General duties of a <a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-proprietor-%e6%9d%b1%e4%b8%bb-employer-%e5%83%b1%e4%b8%bb-contractor-%e6%89%bf%e5%bb%ba%e5%95%86-occupier-%e4%bd%94%e7%94%a8%e4%ba%ba-and-person-responsible-%e8%b2%a0\/\" target=\"_blank\" rel=\"noopener noreferrer\">proprietor<\/a><br \/>\n\u6771\u4e3b\u7684\u4e00\u822c\u8cac\u4efb<\/h5>\n<div>\n<div id=\"ID_1438413603313_004\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1) It shall be the duty of every proprietor of an <a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-industrial-undertaking-%e5%b7%a5%e6%a5%ad%e7%b6%93%e7%87%9f-factory-%e5%b7%a5%e5%bb%a0-notifiable-workplace-%e6%87%89%e5%91%88%e5%a0%b1%e5%b7%a5%e5%a0%b4\/\" target=\"_blank\" rel=\"noopener noreferrer\">industrial undertaking<\/a> to ensure, so far as is reasonably practicable, the <strong>health and safety at work of all persons employed<\/strong> by him at the industrial undertaking.<br \/>\n\u5de5\u696d\u7d93\u71df\u7684\u6bcf\u4f4d\u6771\u4e3b\uff0c\u5747\u6709\u8cac\u4efb\u5728\u5408\u7406\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\uff0c\u76e1\u91cf\u78ba\u4fdd\u5176\u5728\u5de5\u696d\u7d93\u71df\u4e2d\u50f1\u7528\u7684\u6240\u6709\u7684\u4eba\u5065\u5eb7\u53ca\u5de5\u4f5c\u5b89\u5168\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413603313_012\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) Without prejudice to the generality of a proprietor\u2019s duty under subsection (1), the matters to which that duty extends include in\u00a0<span class=\"nowrap\">particular\u2014<br \/>\n\u5728\u4e0d\u640d\u5bb3\u7b2c(1)\u6b3e\u6240\u8a02\u7684\u6771\u4e3b\u8cac\u4efb\u7684\u6982\u62ec\u6027\u7684\u539f\u5247\u4e0b\uff0c\u8a72\u8cac\u4efb\u6240\u64f4\u53ca\u7684\u4e8b\u9805\u5c24\u5176\u5305\u62ec\u4ee5\u4e0b\u5404\u9805<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413603313_020\" class=\"hklm_paragraph\">\n<ul>\n<li>(a) the provision and maintenance of<strong> plant and systems of work<\/strong> that are, so far as is reasonably practicable, safe and without risks to health;<br \/>\n\u8a2d\u7f6e\u53ca\u4fdd\u6301\u5728\u5408\u7406\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\u76e1\u91cf\u662f\u5b89\u5168\u548c\u4e0d\u6703\u5371\u5bb3\u5065\u5eb7\u7684\u5de5\u696d\u88dd\u7f6e\u53ca\u5de5\u4f5c\u7cfb\u7d71\uff1b<\/li>\n<li>(b) arrangements for ensuring, so far as is reasonably practicable, safety and absence of risks to health in connection with the <strong>use, handling, storage and transport of articles and substances<\/strong>;<br \/>\n\u4f5c\u51fa\u6709\u95dc\u7684\u5b89\u6392\uff0c\u4ee5\u5728\u5408\u7406\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\u76e1\u91cf\u78ba\u4fdd\u5728\u4f7f\u7528\u3001\u642c\u904b\u3001\u8caf\u5b58\u548c\u904b\u8f09\u7269\u54c1\u53ca\u7269\u8cea\u65b9\u9762\uff0c\u5b89\u5168\u548c\u4e0d\u81f4\u5371\u5bb3\u5065\u5eb7\uff1b<\/li>\n<li>(c)the provision of such<strong> information, instruction, training and supervision<\/strong> as is necessary to ensure, so far as is reasonably practicable, the health and safety at work of all persons employed by him at the industrial undertaking;<br \/>\n\u63d0\u4f9b\u6240\u9700\u7684\u8cc7\u6599\u3001\u6307\u5c0e\u3001\u8a13\u7df4\u53ca\u76e3\u7763\uff0c\u4ee5\u5728\u5408\u7406\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\u76e1\u91cf\u78ba\u4fdd\u5176\u5728\u5de5\u696d\u7d93\u71df\u4e2d\u50f1\u7528\u7684\u6240\u6709\u7684\u4eba\u5065\u5eb7\u53ca\u5de5\u4f5c\u5b89\u5168\uff1b<\/li>\n<li>(d) so far as is reasonably practicable as regards any part of the industrial undertaking under the proprietor\u2019s control, the maintenance of it in a condition that is safe and without risks to health and the provision and maintenance of <strong>means of access to and egress<\/strong> from it that are safe and without such risks; and<br \/>\n\u5c0d\u65bc\u4efb\u4f55\u7531\u6771\u4e3b\u63a7\u5236\u7684\u5de5\u696d\u7d93\u71df\u90e8\u5206\uff0c\u5728\u5408\u7406\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\u76e1\u91cf\u4fdd\u6301\u8a72\u90e8\u5206\u8655\u65bc\u5b89\u5168\u548c\u4e0d\u6703\u5371\u5bb3\u5065\u5eb7\u7684\u72c0\u6cc1\uff0c\u4ee5\u53ca\u63d0\u4f9b\u548c\u4fdd\u6301\u9032\u51fa\u8a72\u90e8\u5206\u7684\u5b89\u5168\u548c\u4e0d\u6703\u5371\u5bb3\u5065\u5eb7\u7684\u9014\u5f91\uff1b\u53ca<\/li>\n<li>(e) the provision and maintenance of a <strong>working environment<\/strong> for all persons employed by him at the industrial undertaking that is, so far as is reasonably practicable, safe, and without risks to health.<br \/>\n\u70ba\u5176\u5728\u5de5\u696d\u7d93\u71df\u4e2d\u50f1\u7528\u7684\u6240\u6709\u7684\u4eba\u63d0\u4f9b\u53ca\u4fdd\u6301\u5728\u5408\u7406\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\u76e1\u91cf\u662f\u5b89\u5168\u548c\u4e0d\u6703\u5371\u5bb3\u5065\u5eb7\u7684\u5de5\u4f5c\u74b0\u5883\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603344_013\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(3) Subject to subsection (4), a proprietor of an industrial undertaking who contravenes this section commits an offence and is liable to a fine of $500,000.<br \/>\n\u9664\u7b2c(4)\u6b3e\u53e6\u6709\u898f\u5b9a\u5916\uff0c\u4efb\u4f55\u5de5\u696d\u7d93\u71df\u7684\u6771\u4e3b\u9055\u53cd\u672c\u689d\u7684\u898f\u5b9a\uff0c\u5373\u5c6c\u72af\u7f6a\uff0c\u53ef\u8655\u7f70\u6b3e$500,000\u3002<\/div>\n<div class=\"hklm_content\">\n<div class=\"hklm_sourceNote\">(Amended\u00a0<span class=\"hklm_ref nowrap\"><a class=\"hklm_ref source-note unsupported-ref nowrap\">40 of 1997 s. 2<\/a><\/span>)<\/div>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603344_021\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(4) A proprietor of an industrial undertaking who contravenes this section wilfully and without reasonable excuse commits an offence and is liable to a fine of $500,000 and to imprisonment for 6 months. General duties of persons employed<br \/>\n\u53d7\u50f1\u7684\u4eba\u7684\u4e00\u822c\u8cac\u4efb<\/h5>\n<div id=\"ID_1438413603391_019\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1) It shall be the duty of every person employed at an <a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-industrial-undertaking-%e5%b7%a5%e6%a5%ad%e7%b6%93%e7%87%9f-factory-%e5%b7%a5%e5%bb%a0-notifiable-workplace-%e6%87%89%e5%91%88%e5%a0%b1%e5%b7%a5%e5%a0%b4\/\" target=\"_blank\" rel=\"noopener noreferrer\">industrial undertaking<\/a> while at\u00a0<span class=\"nowrap\">work\u2014<br \/>\n\u5de5\u696d\u7d93\u71df\u7684\u6bcf\u540d\u53d7\u50f1\u7684\u4eba\uff0c\u65bc\u5de5\u4f5c\u6642\u5747\u6709\u8cac\u4efb<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413603391_027\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) to