can be found in both Cap.59 (F&amp;IUO) and Cap.509 (OSHO).<\/p>\n<p>According to <strong>Cap.59 (F&amp;IUO):<\/strong><\/p>\n<blockquote>\n<div id=\"ID_1438413604077_004\" class=\"hklm_subsection\">\n<p><strong>7A.<\/strong> Codes of practice \u5de5\u4f5c\u5b88\u5247<\/p>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(1) For the purpose of providing practical guidance in respect of any one or more of the requirements of this Ordinance or of regulations under this Ordinance, the Commissioner may issue such codes of practice (whether prepared by the Commissioner or not) as the Commissioner considers appropriate.<br \/>\n\u70ba\u5c31\u672c\u689d\u4f8b\u6216\u6839\u64da\u672c\u689d\u4f8b\u8a02\u7acb\u7684\u898f\u4f8b\u7684\u4efb\u4f55\u4e00\u9805\u6216\u591a\u65bc\u4e00\u9805\u898f\u5b9a\u800c\u63d0\u4f9b\u5be6\u52d9\u6307\u5f15\uff0c\u8655\u9577\u53ef\u767c\u51fa\u4ed6\u8a8d\u70ba\u9069\u7576\u7684\u5de5\u4f5c\u5b88\u5247(\u4e0d\u8ad6\u662f\u5426\u7531\u8655\u9577\u64ec\u5099)\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(2)The Commissioner may amend or revoke a code of practice issued by him under subsection (1).<br \/>\n\u8655\u9577\u53ef\u4fee\u8a02\u6216\u64a4\u92b7\u5176\u6839\u64da\u7b2c(1)\u6b3e\u767c\u51fa\u7684\u5de5\u4f5c\u5b88\u5247\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(3)Where the Commissioner exercises a power under subsection (1) or (2), he shall as soon as may be reasonably practicable publish notice thereof in the Gazette and the notice shall be in such form as the Commissioner considers appropriate.<br \/>\n\u5982\u8655\u9577\u6839\u64da\u7b2c(1)\u6216(2)\u6b3e\u884c\u4f7f\u6b0a\u529b\uff0c\u4ed6\u9808\u5728\u5408\u7406\u5207\u5be6\u53ef\u884c\u7bc4\u570d\u5167\u76e1\u5feb\u65bc\u61b2\u5831\u520a\u767b\u6709\u95dc\u7684\u516c\u544a\uff0c\u516c\u544a\u7684\u683c\u5f0f\u6309\u8655\u9577\u8a8d\u70ba\u5408\u9069\u8005\u800c\u5b9a\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(4)A failure by any person to observe a provision of an approved code shall not of itself cause him to incur any criminal liability, but <span class=\"nowrap\">where\u2014<br \/>\n<\/span>\u4efb\u4f55\u4eba\u4e0d\u6703\u7d14\u7cb9\u56e0\u6c92\u6709\u9075\u5b88\u8a8d\u53ef\u5b88\u5247\u7684\u689d\u6587\u800c\u4ee4\u4ed6\u62db\u81f4\u4efb\u4f55\u5211\u4e8b\u6cd5\u5f8b\u8cac\u4efb\uff0c\u4f46\u5982 \u2014\u2014<\/p>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a)in any criminal proceedings the defendant is alleged to have committed an offence\u00a0<span class=\"nowrap\">either\u2014<br \/>\n<\/span>\u5728\u4efb\u4f55\u5211\u4e8b\u6cd5\u5f8b\u7a0b\u5e8f\u4e2d\uff0c\u88ab\u544a\u4eba\u88ab\u6307\u7a31\u5df2\u72af\u7f6a\uff0c\u7406\u7531\u662f \u2014\u2014<\/p>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(i)by reason of a contravention of or a failure to comply with, whether by act or omission, this Ordinance or regulations under this Ordinance; or<br \/>\n\u672c\u689d\u4f8b\u6216\u6839\u64da\u672c\u689d\u4f8b\u8a02\u7acb\u7684\u898f\u4f8b(\u4e0d\u8ad6\u662f\u85c9\u4efb\u4f55\u4f5c\u70ba\u6216\u4e0d\u4f5c\u70ba)\u906d\u9055\u53cd\u6216\u6c92\u6709\u7372\u9075\u5f9e\uff1b<\/li>\n<li class=\"hklm_num no_heading_follows\">(ii)by reason of a failure to discharge or perform a duty imposed by this Ordinance or such regulations; and<br \/>\n\u672c\u689d\u4f8b\u6216\u8a72\u7b49\u898f\u4f8b\u6240\u59d4\u4e88\u7684\u8cac\u4efb\u6c92\u6709\u7372\u5c65\u884c\u6216\u57f7\u884c\uff1b\u53ca<\/li>\n<\/ul>\n<\/li>\n<li class=\"hklm_num no_heading_follows\">(b)the matter to which the alleged contravention or failure relates is one to which, in the opinion of the court, an approved code relates, then subsection (5) shall apply as regards the proceedings.