{"id":6128,"date":"2020-10-29T16:24:43","date_gmt":"2020-10-29T08:24:43","guid":{"rendered":"https:\/\/tommykwan.com\/blog\/?p=6128"},"modified":"2020-11-16T20:35:48","modified_gmt":"2020-11-16T12:35:48","slug":"legislative-context-in-cap-59j-related-to-crane","status":"publish","type":"post","link":"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/legislative-context-in-ohs\/legislative-context-in-cap-59j-related-to-crane\/","title":{"rendered":"Legislative context in Cap.59J related to &#8220;Crane&#8221;"},"content":{"rendered":"[Ref\u00a0<a href=\"https:\/\/www.elegislation.gov.hk\/hk\/cap59J!en-zh-Hant-HK?INDEX_CS=N&amp;xpid=ID_1438403506188_002\" target=\"_blank\" rel=\"noopener noreferrer\">Cap.59J<\/a>]\n<p>According to Cap.59J :<\/p>\n<h5>3 Interpretation<\/h5>\n<div class=\"hklm_term old_format\"><strong>automatic safe load indicator \u00a0(\u5b89\u5168\u8ca0\u8377\u81ea\u52d5\u986f\u793a\u5668)<\/strong> means a device intended to be<span style=\"color: #ff0000;\"> fitted to a crane<\/span> that automatically gives an audible and visible warning to the operator thereof that the crane is approaching its safe working load and that automatically gives a further audible and visible warning when the crane has exceeded its safe working load;<br \/>\n\u6307<span style=\"color: #ff0000;\">\u5b89\u88dd\u65bc\u8d77\u91cd\u6a5f<\/span>\u7684\u4e00\u7a2e\u88dd\u7f6e\uff0c\u8a72\u88dd\u7f6e\u80fd\u5728\u8d77\u91cd\u6a5f\u8da8\u8fd1\u5b89\u5168\u64cd\u4f5c\u8ca0\u8377\u6642\u81ea\u52d5\u5411\u8d77\u91cd\u6a5f\u64cd\u4f5c\u54e1\u767c\u51fa\u53ef\u807d\u898b\u53ca\u53ef\u770b\u898b\u7684\u8b66\u544a\u8a0a\u865f\uff0c\u4e26\u5728\u8d77\u91cd\u6a5f\u8d85\u903e\u5b89\u5168\u64cd\u4f5c\u8ca0\u8377\u6642\u81ea\u52d5\u767c\u51fa\u53ef\u807d\u898b\u53ca\u53ef\u770b\u898b\u7684\u9032\u4e00\u6b65\u8b66\u544a\u8a0a\u865f<\/div>\n<div><\/div>\n<div>\n<h5 class=\"hklm_num\">7B. Automatic safe load indicator required \u5fc5\u9808\u88dd\u4e0a\u5b89\u5168\u8ca0\u8377\u81ea\u52d5\u986f\u793a\u5668<\/h5>\n<\/div>\n<div>\n<div class=\"hklm_num no_heading_follows\">(1) The owner of a crane shall ensure that it is not used unless it is fitted with an automatic safe load indicator\u00a0<span class=\"nowrap\">that\u2014<\/span><\/div>\n<div>\n<div id=\"ID_1438413663935_004\" class=\"hklm_subsection\">\n<div id=\"ID_1438413663935_012\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a)functions properly;<\/li>\n<li class=\"hklm_num no_heading_follows\">(b)has been <span style=\"color: #ff0000;\">tested by a competent examiner<\/span> on each occasion that a<span style=\"color: #ff0000;\"> test and thorough examination of the crane is required under\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\" style=\"color: #ff0000;\">regulation 5<\/a><\/span> <\/span>and the competent examiner has given the owner a certificate in the approved form in which he has made a statement to the effect that the automatic safe load indicator is in good working order; and<br \/>\n\u6bcf\u6b21<span style=\"color: #ff0000;\">\u6839\u64da<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\" style=\"color: #ff0000;\">\u7b2c5\u689d<\/a><\/span>\u7684\u898f\u5b9a\u9808\u5c0d\u8a72\u8d77\u91cd\u6a5f\u9032\u884c\u6e2c\u8a66\u53ca\u5fb9\u5e95\u6aa2\u9a57<\/span>\u6642\uff0c\u986f\u793a\u5668\u5747<span style=\"color: #ff0000;\">\u7531\u4e00\u540d\u5408\u8cc7\u683c\u6aa2\u9a57\u54e1\u9032\u884c<\/span>\u6e2c\u8a66\uff0c\u4e14\u8a72\u540d\u5408\u8cc7\u683c\u6aa2\u9a57\u54e1\u5df2\u4ea4\u7d66\u64c1\u6709\u4eba\u4e00\u4efd\u6309\u8a8d\u53ef\u683c\u5f0f\u767c\u51fa\u7684\u8b49\u660e\u66f8\uff0c\u4e26\u5728\u8b49\u660e\u66f8\u5167\u8ff0\u660e\u5b89\u5168\u8ca0\u8377\u81ea\u52d5\u986f\u793a\u5668\u8655\u65bc\u826f\u597d\u64cd\u4f5c\u72c0\u614b\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(c)has been <span style=\"color: #ff0000;\">inspected by a competent person<\/span> and determined to be in safe working order during each <span style=\"color: #ff0000;\">inspection of the crane required under\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\" style=\"color: #ff0000;\" href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/legislative-context-in-ohs\/testing-examination-and-inspection-of-lifting-appliance\/\" target=\"_blank\" rel=\"noopener noreferrer\">regulation 7A<\/a><\/span>\u00a0<\/span>and the competent person has given the owner a certificate in the approved form in which he has made a statement to the effect that the automatic safe load indicator is in good working order.