take reasonable care for the health and safety of himself and of other persons who may be affected by his acts or omissions at work; and<br \/>\n\u70ba\u4ed6\u672c\u4eba\u7684\u5065\u5eb7\u53ca\u5b89\u5168\u63a1\u53d6\u5408\u7406\u7684\u8b39\u614e\u63aa\u65bd\uff0c\u53ca\u70ba\u6703\u56e0\u4ed6\u5de5\u4f5c\u6642\u7684\u4f5c\u70ba\u6216\u4e0d\u4f5c\u70ba\u800c\u53d7\u5f71\u97ff\u7684\u5176\u4ed6\u4eba\u7684\u5065\u5eb7\u53ca\u5b89\u5168\u63a1\u53d6\u5408\u7406\u7684\u8b39\u614e\u63aa\u65bd\uff1b\u53ca<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413603407_006\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(b) as regards any duty or requirement imposed on a proprietor of the industrial undertaking or on any other person by this Ordinance for securing the health and safety of persons employed at the industrial undertaking, to co-operate with him so far as is necessary to enable that duty or requirement to be performed or complied with.<br \/>\n\u5728\u672c\u689d\u4f8b\u70ba\u78ba\u4fdd\u5de5\u696d\u7d93\u71df\u4e2d\u53d7\u50f1\u7684\u4eba\u7684\u5065\u5eb7\u53ca\u5b89\u5168\uff0c\u800c\u65bd\u52a0\u65bc\u5de5\u696d\u7d93\u71df\u7684\u6771\u4e3b\u6216\u4efb\u4f55\u5176\u4ed6\u4eba\u7684\u8cac\u4efb\u6216\u898f\u5b9a\u65b9\u9762\uff0c\u5728\u6709\u9700\u8981\u7684\u7bc4\u570d\u5167\u76e1\u91cf\u8207\u6771\u4e3b\u6216\u8a72\u7b49\u5176\u4ed6\u4eba\u5408\u4f5c\uff0c\u4f7f\u8a72\u8cac\u4efb\u6216\u898f\u5b9a\u5f97\u4ee5\u57f7\u884c\u6216\u9075\u5f9e\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413603407_013\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) A person who contravenes subsection (1) commits an offence and is liable to a fine at level 4.<br \/>\n\u4efb\u4f55\u4eba\u9055\u53cd\u7b2c(1)\u6b3e\u7684\u898f\u5b9a\uff0c\u5373\u5c6c\u72af\u7f6a\uff0c\u53ef\u8655\u7b2c4\u7d1a\u7f70\u6b3e\u3002<\/div>\n<div class=\"hklm_content\">\n<div id=\"ID_1438413603407_021\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(3) A person employed at an industrial undertaking who wilfully and without reasonable excuse does anything while at work likely to endanger himself or other persons commits an offence and is liable to a fine at level 5 and to imprisonment for 6 months.<br \/>\n\u5728\u5de5\u696d\u7d93\u71df\u4e2d\u53d7\u50f1\u7684\u4eba\u7121\u5408\u7406\u8faf\u89e3\u800c\u6545\u610f\u65bc\u5de5\u4f5c\u6642\u4f5c\u51fa\u4efb\u4f55\u76f8\u7576\u53ef\u80fd\u5371\u53ca\u4ed6\u672c\u4eba\u6216\u4ed6\u4eba\u7684\u4e8b\u60c5\uff0c\u5373\u5c6c\u72af\u7f6a\uff0c\u53ef\u8655\u7b2c5\u7d1a\u7f70\u6b3e\u53ca\u76e3\u79816\u500b\u6708\u3002<\/div>\n<div substances<\/strong> &#8211; arrangements<\/li>\n<li>\u8cc7\u6599\u3001\u6307\u5c0e\u3001\u8a13\u7df4\u53ca\u76e3\u7763 : information, instruction, training and supervision (<strong>IITS<\/strong>) &#8211; provision<\/li>\n<\/ol>\n<div>Subsection (3), (4) \u8b1b\u7f70\u5247, Subsection (4) \u6307\u51fa\u5982\u679c\u6771\u4e3b\u7121\u5408\u7406\u8faf\u89e3\u800c\u6545\u610f\u9055\u53cd\u672c\u689d (without reasonable excuse commits an (3)\u6307\u51fa\u5982\u7121\u5408\u7406\u8faf\u89e3\u800c\u6545\u610f\u65bc\u5de5\u4f5c\u6642\u4f5c\u51fa\u4efb\u4f55\u76f8\u7576\u53ef\u80fd\u5371\u53ca\u4ed6\u672c\u4eba\u6216\u4ed6\u4eba\u7684\u4e8b\u60c5\uff0c\u53ef\u8655<a