<br \/>\n\u6240\u6307\u7a31\u7684\u9055\u53cd\u6216\u6c92\u6709\u7372\u9075\u5f9e\u6216\u5c65\u884c\u6216\u57f7\u884c\u6240\u6d89\u53ca\u7684\u4e8b\u9805\uff0c\u662f\u6cd5\u5ead\u8a8d\u70ba\u8207\u8a8d\u53ef\u5b88\u5247\u6709\u95dc\u7684\uff0c\u5247\u5c0d\u65bc\u8a72\u7b49\u6cd5\u5f8b\u7a0b\u5e8f\u800c\u8a00\uff0c\u7b2c(5)\u6b3e\u5373\u9069\u7528\u3002<\/li>\n<\/ul>\n<\/li>\n<li class=\"hklm_num no_heading_follows\">(5)In any criminal proceedings to which this subsection applies, the following, <span class=\"nowrap\">namely\u2014<br \/>\n<\/span>\u5728\u672c\u6b3e\u9069\u7528\u7684\u4efb\u4f55\u5211\u4e8b\u6cd5\u5f8b\u7a0b\u5e8f\u4e2d\uff0c\u4ee5\u4e0b\u5404\u9805\uff0c\u5373 \u2014\u2014<\/p>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a)compliance with a provision of an approved code found by the court to be relevant to a matter to which a contravention or failure alleged in the proceedings relates;<br \/>\n\u9075\u5f9e\u8a8d\u53ef\u5b88\u5247\u7684\u689d\u6587\uff0c\u800c\u8a72\u689d\u6587\u7372\u6cd5\u5ead\u88c1\u65b7\u70ba\u8207\u6cd5\u5f8b\u7a0b\u5e8f\u4e2d\u6240\u6307\u7a31\u7684\u9055\u53cd\u6216\u6c92\u6709\u7372\u9075\u5f9e\u6216\u5c65\u884c\u6216\u57f7\u884c\u6240\u6d89\u53ca\u7684\u4e8b\u9805\u6709\u95dc\uff1b<\/li>\n<li class=\"hklm_num no_heading_follows\">(b)a contravention or failure to comply with, whether by act or omission, any such provision so found, may be relied on by any party to the proceedings as tending to establish or to negative any liability which is in question in the proceedings.<br \/>\n\u9055\u53cd\u6216\u6c92\u6709\u9075\u5f9e(\u4e0d\u8ad6\u662f\u85c9\u4efb\u4f55\u4f5c\u70ba\u6216\u4e0d\u4f5c\u70ba)\u4efb\u4f55\u7372\u5982\u6b64\u88c1\u65b7\u7684\u689d\u6587\uff0c\u5747\u53ef\u88ab\u6cd5\u5f8b\u7a0b\u5e8f\u7684\u4efb\u4f55\u4e00\u65b9\u501a\u8cf4\u70ba\u50be\u5411\u78ba\u5b9a\u6216\u5426\u5b9a\u5728\u6cd5\u5f8b\u7a0b\u5e8f\u4e2d\u53d7\u722d\u8b70\u7684\u4efb\u4f55\u6cd5\u5f8b\u8cac\u4efb\u7684\u6839\u64da\u3002<\/li>\n<\/ul>\n<\/li>\n<li class=\"hklm_num no_heading_follows\">(6)In any criminal proceedings, any document which purports to be a copy of a particular approved code shall, in the absence of evidence to the contrary, be regarded by the court as being a true copy of that code.<br \/>\n\u5728\u4efb\u4f55\u5211\u4e8b\u6cd5\u5f8b\u7a0b\u5e8f\u4e2d\uff0c\u4efb\u4f55\u770b\u4f86\u662f\u500b\u5225\u8a8d\u53ef\u5b88\u5247\u7684\u6587\u672c\uff0c\u5728\u7121\u76f8\u53cd\u8b49\u64da\u7684\u60c5\u6cc1\u4e0b\uff0c\u9808\u88ab\u6cd5\u5ead\u8996\u70ba\u8a72\u5b88\u5247\u7684\u771f\u78ba\u6587\u672c\u3002<\/li>\n<\/ul>\n<\/div>\n<div>(Added\u00a0<span class=\"hklm_ref nowrap\"><a class=\"hklm_ref source-note unsupported-ref nowrap\">81 of 1993 s. 6\/\u7531<\/a><a class=\"hklm_ref source-note unsupported-ref\">1993\u5e74\u7b2c81\u865f\u7b2c6\u689d<\/a><\/span>\u589e\u88dc)<\/div>\n<div><\/div>\n<\/blockquote>\n<p>According to <strong>Cap.509 (OSHO):<\/strong><\/p>\n<div>\n<blockquote>\n<div id=\"ID_1438412861696_004\" class=\"hklm_subsection\">\n<p><strong>40.<\/strong> Workplace codes of practice \u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247<\/p>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(1)The Commissioner may issue codes of practice for the purpose of providing practical guidance to employers and employees, and to occupiers of workplaces who are not employers.