<br \/>\n\u6bcf\u6b21<span style=\"color: #ff0000;\">\u5c0d\u8a72\u8d77\u91cd\u6a5f\u9032\u884c<a style=\"color: #ff0000;\" href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/legislative-context-in-ohs\/testing-examination-and-inspection-of-lifting-appliance\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span class=\"hklm_ref \">\u7b2c7A\u689d<\/span>\u898f\u5b9a<\/a>\u7684\u6aa2\u67e5<\/span>\u6642\uff0c\u986f\u793a\u5668\u5747<span style=\"color: #ff0000;\">\u7531\u4e00\u540d\u5408\u8cc7\u683c\u7684\u4eba\u9032\u884c<\/span>\u6aa2\u67e5\u4e26\u6c7a\u5b9a\u5176\u8655\u65bc\u5b89\u5168\u64cd\u4f5c\u72c0\u614b\uff0c\u4e14\u8a72\u540d\u5408\u8cc7\u683c\u7684\u4eba\u5df2\u4ea4\u7d66\u64c1\u6709\u4eba\u4e00\u4efd\u6309\u8a8d\u53ef\u683c\u5f0f\u767c\u51fa\u7684\u8b49\u660e\u66f8\uff0c\u4e26\u5728\u8b49\u660e\u66f8\u5167\u8ff0\u660e\u5b89\u5168\u8ca0\u8377\u81ea\u52d5\u986f\u793a\u5668\u8655\u65bc\u826f\u597d\u64cd\u4f5c\u72c0\u614b\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413663950_012\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) This regulation does <strong>not apply to<\/strong> a crane with a <strong>maximum safe working load<\/strong> of<strong> 1 tonne or less or<\/strong> a crane that operates <strong>with a grab<\/strong> <strong>or<\/strong> any <strong>electro magnetic means.<\/strong><br \/>\n\u672c\u689d<strong>\u4e0d\u9069\u7528<\/strong>\u65bc\u6700<strong>\u9ad8\u5b89\u5168\u64cd\u4f5c\u8ca0\u8377<\/strong>\u70ba<strong>1\u516c\u5678\u62161\u516c\u5678\u4ee5\u4e0b<\/strong>\u7684\u8d77\u91cd\u6a5f\uff0c\u4ea6\u4e0d\u9069\u7528\u65bc<strong>\u914d\u4ee5\u6293\u6597<\/strong>\u6216\u4ee5\u4efb\u4f55<strong>\u96fb\u78c1\u65b9\u5f0f\u64cd\u4f5c<\/strong>\u7684\u8d77\u91cd\u6a5f\u3002<\/div>\n<div class=\"hklm_content\">\n<div class=\"hklm_sourceNote\">(<span class=\"hklm_ref \"><a class=\"hklm_ref source-note unsupported-ref\">L.N. 23 of 1994<\/a><\/span>)<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<h5>5 Lifting appliances to be tested and examined prior to use<\/h5>\n<div>\n<div class=\"hklm_num no_heading_follows\">(3) The <span style=\"color: #ff0000;\">owner of any crane<\/span>, crab or winch shall ensure that it is not used unless during the <strong>preceding 4 years<\/strong> it has been <strong>tested and thoroughly examined<\/strong> <strong>by<\/strong> a <strong>competent examiner<\/strong> in the <strong>manner prescribed in the\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">First Schedule<\/a><\/span><\/strong>, and a certificate in the approved form in which the competent examiner has made a statement to the effect that it is in safe working order has been obtained.<\/div>\n<\/div>\n<p><span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f<\/span>\u3001\u8d77\u91cd\u6ed1\u8eca\u6216\u7d5e\u8eca<span style=\"color: #ff0000;\">\u7684\u64c1\u6709\u4eba<\/span>\u9808\u78ba\u4fdd\u5176\u8d77\u91cd\u6a5f\u3001\u8d77\u91cd\u6ed1\u8eca\u6216\u7d5e\u8eca\u4e0d\u5f97\u4f7f\u7528\uff0c\u9664\u975e\u8a72\u8d77\u91cd\u6a5f\u3001\u8d77\u91cd\u6ed1\u8eca\u6216\u7d5e\u8eca\u5728<strong>\u904e\u53bb4\u5e74\u5167\u66fe\u7531\u4e00\u540d\u5408\u8cc7\u683c\u6aa2\u9a57\u54e1\u6309<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">\u9644\u88681<\/a><\/span>\u6240\u8a02\u660e\u7684\u65b9\u5f0f\u9032\u884c\u6e2c\u8a66\u53ca\u5fb9\u5e95\u6aa2\u9a57<\/strong>\uff0c\u4e26\u53d6\u5f97\u6309\u8a8d\u53ef\u683c\u5f0f\u767c\u51fa\u7684\u8b49\u660e\u66f8\uff0c\u800c\u8a72\u540d\u5408\u8cc7\u683c\u6aa2\u9a57\u54e1\u5728\u8b49\u660e\u66f8\u5167\u8ff0\u660e\u8a72\u8d77\u91cd\u6a5f\u3001\u8d77\u91cd\u6ed1\u8eca\u6216\u7d5e\u8eca\u8655\u65bc\u5b89\u5168\u64cd\u4f5c\u72c0\u614b\u3002<\/p>\n<p>&nbsp;<\/p>\n<h5 class=\"hklm_num\">7D. Stability of lifting appliances \u8d77\u91cd\u6a5f\u68b0\u7684\u7a69\u5b9a\u6027<\/h5>\n<div>\n<div class=\"hklm_num no_heading_follows\">(2) The <span style=\"color: #ff0000;\">owner of a crane<\/span> shall, for the purpose of securing the stability of the crane, ensure that before\u00a0<span class=\"nowrap\">use\u2014<br \/>\n<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f\u7684\u64c1\u6709\u4eba<\/span>\u70ba\u4fdd\u969c\u5176\u8d77\u91cd\u6a5f\u7684\u7a69\u5b9a\u6027\uff0c\u9808\u78ba\u4fdd\u5728\u4f7f\u7528\u524d<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413664028_020\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) the <span style=\"color: #ff0000;\">crane is<\/span> securely anchored, or adequately weighted by suitable ballast which is properly placed on the structure of the crane and secured in a manner sufficient to prevent the ballast from being accidentally displaced; and<br \/>\n<span style=\"color: #ff0000;\">\u5c07\u8a72\u8d77\u91cd\u6a5f<\/span>\u7a69\u56fa\u5730\u9328\u5b9a\uff0c\u6216\u4ee5\u9069\u7576\u7684\u58d3\u91cd\u7269\u5c0d\u8a72\u8d77\u91cd\u6a5f\u65bd\u52a0\u8db3\u5920\u91cd\u91cf\uff0c\u58d3\u91cd\u7269\u9808\u59a5\u70ba\u653e\u7f6e\u5728\u8d77\u91cd\u6a5f\u7684\u7d50\u69cb\u4e0a\u4e26\u9069\u7576\u5730\u7a69\u56fa\uff0c\u4ee5\u9632\u6b62\u58d3\u91cd\u7269\u610f\u5916\u79fb\u4f4d\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) no part of any rail on which the <span style=\"color: #ff0000;\">crane<\/span> is mounted, or any sleeper supporting such rail, is used as an anchorage.