immediately preceding the day on which that demand is made;<br \/>\n\u5728\u4ed6\u5728\u7dca\u63a5\u8a72\u6771\u4e3b\u63d0\u51fa\u8981\u6c42\u7576\u65e5\u4e4b\u524d\u4e00\u5929\u672a\u6709\u5728\u8a72\u7d00\u9304\u518a\u5167\u4f5c\u51fa\u540c\u6a23\u8072\u660e\u7684\u60c5\u6cc1\u4e0b(\u4ea6\u53ea\u6709\u5728\u8a72\u60c5\u6cc1\u4e0b)\u4ed6\u65b9\u53ef\u4f5c\u51fa\u8a72\u8072\u660e\uff1b<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603578_014\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(d) if unable to comply with a demand under paragraph\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(b<span class=\"nowrap\">)(<\/span>ii)<\/a><\/span>, produce the certificate at a place and within a\u00a0<span class=\"nowrap\">period\u2014<br \/>\n\u5747\u6709\u8cac\u4efb\u5728\u672a\u80fd\u9075\u5f9e\u6839\u64da<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(b)(ii)<\/a><\/span>\u6bb5\u63d0\u51fa\u7684\u8981\u6c42\u51fa\u793a\u8a72\u8b49\u660e\u66f8\u7684\u60c5\u6cc1\u4e0b\uff0c\u65bc<br \/>\n<\/span><\/li>\n<\/ul>\n<div id=\"ID_1438413603578_022\" class=\"hklm_subparagraph\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(i) specified by the occupational safety officer who made the demand; and<br \/>\n\u63d0\u51fa\u8a72\u8981\u6c42\u7684\u8077\u696d\u5b89\u5168\u4e3b\u4efb\u6307\u660e\u7684\uff1b\u53ca<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413603578_030\" class=\"hklm_subparagraph\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(ii) which are reasonable in all the circumstances.<br \/>\n\u5728\u6240\u6709\u60c5\u6cc1\u4e0b\u5747\u5c6c\u5408\u7406\u7684\uff0c<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603578_036\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(8) On and after the appointed day, every proprietor of a relevant industrial undertaking\u00a0<span class=\"nowrap\">shall\u2014<br \/>\n\u81ea\u6307\u5b9a\u7576\u65e5\u958b\u59cb\uff0c\u6709\u95dc\u5de5\u696d\u7d93\u71df\u7684\u6771\u4e3b<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413603578_044\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) establish and maintain a register or registers for the purposes of subsection\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(7<span class=\"nowrap\">)(<\/span>c)<\/a><\/span>\u00a0in such form as is specified by the Commissioner;<br \/>\n\u9808\u70ba\u65bd\u884c\u7b2c<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(7<span class=\"nowrap\">)(<\/span>c)<\/a><\/span>\u6b3e\u6309\u8655\u9577\u6307\u660e\u7684\u5f62\u5f0f\u8a2d\u7acb\u53ca\u5099\u5b58\u7d00\u9304\u518a\uff1b<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413603578_052\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(b) not cause or permit any statement referred to in subsection\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(7<span class=\"nowrap\">)(<\/span>c)<\/a><\/span>\u00a0made in any such register to be removed therefrom at any time before the expiration of 18 months from the date on which the statement was made in the register.<\/li>\n<li>\u4e0d\u5f97\u5b89\u6392\u6216\u51c6\u8a31\u65bc\u7b2c<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(7<span class=\"nowrap\">)(<\/span>c)<\/a><\/span>\u6b3e\u63d0\u8ff0\u7684\u4efb\u4f55\u8072\u660e\u5728\u8a72\u7b49\u7d00\u9304\u518a\u5167\u4f5c\u51fa\u4e4b\u65e5\u5f8c18\u500b\u6708\u5c46\u6eff\u524d\uff0c\u5c07\u8a72\u8072\u660e\u5f9e\u7d00\u9304\u518a\u4e2d\u522a\u9664\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603594_005\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(9) Where a relevant certificate which has not expired has been lost, defaced or destroyed, the relevant person to whom it was issued shall, unless he has ceased to be employed at a relevant industrial undertaking, as soon as is reasonably practicable make an application to the Commissioner to be issued a replacement relevant certificate in the same terms (and any such application may consist of, or require the accompaniment of, a statutory declaration made by the person as to the loss, defacement or destruction of the certificate).