<br \/>\n\u8655\u9577\u53ef\u70ba\u5411\u50f1\u4e3b\u3001\u50f1\u54e1\u53ca\u4e0d\u662f\u50f1\u4e3b\u7684\u5de5\u4f5c\u5730\u9ede\u4f54\u7528\u4eba\u63d0\u4f9b\u5be6\u52d9\u6307\u5f15\u800c\u767c\u51fa\u5de5\u4f5c\u5b88\u5247\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(2)A workplace code of\u00a0<span class=\"nowrap\">practice\u2014<br \/>\n\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\u00a0\u2014\u2014<br \/>\n<\/span><\/p>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a)may consist of a code, standard, rule, specification or provision relating to occupational safety or health approved by the Commissioner; and<br \/>\n\u53ef\u5305\u542b\u7531\u8655\u9577\u6279\u51c6\u7684\u95dc\u4e4e\u8077\u696d\u5b89\u5168\u6216\u5065\u5eb7\u7684\u5b88\u5247\u3001\u6a19\u6e96\u3001\u898f\u5247\u3001\u898f\u683c\u6216\u689d\u6587\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(b)may apply, incorporate or refer to any document that has been formulated or published by a body or authority either as in force at the time when the document is approved by the Commissioner or as amended, formulated or published from time to time.<br \/>\n\u53ef\u61c9\u7528\u3001\u7de8\u5165\u3001\u53c3\u7167\u6216\u63d0\u8ff0\u4efb\u4f55\u5df2\u7531\u4efb\u4f55\u5718\u9ad4\u6216\u7576\u5c40\u516c\u5e03\u6216\u767c\u8868\u7684\u6587\u4ef6\uff0c\u800c\u8a72\u6587\u4ef6\u662f\u65bc\u8655\u9577\u6279\u51c6\u6642\u6709\u6548\u7684\u6216\u662f\u4e0d\u6642\u7d93\u4fee\u8a02\u3001\u516c\u5e03\u6216\u767c\u8868\u7684\u3002<\/li>\n<\/ul>\n<\/li>\n<li class=\"hklm_num no_heading_follows\">(3)The Commissioner may amend or revoke a code of practice issued under this section.<br \/>\n\u8655\u9577\u53ef\u4fee\u8a02\u6216\u64a4\u92b7\u6839\u64da\u672c\u689d\u767c\u51fa\u7684\u5de5\u4f5c\u5b88\u5247\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(4)The Commissioner is required to publish in both English and\u00a0<span class=\"nowrap\">Chinese\u2014<br \/>\n\u8655\u9577\u9808\u4ee5\u4e2d\u6587\u53ca\u82f1\u6587\u767c\u8868\u00a0\u2014\u2014<br \/>\n<\/span><\/p>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a)any code of practice issued under this section; and<br \/>\n\u6839\u64da\u672c\u689d\u767c\u51fa\u7684\u4efb\u4f55\u5de5\u4f5c\u5b88\u5247\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(b)if the code is subsequently amended, the amendments made to the code.\n<div id=\"ID_1438412861743_059\" class=\"hklm_paragraph\"><\/div>\n<\/li>\n<li class=\"hklm_num no_heading_follows\">The publication may be in such form as the Commissioner considers will communicate the contents of the code or of the amendments to the people affected.<br \/>\n(\u5982\u8a72\u5b88\u5247\u5176\u5f8c\u7d93\u4fee\u8a02)\u5c0d\u8a72\u5b88\u5247\u4f5c\u51fa\u7684\u4fee\u8a02\uff0c<\/p>\n<div class=\"hklm_continued\">\u4e26\u53ef\u4ee5\u8655\u9577\u8a8d\u70ba\u80fd\u5411\u53d7\u5f71\u97ff\u7684\u4eba\u50b3\u9054\u8a72\u5b88\u5247\u6216\u4fee\u8a02\u7684\u5167\u5bb9\u7684\u5f62\u5f0f\u767c\u8868\u3002<\/div>\n<\/li>\n<\/ul>\n<\/li>\n<li class=\"hklm_num no_heading_follows\">(5)Whenever a code of practice is issued under this section or the code is amended or revoked, the Commissioner is required to publish in the Gazette a notice of the issue, amendment or revocation.<br \/>\n\u6bcf\u7576\u6839\u64da\u672c\u689d\u767c\u51fa\u4efb\u4f55\u5de5\u4f5c\u5b88\u5247\u6642\u6216\u8a72\u5b88\u5247\u88ab\u4fee\u8a02\u6216\u906d\u64a4\u92b7\u6642\uff0c\u8655\u9577\u9808\u5728\u61b2\u5831\u520a\u767b\u95dc\u65bc\u8a72\u9805\u767c\u51fa\u3001\u4fee\u8a02\u6216\u64a4\u92b7\u7684\u516c\u544a\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(6)The Commissioner is required to make available at the head office of the Labour Department, during ordinary business hours, all workplace codes of practice for inspection by members of the public. No charge is to be made for the inspection of a workplace code of practice.