<br \/>\n\u8a72<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f<\/span>\u67b6\u7f6e\u5728\u4e0a\u7684\u8ecc\u9053\u6216\u652f\u6301\u8a72\u7b49\u8ecc\u9053\u7684\u8ecc\u6795\u7684\u4efb\u4f55\u90e8\u5206\u5747\u4e0d\u5f97\u7528\u4f5c\u9328\u6a01\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<blockquote><p>7E (2) &amp; (3) \u8b1b\u65e2\u4fc2<strong> Form 2<\/strong><\/p><\/blockquote>\n<div>\n<div id=\"ID_1438413664028_020\" class=\"hklm_paragraph\">\n<h5 class=\"hklm_num\">7E. Anchoring and ballasting of cranes \u8d77\u91cd\u6a5f\u7684\u9328\u5b9a\u53ca\u58d3\u91cd<\/h5>\n<div>\n<div id=\"ID_1438413664059_011\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1) The <span style=\"color: #ff0000;\">owner of a crane<\/span> shall ensure that all of the devices used for the anchoring or ballasting of the <span style=\"color: #ff0000;\">crane<\/span> are<strong> thoroughly examined by a competent examiner<\/strong> on each occasion <strong>before<\/strong> the crane is<strong> erected.<\/strong><\/div>\n<div class=\"hklm_num no_heading_follows\">\u4efb\u4f55<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f\u7684\u64c1\u6709\u4eba<\/span>\u9808\u78ba\u4fdd\u5176<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f<\/span>\u6240\u7528\u7684\u9328\u5b9a\u53ca\u58d3\u91cd\u88dd\u7f6e\uff0c\u5728\u8a72\u8d77\u91cd\u6a5f<strong>\u67b6\u8a2d\u524d<\/strong>\uff0c\u6bcf\u6b21\u5747<strong>\u7531\u5408\u8cc7\u683c\u6aa2\u9a57\u54e1\u5fb9\u5e95\u6aa2\u9a57<\/strong>\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413664059_019\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) <strong>After<\/strong> each <strong>erection<\/strong> of a<span style=\"color: #ff0000;\"> crane<\/span>, and after each removal of a crane to a new location, or any adjustment to any component member of a crane (being a removal or adjustment which involves changes in the arrangements for anchoring or ballasting the crane), the owner of the crane shall, before it is taken into use, cause the crane to be tested by a competent examiner, by the imposition\u00a0<span class=\"nowrap\">either\u2014<br \/>\n\u6bcf\u6b21<strong>\u67b6\u8a2d<\/strong><span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f<\/span><strong>\u5f8c<\/strong>\uff0c\u4ee5\u53ca\u6bcf\u6b21\u5c07\u8d77\u91cd\u6a5f\u79fb\u5f80\u65b0\u5730\u9ede\u5f8c\uff0c\u6216\u5c0d\u8d77\u91cd\u6a5f\u7684\u4efb\u4f55\u69cb\u4ef6\u4f5c\u51fa\u8abf\u6821\u5f8c(\u6307\u6d89\u53ca\u6539\u8b8a\u8d77\u91cd\u6a5f\u7684\u9328\u5b9a\u6216\u58d3\u91cd\u5b89\u6392\u7684\u9077\u79fb\u6216\u8abf\u6821)\uff0c\u6709\u95dc\u7684\u8d77\u91cd\u6a5f\u7684\u64c1\u6709\u4eba\u9808\u5728\u8a72\u8d77\u91cd\u6a5f\u4f7f\u7528\u524d\uff0c\u5b89\u6392\u7531\u5408\u8cc7\u683c\u6aa2\u9a57\u54e1\u5c0d\u8a72\u8d77\u91cd\u6a5f\u9032\u884c\u6e2c\u8a66\uff0c\u5176\u65b9\u6cd5\u70ba<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413664075_005\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) of a load of 25% above the maximum load to be lifted by the crane as erected, at the positions where there is a maximum pull on each anchorage; or<br \/>\n\u5728\u8a72\u8d77\u91cd\u6a5f\u8655\u65bc\u6bcf\u500b\u9328\u6a01\u627f\u53d7\u6700\u5927\u62c9\u529b\u4e0b\u7684\u5404\u500b\u4f4d\u7f6e\uff0c\u6309\u8a72\u8d77\u91cd\u6a5f\u5728\u67b6\u8a2d\u5f8c\u9700\u63d0\u8d77\u7684\u6700\u9ad8\u8ca0\u8377\uff0c\u65bd\u52a0\u9ad8\u51fa\u8a72\u6700\u9ad8\u8ca0\u837725%\u7684\u8ca0\u8377\uff1b\u6216<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) of a lesser load arranged to provide an equivalent test of the anchorage or ballasting arrangements.<br \/>\n\u65bd\u52a0\u8f03\u8f15\u8ca0\u8377\uff0c\u4f46\u65bd\u52a0\u8ca0\u8377\u7684\u5b89\u6392\u9808\u8db3\u4ee5\u5c0d\u9328\u5b9a\u6216\u58d3\u91cd\u5b89\u6392\u4f5c\u51fa\u76f8\u7b49\u6e2c\u8a66\u3002<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<\/div>\n<div id=\"ID_1438413664075_020\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(3)The owner shall obtain a certificate of the examination and test under paragraphs (1) and (2) from the <strong>competent examiner<\/strong> in the approved from in which the competent examiner has made a statement to the effect that the<span style=\"color: #ff0000;\"> crane<\/span> is in safe working order.<br \/>\n\u64c1\u6709\u4eba\u9808\u5411\u4e00\u540d<strong>\u5408\u8cc7\u683c\u6aa2\u9a57\u54e1<\/strong>\u53d6\u5f97\u6709\u95dc\u7b2c(1)\u53ca(2)\u6b3e\u898f\u5b9a\u7684\u6aa2\u9a57\u53ca\u6e2c\u8a66\u7684\u8b49\u660e\u66f8\uff0c\u8a72\u8b49\u660e\u66f8\u9808\u6309\u8a8d\u53ef\u683c\u5f0f\u767c\u51fa\uff0c\u800c\u8a72\u540d\u5408\u8cc7\u683c\u6aa2\u9a57\u54e1\u5728\u8b49\u660e\u66f8\u5167\u8ff0\u660e\u6709\u95dc\u7684<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f<\/span>\u8655\u65bc\u5b89\u5168\u64cd\u4f5c\u72c0\u614b\u3002<\/div>\n<div><\/div>\n<\/div>\n<div id=\"ID_1438413664075_028\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(4)If the <strong>competent examiner<\/strong> making the test under paragraph (2) considers that the maximum load which may safely be lifted by that<span style=\"color: #ff0000;\"> crane<\/span> as erected is less than the safe working load of the crane he shall specify the new maximum load in his certificate and in which case, the new maximum load shall be the modified safe working load.