<br \/>\n\u51e1\u6709\u6548\u671f\u672a\u5c46\u6eff\u7684\u6709\u95dc\u8b49\u660e\u66f8\u5df2\u907a\u5931\u3001\u6c61\u640d\u6216\u92b7\u6bc0\uff0c\u7372\u767c\u7d66\u8a72\u8b49\u660e\u66f8\u7684\u6709\u95dc\u4eba\u58eb\u9664\u975e\u5df2\u4e0d\u518d\u53d7\u50f1\u65bc\u6709\u95dc\u5de5\u696d\u7d93\u71df\uff0c\u5426\u5247\u9808\u5728\u5408\u7406\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\uff0c\u76e1\u5feb\u5411\u8655\u9577\u63d0\u51fa\u8981\u6c42\u88dc\u767c\u689d\u6b3e\u76f8\u540c\u7684\u6709\u95dc\u8b49\u660e\u66f8\u7684\u7533\u8acb\uff0c\u4efb\u4f55\u8a72\u7b49\u7533\u8acb\u53ef\u5305\u62ec\u6216\u898f\u5b9a\u9808\u9644\u540c\u8a72\u4eba\u6240\u4f5c\u7684\u95dc\u65bc\u8a72\u8b49\u660e\u66f8\u7684\u907a\u5931\u3001\u6c61\u640d\u6216\u92b7\u6bc0\u7684\u6cd5\u5b9a\u8072\u660e\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603609_005\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(10) The Commissioner shall issue or cause to be issued a replacement relevant certificate pursuant to an application under subsection (9) upon being satisfied that the relevant certificate which it will replace has in fact been lost, defaced or destroyed.<br \/>\n\u5982\u6709\u4eba\u6839\u64da\u7b2c(9)\u6b3e\u63d0\u51fa\u7533\u8acb\u8981\u6c42\u88dc\u767c\u8b49\u660e\u66f8\u4ee5\u66ff\u88dc\u67d0\u4efd\u6709\u95dc\u8b49\u660e\u66f8\uff0c\u800c\u8655\u9577\u4fe1\u7d0d\u8a72\u6709\u95dc\u8b49\u660e\u66f8\u78ba\u5be6\u5df2\u907a\u5931\u3001\u6c61\u640d\u6216\u92b7\u6bc0\uff0c\u5247\u8655\u9577\u9808\u61c9\u7533\u8acb\u88dc\u767c\u6216\u5b89\u6392\u88dc\u767c\u6709\u95dc\u8b49\u660e\u66f8\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603609_013\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(11) A replacement relevant certificate issued pursuant to an application under subsection (9) shall, for the purposes of this Ordinance, have the same effect as the relevant certificate which it replaces.<br \/>\n\u5c31\u672c\u689d\u4f8b\u800c\u8a00\uff0c\u61c9\u6839\u64da\u7b2c(9)\u6b3e\u63d0\u51fa\u7684\u7533\u8acb\u800c\u88dc\u767c\u7684\u6709\u95dc\u8b49\u660e\u66f8\u5177\u6709\u8207\u88ab\u66ff\u88dc\u7684\u6709\u95dc\u8b49\u660e\u66f8\u76f8\u540c\u7684\u6548\u529b\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603609_021\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(12) <strong>Subject to subsection (13),<\/strong> a <strong>proprietor who contravenes subsection (5)<\/strong> commits an offence and is liable to a<strong> fine at level 5<\/strong>.<br \/>\n<strong>\u9664\u7b2c(13)\u6b3e\u53e6\u6709\u898f\u5b9a\u5916<\/strong>\uff0c\u4efb\u4f55<strong>\u6771\u4e3b\u9055\u53cd\u7b2c(5)\u6b3e<\/strong>\uff0c\u5373\u5c6c\u72af\u7f6a\uff0c\u53ef\u8655<strong>\u7b2c5\u7d1a\u7f70\u6b3e<\/strong>\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603609_029\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(13) It shall be a defence to a prosecution for an offence under subsection (12) for the proprietor to show that he believed, and that it was reasonable for him to believe, that the relevant person to whom the offence relates had been issued with a relevant certificate and that the certificate had not expired.<br \/>\n\u5728\u6aa2\u63a7\u7b2c(12)\u6b3e\u6240\u8a02\u7684\u7f6a\u884c\u6642\uff0c\u5982\u6709\u95dc\u6771\u4e3b\u8b49\u660e\u4ed6\u76f8\u4fe1(\u800c\u4ed6\u5982\u6b64\u76f8\u4fe1\u662f\u5408\u7406\u7684)\u8a72\u7f6a\u884c\u95dc\u4e4e\u7684\u6709\u95dc\u4eba\u58eb\u5df2\u7372\u767c\u7d66\u6709\u95dc\u8b49\u660e\u66f8\u4e26\u4e14\u8a72\u8b49\u660e\u66f8\u7684\u6709\u6548\u671f\u672a\u5c46\u6eff\uff0c\u5373\u53ef\u4ee5\u6b64\u4f5c\u70ba\u514d\u8cac\u8faf\u8b77\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603625_005\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(14) A<strong> relevant