<br \/>\n\u5982\u6839\u64da\u7b2c(2)\u6b3e\u9032\u884c\u6e2c\u8a66\u7684<strong>\u5408\u8cc7\u683c\u6aa2\u9a57\u54e1<\/strong>\u8a8d\u70ba\uff0c\u6709\u95dc\u7684<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f<\/span>\u5728\u67b6\u8a2d\u5f8c\u53ef\u5b89\u5168\u63d0\u8d77\u7684\u6700\u9ad8\u8ca0\u8377\uff0c\u4f4e\u65bc\u8a72\u8d77\u91cd\u6a5f\u7684\u5b89\u5168\u64cd\u4f5c\u8ca0\u8377\uff0c\u5247\u8a72\u540d\u5408\u8cc7\u683c\u6aa2\u9a57\u54e1\u9808\u5728\u5176\u8b49\u660e\u66f8\u5167\u6307\u660e\u65b0\u7684\u6700\u9ad8\u8ca0\u8377\uff0c\u800c\u5728\u6b64\u60c5\u6cc1\u4e0b\uff0c\u65b0\u7684\u6700\u9ad8\u8ca0\u8377\u5373\u70ba\u7d93\u4fee\u6539\u7684\u5b89\u5168\u64cd\u4f5c\u8ca0\u8377\u3002<\/div>\n<div><\/div>\n<\/div>\n<div id=\"ID_1438413664091_005\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(5)Where a maximum load has been specified under paragraph (4), the<strong> owner<\/strong> shall cause a loading\u00a0<span class=\"nowrap\">diagram\u2014<br \/>\n\u51e1\u6709\u6839\u64da\u7b2c(4)\u6b3e\u6307\u660e\u6700\u9ad8\u8ca0\u8377\uff0c<strong>\u64c1\u6709\u4eba\u9808<\/strong>\u5b89\u6392\u5728<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f\u99d5\u99db\u54e1<\/span>\u6613\u65bc\u770b\u898b\u7684\u4f4d\u7f6e\u5f35\u8cbc\u8ca0\u8377\u7c21\u5716\uff0c\u8a72\u8ca0\u8377\u7c21\u5716\u9808<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413664091_013\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a)appropriate to the stability of the crane as at the time of the test (taking into account, in the case of a crane mounted on wheels, the conditions of the track); Stability of cranes secured by removable weights<\/h5>\n<div class=\"hklm_content\">Where the stability of a crane is secured by means of removable weights, the <span style=\"color: #ff0000;\">owner of the crane<\/span> shall, before it is used, cause a diagram or notice indicating the position and amount of the weights, to be affixed to the crane in a place where it can easily be seen.<br \/>\n\u51e1\u4efb\u4f55\u8d77\u91cd\u6a5f\u85c9\u53ef\u79fb\u8d70\u7684\u5b9a\u91cf\u91cd\u7269\u4e88\u4ee5\u7a69\u5b9a\uff0c\u8a72<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f\u7684\u64c1\u6709\u4eba<\/span>\u9808\u5728\u8a72\u8d77\u91cd\u6a5f\u4f7f\u7528\u524d\uff0c\u5b89\u6392\u5728\u8a72\u8d77\u91cd\u6a5f\u7684\u6613\u65bc\u770b\u898b\u7684\u5730\u65b9\u5f35\u8cbc\u7c21\u5716\u6216\u544a\u793a\uff0c\u986f\u793a\u5404\u5b9a\u91cf\u91cd\u7269\u7684\u4f4d\u7f6e\u53ca\u91cd\u91cf\u3002<\/div>\n<div class=\"hklm_sourceNote\">(<span class=\"hklm_ref \"><a class=\"hklm_ref source-note unsupported-ref\">L.N. 285 of 1993<\/a><\/span>)<\/div>\n<\/div>\n<div><\/div>\n<p>&nbsp;<\/p>\n<div><\/div>\n<div>\n<h5 class=\"hklm_num\">7G.Use of cranes in bad weather<\/h5>\n<div id=\"ID_1438413664169_004\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1) Every<span style=\"color: #ff0000;\"> owner of a crane<\/span> shall ensure that no crane of his is used under weather conditions likely to endanger its stability.<br \/>\n\u6bcf\u4e00<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f\u64c1\u6709\u4eba<\/span>\u5747\u9808\u78ba\u4fdd\u5176\u8d77\u91cd\u6a5f\u4e0d\u5f97\u5728\u76f8\u7576\u53ef\u80fd\u5371\u5bb3\u5176\u8d77\u91cd\u6a5f\u7684\u7a69\u5b9a\u6027\u7684\u5929\u6c23\u60c5\u6cc1\u4e0b\u4f7f\u7528\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413664169_012\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) Before a <span style=\"color: #ff0000;\">crane<\/span> is taken into use after exposure to weather conditions likely to have affected the stability of the crane, the owner\u00a0<span class=\"nowrap\">shall\u2014<br \/>\n<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f<\/span>\u5982\u66fe\u66b4\u9732\u65bc\u76f8\u7576\u53ef\u80fd\u5df2\u5f71\u97ff\u5176\u7a69\u5b9a\u6027\u7684\u5929\u6c23\u60c5\u6cc1\u4e4b\u4e0b\uff0c\u5247\u5728\u518d\u4f7f\u7528\u524d\uff0c\u64c1\u6709\u4eba\u9808\u63a1\u53d6\u4ee5\u4e0b\u63aa\u65bd<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413664169_020\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a)cause the devices used for the anchoring or ballasting of the crane to be examined in the<strong> manner prescribed in\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">regulation 7E(1)<\/a><\/span><\/strong>\u00a0and cause the crane to be tested in the <strong>manner prescribed in\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">regulation 7E(2)<\/a><\/span><\/strong>, by a competent examiner as soon as practicable after such exposure and obtain a certificate in the approved form in which the <strong>competent examiner<\/strong>has made a statement to the effect that it is in safe working order; or<br \/>\n\u4e0d\u5f97\u67b6\u8a2d\u6216\u62c6\u5378\u5176\u8d77\u91cd\u6a5f\uff1b\u6216<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) the structure thereof, as originally designed, is not altered,\n<div class=\"hklm_content\">\u4e0d\u5f97\u66f4\u6539\u5176\u8d77\u91cd\u6a5f\u539f\u8a2d\u8a08\u7684\u7d50\u69cb\uff0c<\/div>\n<\/li>\n<\/ul>\n<\/div>\n<div class=\"hklm_continued\">except under the supervision of a competent person.<br \/>\n\u4f46\u5728\u5408\u8cc7\u683c\u7684\u4eba\u76e3\u7763\u4e0b\u9032\u884c\u5247\u9664\u5916<\/div>\n<div class=\"hklm_sourceNote\">(<span class=\"hklm_ref \"><a class=\"hklm_ref source-note unsupported-ref\">L.N. 285 of 1993<\/a><\/span>)<\/div>\n<div><\/div>\n<p>&nbsp;<\/p>\n<div><\/div>\n<div>\n<h5 class=\"hklm_num\">9.Platforms for crane drivers and signallers<br \/>\n\u8d77\u91cd\u6a5f\u99d5\u99db\u54e1\u53ca\u8a0a\u865f\u54e1\u7684\u5e73\u53f0<\/h5>\n<\/div>\n<div id=\"ID_1438413664371_012\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1) Where a <span style=\"color: #ff0000;\">crane has a platform<\/span> for the use of the person driving or operating the crane, or for any signaller (where good safe working practice requires a signaller in connexion with the use of the crane), the <strong>owner shall ensure<\/strong> that it is not used unless the platform\u00a0<span class=\"nowrap\">is\u2014<br \/>\n\u51e1\u4efb\u4f55<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f\u8a2d\u6709\u5e73\u53f0<\/span>\u4ee5\u4f9b\u99d5\u99db\u6216\u64cd\u4f5c\u8a72\u8d77\u91cd\u6a5f\u7684\u4eba\u4f7f\u7528\uff0c\u6216\u4f9b\u8a0a\u865f\u54e1(\u5982\u826f\u597d\u7684\u5b89\u5168\u5de5\u4f5c\u65b9\u6cd5\u898f\u5b9a\u4f7f\u7528\u8a72\u8d77\u91cd\u6a5f\u6642\u9808\u6709\u8a0a\u865f\u54e1)\u4f7f\u7528\uff0c\u5247<strong>\u5176\u64c1\u6709\u4eba\u9808\u78ba\u4fdd<\/strong>\u8a72\u8d77\u91cd\u6a5f\u4e0d\u5f97\u4f7f\u7528\uff0c\u9664\u975e\u8a72\u5e73\u53f0<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413664387_005\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) of sufficient area for the persons employed on it;<br \/>\n\u6709\u8db3\u5920\u5730\u65b9\u5bb9\u7d0d\u53d7\u50f1\u5728\u5e73\u53f0\u4e0a\u5de5\u4f5c\u7684\u4eba<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) either close planked or plated; and<br \/>\n\u4ee5\u6728\u677f\u6216\u91d1\u5c6c\u677f\u5bc6\u92ea\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(c) provided with a safe means of access.<br \/>\n\u8a2d\u6709\u5b89\u5168\u7684\u9032\u51fa\u9014\u5f91\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413664387_028\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) If any such platform has a side from which a person may fall a distance of<strong> more than 2 metres<\/strong>, the owner shall ensure that the crane is not used\u00a0<span class=\"nowrap\">unless\u2014<br \/>\n\u5982\u6709\u4eba\u53ef\u5f9e\u4efb\u4f55\u8a72\u7b49\u5e73\u53f0\u7684\u4e00\u908a\u58ae\u4e0b<strong>\u8d85\u904e2\u7c73\u7684\u8ddd\u96e2<\/strong>\uff0c\u5247\u64c1\u6709\u4eba\u9808\u78ba\u4fdd\u6709\u95dc\u8d77\u91cd\u6a5f\u4e0d\u5f97\u4f7f\u7528\uff0c\u9664\u975e<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413664387_036\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) there is affixed to the platform a <strong>suitable guard rail<\/strong> of adequate strength to a height of not less than 900 millimetres above the platform and above any raised standing place therein;<br \/>\n\u5e73\u53f0\u4e0a\u5df2\u88dd\u6709\u8db3\u5920\u5f37\u5ea6\u7684<strong>\u9069\u7576\u8b77\u6b04<\/strong>\uff0c\u5176\u9ad8\u5ea6\u5230\u9054\u5e73\u53f0\u4e4b\u4e0a\u53ca\u5e73\u53f0\u5167\u7684\u4efb\u4f55\u5347\u8d77\u7684\u7ad9\u7acb\u8655\u4e4b\u4e0a\u4e0d\u5c11\u65bc900\u6beb\u7c73\uff1b<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) the side is provided with one or more<strong> toe boards\u00a0<\/strong><span class=\"nowrap\">placed\u2014<br \/>\n\u8a72\u908a\u8a2d\u6709\u4e00\u584a\u6216\u591a\u65bc\u4e00\u584a\u7684<strong>\u5e95\u8b77\u677f<\/strong><br \/>\n<\/span><\/p>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(i) at a height not less than 200 millimetres above the level of the platform and any raised standing place on it; and<br \/>\n\u8a72\u7b49\u5e95\u8b77\u677f\u9808\u7f6e\u65bc\u9ad8\u51fa\u5e73\u53f0\u6c34\u5e73\u9762\u53ca\u5e73\u53f0\u4e0a\u4efb\u4f55\u5347\u8d77\u7684\u7ad9\u7acb\u8655\u7684\u6c34\u5e73\u9762\u4e0d\u5c11\u65bc200\u6beb\u7c73\u4e4b\u8655\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(ii) in a position that will prevent as far as possible the fall of persons, materials, and tools, from the platform; and<br \/>\n\u8a72\u7b49\u5e95\u8b77\u677f\u653e\u7f6e\u7684\u4f4d\u7f6e\u53ef\u76e1\u91cf\u9632\u6b62\u4eba\u3001\u7269\u6599\u53ca\u5de5\u5177\u5f9e\u5e73\u53f0\u4e0a\u58ae\u4e0b\uff1b\u53ca<\/li>\n<\/ul>\n<\/li>\n<li class=\"hklm_num no_heading_follows\">(c) the space between any toe board on the platform and the <strong>lowest guard rail<\/strong> above it does not exceed 700 millimetres.<br \/>\n\u5e73\u53f0\u4e0a\u7684\u4efb\u4f55\u5e95\u8b77\u677f\u8207\u8a72\u5e95\u8b77\u677f\u4e4b\u4e0a\u7684<strong>\u6700\u4f4e\u7684\u8b77\u6b04<\/strong>\u4e4b\u9593\uff0c\u8ddd\u96e2\u4e0d\u5f97\u8d85\u903e700\u6beb\u7c73\u3002<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413664403_006\" class=\"hklm_paragraph\">\n<div class=\"hklm_content\">\n<div class=\"hklm_sourceNote\">(<span class=\"hklm_ref \"><a class=\"hklm_ref source-note unsupported-ref\">L.N. 238 of 1984<\/a><\/span>)<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"ID_1438413664403_013\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(3) Notwithstanding anything in this regulation, a guard rail or toe board required under this regulation may be removed or remain unerected for such period and to such extent as is necessary for any person to gain access to and egress from the platform or for materials to be removed to it or from it.