person<\/strong> employed at a relevant industrial undertaking\u00a0<span class=\"nowrap\">who\u2014<br \/>\n<strong>\u4efb\u4f55\u53d7\u50f1<\/strong>\u65bc\u6709\u95dc\u5de5\u696d\u7d93\u71df<strong>\u7684\u6709\u95dc\u4eba\u58eb<\/strong><br \/>\n<\/span><\/div>\n<div id=\"ID_1438413603625_013\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) makes a statement referred to in subsection\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(7<span class=\"nowrap\">)(<\/span>c)<\/a><\/span>; and<br \/>\n<strong>\u4f5c\u51fa\u7b2c<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(7<span class=\"nowrap\">)(<\/span>c)<\/a><\/span>\u6b3e<\/strong>\u6240\u63d0\u8ff0<strong>\u7684\u8072\u660e<\/strong>\uff1b<strong>\u800c<\/strong><\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413603625_021\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(b) is not a person who has been issued a relevant certificate which has not expired at the time of making that statement,<br \/>\n\u5728<strong>\u4f5c\u51fa\u8a72\u8072\u660e\u6642\u4e26\u975e\u5df2\u7372\u767c\u7d66\u6709\u6548\u671f\u672a\u5c46\u6eff\u7684\u6709\u95dc\u8b49\u660e\u66f8<\/strong>\uff0c<\/li>\n<\/ul>\n<\/div>\n<div class=\"hklm_continued\">commits an offence and is liable to a fine at level 3.<br \/>\n\u5373\u5c6c\u72af\u7f6a\uff0c<strong>\u53ef\u8655\u7b2c3\u7d1a\u7f70\u6b3e<\/strong>\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603625_034\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(15) A relevant person who, without reasonable excuse, contravenes subsection\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(7<span class=\"nowrap\">)(<\/span>d)<\/a><\/span>\u00a0commits an offence and is liable to a fine at level 3.<br \/>\n\u4efb\u4f55\u6709\u95dc\u4eba\u58eb\u7121\u5408\u7406\u8faf\u89e3\u800c\u9055\u53cd\u7b2c<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(7<span class=\"nowrap\">)(<\/span>d)<\/a><\/span>\u6b3e\uff0c\u5373\u5c6c\u72af\u7f6a\uff0c\u53ef\u8655\u7b2c3\u7d1a\u7f70\u6b3e\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603641_005\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(16) A proprietor who contravenes subsection (8) commits an offence and is liable to a fine at level 3.<br \/>\n\u4efb\u4f55\u6771\u4e3b\u9055\u53cd\u7b2c(8)\u6b3e\uff0c\u5373\u5c6c\u72af\u7f6a\uff0c\u53ef\u8655\u7b2c3\u7d1a\u7f70\u6b3e\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603641_013\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">*(17) The Secretary for Education and Manpower may, by notice in the Gazette, appoint a day for the purposes of subsections (5), (7) and (8).<br \/>\n\u6559\u80b2\u7d71\u7c4c\u5c40\u5c40\u9577\u53ef\u85c9\u61b2\u5831\u516c\u544a\uff0c\u70ba\u7b2c(5)\u3001(7)\u53ca(8)\u6b3e\u7684\u76ee\u7684\u800c\u6307\u5b9a\u67d0\u65e5\u671f\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603641_021\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(18) A notice under subsection (17) is subsidiary legislation.<br \/>\n\u7b2c(17)\u6b3e\u6240\u6307\u7684\u516c\u544a\u662f\u9644\u5c6c\u6cd5\u4f8b\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603641_029\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(19) For the avoidance of doubt, it is hereby declared that subsection\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">(5<span class=\"nowrap\">)(<\/span>b)<\/a><\/span>\u00a0shall not operate to entitle an employer to terminate the contract of employment of an employee otherwise than in accordance with the provisions of the Employment Ordinance (<span class=\"hklm_ref \"><a class=\"hklm_ref cross-reference\">Cap. 57<\/a><\/span>) in the case of an employee within the meaning of\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">section 2(1)<\/a><\/span>\u00a0of that Ordinance.<br \/>\n\u70ba\u514d\u751f\u7591\u554f\uff0c\u73fe\u5ba3\u5e03\uff1a\u5c31\u300a\u50f1\u50ad\u689d\u4f8b\u300b(<span