<br \/>\n\u5118\u7ba1\u672c\u689d\u53e6\u6709\u898f\u5b9a\uff0c\u672c\u689d\u898f\u5b9a\u9808\u8a2d\u7f6e\u7684\u8b77\u6b04\u6216\u5e95\u8b77\u677f\uff0c\u53ef\u6309\u6240\u9700\u7684\u6642\u9593\u53ca\u7a0b\u5ea6\u79fb\u53bb\u6216\u66ab\u4e0d\u67b6\u8a2d\uff0c\u4ee5\u4f9b\u4eba\u9032\u51fa\u5e73\u53f0\u6216\u4f9b\u7269\u6599\u79fb\u9032\u6216\u79fb\u51fa\u5e73\u53f0\u3002<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<h5 class=\"hklm_num\">11. Marking of safe working loads<br \/>\n\u5b89\u5168\u64cd\u4f5c\u8ca0\u8377\u7684\u6a19\u8a18<\/h5>\n<div id=\"ID_1438413664496_004\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1) The <strong>owner of a lifting appliance<\/strong> shall ensure that the appliance is not used unless the safe working load for the time being applicable to the appliance is clearly and legibly marked on it, in English and Chinese, together with an appropriate mark to distinguish it from other similar appliances.<br \/>\n<strong>\u8d77\u91cd\u6a5f\u68b0\u7684\u64c1\u6709\u4eba<\/strong>\u9808\u78ba\u4fdd\u5176\u8d77\u91cd\u6a5f\u68b0\u4e0d\u5f97\u4f7f\u7528\uff0c\u9664\u975e\u5176\u4e0a\u4ee5\u4e2d\u82f1\u6587\u6e05\u6670\u6613\u8b80\u5730\u6a19\u660e\u7576\u5176\u6642\u9069\u7528\u65bc\u8a72\u8d77\u91cd\u6a5f\u68b0\u7684\u5b89\u5168\u64cd\u4f5c\u8ca0\u8377\uff0c\u4e26\u6709\u4e00\u9069\u7576\u6a19\u8a18\uff0c\u4ee5\u4f7f\u5176\u5225\u65bc\u5176\u4ed6\u540c\u985e\u6a5f\u68b0\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413664496_012\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) The <span style=\"color: #ff0000;\"><strong>owner of a crane<\/strong><\/span> (including a crane with a derricking jib) which has a variable operating radius shall ensure that the crane is not used unless\u00a0<span class=\"nowrap\">it<br \/>\n\u64cd\u4f5c\u534a\u5f91\u53ef\u8b8a\u7684<span style=\"color: #ff0000;\"><strong>\u8d77\u91cd\u6a5f<\/strong><\/span>(\u5305\u62ec\u6709\u4eba\u5b57\u540a\u81c2\u7684\u8d77\u91cd\u6a5f)<span style=\"color: #ff0000;\"><strong>\u7684\u64c1\u6709\u4eba<\/strong><\/span>\u9808\u78ba\u4fdd\u5176\u8d77\u91cd\u6a5f\u4e0d\u5f97\u4f7f\u7528\uff0c\u9664\u975e \u2014<\/span><\/div>\n<div id=\"ID_1438413664496_020\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) has clearly and legibly marked on it the safe working load at various radii of the jib, trolley or crab, and, in the case of a <span style=\"color: #ff0000;\">crane<\/span> with a derricking jib, the maximum radius at which the jib may be worked; and<br \/>\n\u8a72\u8d77\u91cd\u6a5f\u7684\u540a\u81c2\u3001\u540a\u904b\u8eca\u6216\u8d77\u91cd\u6ed1\u8eca\u4ee5\u4e0d\u540c\u534a\u5f91\u64cd\u4f5c\u6642\u7684\u5b89\u5168\u64cd\u4f5c\u8ca0\u8377\u5df2\u6e05\u6670\u6613\u8b80\u5730\u6a19\u660e\u65bc\u8a72<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f\u4e0a<\/span>\uff0c\u5982\u5c6c\u6709\u4eba\u5b57\u540a\u81c2\u7684\u8d77\u91cd\u6a5f\uff0c\u5247\u9808\u6a19\u660e\u8a72\u540a\u81c2\u4ee5\u6700\u5927\u7684\u534a\u5f91\u64cd\u4f5c\u6642\u7684\u5b89\u5168\u64cd\u4f5c\u8ca0\u8377\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) is fitted with an accurate indicator, clearly visible to the driver, which shows the radius of the jib, trolley or crab at any particular time and the safe working load applicable to that radius.<br \/>\n\u8a72\u8d77\u91cd\u6a5f\u5df2\u88dd\u4e0a\u99d5\u99db\u54e1\u53ef\u6e05\u6670\u770b\u898b\u7684\u6e96\u78ba\u986f\u793a\u5668\uff0c\u96a8\u6642\u986f\u793a\u540a\u81c2\u3001\u540a\u904b\u8eca\u6216\u8d77\u91cd\u6ed1\u8eca\u7684\u534a\u5f91\u53ca\u9069\u7528\u65bc\u8a72\u534a\u5f91\u7684\u5b89\u5168\u64cd\u4f5c\u8ca0\u8377\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<h5 class=\"hklm_num\">15. Restriction on the use of cranes \u4f7f\u7528\u8d77\u91cd\u6a5f\u7684\u9650\u5236<\/h5>\n<div id=\"ID_1438413664668_004\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1) Without prejudice to paragraph (2), the <span style=\"color: #ff0000;\">owner of a crane<\/span> shall ensure that the crane\u2019s hoisting mechanism is not used for any purpose other than raising or lowering a load vertically\u00a0<span class=\"nowrap\">unless\u2014<br \/>\n\u5728\u4e0d\u640d\u5bb3\u7b2c(2)\u6b3e\u7684\u539f\u5247\u4e0b\uff0c<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f\u7684\u64c1\u6709\u4eba<\/span>\u9808\u78ba\u4fdd\u5176\u8d77\u91cd\u6a5f\u7684\u540a\u91cd\u6a5f\u5236\u53ea\u7528\u65bc\u5782\u76f4\u5347\u8d77\u6216\u964d\u4e0b\u8ca0\u8377\u7269\uff0c\u800c\u4e0d\u5f97\u7528\u4f5c\u5176\u4ed6\u7528\u9014\uff0c\u9664\u975e<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413664668_012\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) he has taken all reasonable steps to see that no undue stress is imposed on any part of the structure or mechanism of the <span style=\"color: #ff0000;\">crane<\/span> thereby endangering the stability of the crane; and (<span class=\"hklm_ref nowrap\"><a class=\"hklm_ref source-note unsupported-ref nowrap\">71 of 1989 s. 13<\/a><\/span>)<br \/>\n\u4ed6\u5df2\u63a1\u53d6\u6240\u6709\u5408\u7406\u6b65\u9a5f\uff0c\u4f7f\u8a72<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f<\/span>\u7684\u7d50\u69cb\u6216\u6a5f\u5236\u7684\u4efb\u4f55\u90e8\u5206\u5747\u4e0d\u6703\u906d\u65bd\u52a0\u904e\u5ea6\u7684\u58d3\u529b\uff0c\u800c\u81f4\u5371\u5bb3\u8a72\u8d77\u91cd\u6a5f\u7684\u7a69\u5b9a\u6027\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) such use is supervised by a competent person.<br \/>\n\u4f5c\u8a72\u5176\u4ed6\u7528\u9014\u6642\u7531\u5408\u8cc7\u683c\u7684\u4eba\u76e3\u7763\u3002<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div id=\"ID_1438413664668_027\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) The <span style=\"color: #ff0000;\">owner of a crane<\/span> which has a derricking jib shall ensure that it is not used with the jib extended at a radius which exceeds the maximum radius specified for the jib in the current certificate of test and thorough examination relating to that crane.<br \/>\n\u6709\u4eba\u5b57\u540a\u81c2\u7684<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f\u7684\u64c1\u6709\u4eba<\/span>\uff0c\u9808\u78ba\u4fdd\u8d77\u91cd\u6a5f\u5728\u5176\u540a\u81c2\u4f38\u5c55\u81f3\u8d85\u903e\u8a72\u8d77\u91cd\u6a5f\u7684\u73fe\u884c\u6709\u6548\u7684\u6e2c\u8a66\u53ca\u5fb9\u5e95\u6aa2\u9a57\u8b49\u660e\u66f8\u5167\u6240\u6307\u660e\u8a72\u540a\u81c2\u7684\u6700\u5927\u534a\u5f91\u6642\uff0c\u4e0d\u5f97\u4f7f\u7528\u3002<\/div>\n<\/div>\n<p>&nbsp;<\/p>\n<h5>15A. <span style=\"color: #ff0000;\">Operators of cranes<\/span> and lifting appliances<br \/>\n\u8d77\u91cd\u6a5f\u53ca\u8d77\u91cd\u6a5f\u68b0\u7684\u64cd\u4f5c\u54e1<\/h5>\n<div>\n<div id=\"ID_1438413664730_004\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1) The <span style=\"color: #ff0000;\">owner of a crane<\/span> shall <strong>ensure<\/strong> that it is only <strong>operated by a person\u00a0<\/strong><span class=\"nowrap\">who\u2014<br \/>\n<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f\u7684\u64c1\u6709\u4eba<\/span>\u9808\u78ba\u4fdd\u5176\u8d77\u91cd\u6a5f\u53ea\u7531\u7b26\u5408\u4ee5\u4e0b\u689d\u4ef6\u7684\u4eba\u64cd\u4f5c<br \/>\n<\/span><\/div>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a)has attained the <strong>age of <span style=\"color: #ff0000;\">18<\/span> years;<\/strong><br \/>\n\u5df2\u5e74\u6eff<strong>18\u6b72<\/strong><\/li>\n<li class=\"hklm_num no_heading_follows\">(b)holds a<strong> valid certificate<\/strong> issued by the specified body or by any other person specified by the Commissioner; <strong>and<\/strong> (<span class=\"hklm_ref nowrap\"><a class=\"hklm_ref source-note nowrap\">12 of 2006 s. 84<\/a><\/span>)<br \/>\n\u6301\u6709\u7531\u6307\u660e\u6a5f\u69cb\u6216\u8655\u9577\u6240\u6307\u660e\u7684\u5176\u4ed6\u4eba\u767c\u51fa\u7684\u6709\u6548\u8b49\u660e\u66f8\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(c)in the opinion of the owner, is <strong>competent<\/strong> to operate the crane by virtue of his experience.<br \/>\n\u64c1\u6709\u4eba\u8a8d\u70ba\uff0c\u6191\u85c9\u8a72\u4eba\u7684\u7d93\u9a57\uff0c\u8a72\u4eba\u6709\u8db3\u5920\u80fd\u529b\u64cd\u4f5c\u5176\u8d77\u91cd\u6a5f\u3002<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413664730_035\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) The owner of a\u00a0<span class=\"nowrap\">power-<\/span>driven lifting appliance, other than a crane, shall ensure that it is only operated by a person\u00a0<span class=\"nowrap\">who\u2014<br \/>\n\u8d77\u91cd\u6a5f\u4ee5\u5916\u7684\u52d5\u529b\u63a8\u52d5\u5f0f\u8d77\u91cd\u6a5f\u68b0\u7684\u64c1\u6709\u4eba\u9808\u78ba\u4fdd\u8a72\u5176\u8d77\u91cd\u6a5f\u68b0\u53ea\u7531\u7b26\u5408\u4ee5\u4e0b\u689d\u4ef6\u7684\u4eba\u64cd\u4f5c<br \/>\n<\/span><\/div>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) has attained the age of 18 years; and<br \/>\n\u5df2\u5e74\u6eff18\u6b72\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) in the opinion of the owner, is trained and competent to operate the appliance.<br \/>\n\u64c1\u6709\u4eba\u8a8d\u70ba\uff0c\u8a72\u4eba\u66fe\u53d7\u8a13\u7df4\u4e26\u6709\u8db3\u5920\u80fd\u529b\u64cd\u4f5c\u8a72\u8d77\u91cd\u6a5f\u68b0\u3002<\/li>\n<\/ul>\n<\/div>\n<div id=\"ID_1438413664746_005\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(3) This regulation does not apply where a person undergoing training is operating a lifting appliance providing he does so under the supervision of a person who meets the requirements of paragraph (1) or (2) as the case may be.<br \/>\n\u51e1\u6b63\u53d7\u8a13\u7df4\u7684\u4eba\u64cd\u4f5c\u4efb\u4f55\u8d77\u91cd\u6a5f\u68b0\uff0c\u53ea\u8981\u4ed6\u662f\u5728\u7b26\u5408\u7b2c(1)\u6216(2)\u6b3e(\u8996\u5c6c\u4f55\u60c5\u6cc1\u800c\u5b9a)\u5404\u9805\u898f\u5b9a\u7684\u4eba\u76e3\u7763\u4e0b\u64cd\u4f5c\u8a72\u8d77\u91cd\u6a5f\u68b0\uff0c\u5247\u672c\u689d\u4e26\u4e0d\u9069\u7528\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413664746_013\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(4) In <strong>this regulation, \u201cspecified body\u201d (\u6307\u660e\u6a5f\u69cb) <\/strong><span class=\"nowrap\"><span class=\"nowrap\"><strong>means<\/strong>\u2014<br \/>\n\u5728\u672c\u689d\u4e2d\uff0c\u201c\u6307\u660e\u6a5f\u69cb<\/span><\/span><span class=\"nowrap\"><span class=\"nowrap\">\u201d (specified body<\/span><\/span><span class=\"nowrap\">)\u6307<br \/>\n<\/span><\/div>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) the body known as the <strong>Construction Industry Training Authority<\/strong> before the commencement* of\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">section 71<\/a><\/span>\u00a0of the Construction Industry Council Ordinance (<span class=\"hklm_ref \"><a class=\"hklm_ref cross-reference\">Cap. 587<\/a><\/span>); <strong>or<\/strong><br \/>\n\u5728\u300a\u5efa\u9020\u696d\u8b70\u6703\u689d\u4f8b\u300b(<span class=\"hklm_ref \"><a class=\"hklm_ref cross-reference\">\u7b2c587\u7ae0<\/a><\/span>)<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">\u7b2c71\u689d<\/a><\/span>\u751f\u6548*\u524d\u540d\u70ba\u5efa\u9020\u696d\u8a13\u7df4\u5c40\u7684\u6a5f\u69cb\uff1b\u6216<\/li>\n<li class=\"hklm_num no_heading_follows\">(b) the <strong>Construction Industry Council<\/strong> established by\u00a0<span class=\"hklm_ref \"><a class=\"hklm_ref no-href\">section 4<\/a><\/span>\u00a0of the Construction Industry Council Ordinance (<span class=\"hklm_ref \"><a class=\"hklm_ref cross-reference\">Cap. 587<\/a><\/span>). Steam not to obscure workplace<br \/>\n\u6c34\u84b8\u6c7d\u4e0d\u5f97\u4f7f\u5de5\u5834\u8b8a\u5f97\u77c7\u77d3<\/h5>\n<div class=\"hklm_content\">The <span style=\"color: #ff0000;\">owner of a crane<\/span> or winch shall ensure that the exhaust steam from and, so far as practicable, live steam to any crane or winch does not obscure any workplace at which a workman is employed.<br \/>\n<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f<\/span>\u6216\u7d5e\u8eca<span style=\"color: #ff0000;\">\u7684\u64c1\u6709\u4eba<\/span>\u9808\u78ba\u4fdd\u5176\u8d77\u91cd\u6a5f\u6216\u7d5e\u8eca\u6240\u6392\u51fa\u7684\u5ee2\u6c7d\uff0c\u53ca\u5728\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\u76e1\u91cf\u78ba\u4fdd\u8f38\u7d66\u5176\u8d77\u91cd\u6a5f\u6216\u7d5e\u8eca\u7684\u65b0\u6c7d\uff0c\u4e0d\u6703\u4f7f\u4efb\u4f55\u6709\u5de5\u4eba\u53d7\u50f1\u7684\u5de5\u5834\u8b8a\u5f97\u77c7\u77d3\u4e0d\u6e05\u3002<\/div>\n<div class=\"hklm_sourceNote\">(<span class=\"hklm_ref \"><a class=\"hklm_ref source-note unsupported-ref\">L.N. 191 of 1978<\/a><\/span>)<\/div>\n<div><\/div>\n<p>&nbsp;<\/p>\n<h5 class=\"hklm_num\">16. Brakes, controls, safety devices, etc.<br \/>\n\u5236\u52d5\u5668\u3001\u63a7\u5236\u5668\u3001\u5b89\u5168\u88dd\u7f6e\u7b49<\/h5>\n<div id=\"ID_1438413664917_004\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(1) The<span style=\"color: #ff0000;\"> owner of<\/span> a crab,<span style=\"color: #ff0000;\"> crane<\/span> or winch shall <strong>ensure<\/strong> that it is not used unless it is fitted with<strong> one or more efficient<\/strong> brakes, or other similar <strong>safety devices<\/strong>, which will prevent a load suspended from the appliance from falling uncontrollably or dangerously.<br \/>\n\u8d77\u91cd\u6ed1\u8eca\u3001<span style=\"color: #ff0000;\">\u8d77\u91cd\u6a5f<\/span>\u6216\u7d5e\u8eca<span style=\"color: #ff0000;\">\u7684\u64c1\u6709\u4eba<\/span>\u9808\u78ba\u4fdd\u5176\u8d77\u91cd\u6ed1\u8eca\u3001\u8d77\u91cd\u6a5f\u6216\u7d5e\u8eca\u4e0d\u5f97\u4f7f\u7528\uff0c\u9664\u975e\u8a72\u8d77\u91cd\u6ed1\u8eca\u3001\u8d77\u91cd\u6a5f\u6216\u7d5e\u8eca\u5df2\u88dd\u4e0a<strong>\u4e00\u500b\u6216\u591a\u65bc\u4e00\u500b\u6709\u6548\u5236\u52d5\u5668\u6216\u5176\u4ed6\u540c\u985e\u5b89\u5168\u88dd\u7f6e<\/strong>\uff0c\u4ee5\u9632\u6b62\u8a72\u6a5f\u68b0\u61f8\u540a\u7740\u7684\u8ca0\u8377\u7269\u5931\u63a7\u58ae\u4e0b\u6216\u5371\u96aa\u5730\u58ae\u4e0b\u3002<\/div>\n<\/div>\n<div id=\"ID_1438413664917_012\" class=\"hklm_subsection\">\n<div class=\"hklm_num no_heading_follows\">(2) Subject to paragraph (3), the owner of a lifting appliance shall ensure that it is not used\u00a0<span class=\"nowrap\">unless\u2014<br \/>\n\u9664\u7b2c(3)\u6b3e\u53e6\u6709\u898f\u5b9a\u5916\uff0c\u8d77\u91cd\u6a5f\u68b0\u7684\u64c1\u6709\u4eba\u9808\u78ba\u4fdd\u5176\u8d77\u91cd\u6a5f\u68b0\u4e0d\u5f97\u4f7f\u7528\uff0c\u9664\u975e<br \/>\n<\/span><\/div>\n<div id=\"ID_1438413664917_020\" class=\"hklm_paragraph\">\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a) every lever, handle, switch or other device used for controlling the operation of any part of the appliance (being a lever, handle, switch or other device the accidental movement or displacement of which is liable to cause danger) is, where practicable (unless it is so placed or the appliance is so constructed as to prevent accidental movement or displacement), provided with a suitable spring or other locking arrangement to prevent any such accidental movement or displacement;