<br \/>\n\u8655\u9577\u9808\u65bc\u52de\u5de5\u8655\u7684\u7e3d\u8fa6\u4e8b\u8655\u5728\u65e5\u5e38\u8fa6\u516c\u6642\u9593\u5099\u6709\u6240\u6709\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\uff0c\u4ee5\u4f9b\u516c\u773e\u4eba\u58eb\u67e5\u95b1\u3002\u67e5\u95b1\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\u9808\u662f\u514d\u8cbb\u7684\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(7)A workplace code of practice takes effect on the date on which notice of the code is published in the Gazette or on such later date as is specified in the notice.<br \/>\n\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\u81ea\u95dc\u65bc\u8a72\u5b88\u5247\u7684\u516c\u544a\u5728\u61b2\u5831\u520a\u767b\u7684\u65e5\u671f\u8d77\u751f\u6548\uff0c\u6216\u81ea\u8a72\u516c\u544a\u6240\u6307\u660e\u7684\u8f03\u5f8c\u65e5\u671f\u8d77\u751f\u6548\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(8)An amendment to a workplace code of practice takes effect on the date on which notice of the amendment is published in the Gazette or on such later date as is specified in the notice.<br \/>\n\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\u7684\u4fee\u8a02\u81ea\u95dc\u65bc\u8a72\u9805\u4fee\u8a02\u7684\u516c\u544a\u5728\u61b2\u5831\u520a\u767b\u7684\u65e5\u671f\u8d77\u751f\u6548\uff0c\u6216\u81ea\u8a72\u516c\u544a\u6240\u6307\u660e\u7684\u8f03\u5f8c\u65e5\u671f\u8d77\u751f\u6548\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(9)A workplace code of practice ceases to have effect on the date on which notice of revocation of the code is published in the Gazette or on such later date as is specified in the notice.<br \/>\n\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\u81ea\u95dc\u65bc\u8a72\u5b88\u5247\u7684\u64a4\u92b7\u7684\u516c\u544a\u5728\u61b2\u5831\u520a\u767b\u7684\u65e5\u671f\u8d77\u505c\u6b62\u6709\u6548\u6216\u81ea\u8a72\u516c\u544a\u6240\u6307\u660e\u7684\u8f03\u5f8c\u65e5\u671f\u8d77\u505c\u6b62\u6709\u6548\u3002<\/li>\n<\/ul>\n<\/div>\n<\/blockquote>\n<\/div>\n<div><\/div>\n<div><\/div>\n<div>\n<div>\n<blockquote>\n<div id=\"ID_1438412861759_004\" class=\"hklm_subsection\">\n<p><strong>41.<\/strong> Effect of workplace code of practice \u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\u7684\u6548\u529b<\/p>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(1)A person does not incur a civil or criminal liability only because the person has contravened a provision of a workplace code of practice.<br \/>\n\u4efb\u4f55\u4eba\u4e0d\u6703\u53ea\u56e0\u9055\u53cd\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\u7684\u689d\u6587\u800c\u62db\u81f4\u6c11\u4e8b\u6216\u5211\u4e8b\u6cd5\u5f8b\u8cac\u4efb\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(2)However, if, in any legal proceedings the court is satisfied that a workplace code of practice is relevant to determining a matter that is in issue in the\u00a0<span class=\"nowrap\">proceedings\u2014<br \/>\n\u4f46\u5982\u6cd5\u5ead\u5728\u4efb\u4f55\u6cd5\u5f8b\u7a0b\u5e8f\u4e2d\u4fe1\u7d0d\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\u5c0d\u88c1\u5b9a\u5728\u8a72\u6cd5\u5f8b\u7a0b\u5e8f\u4e2d\u53d7\u722d\u8ad6\u7684\u4e8b\u5b9c\u662f\u6709\u95dc\u7684\uff0c\u5247\u00a0\u2014\u2014<br \/>\n<\/span><\/p>\n<ul>\n<li class=\"hklm_num no_heading_follows\">(a)the code of practice is admissible in evidence in the proceedings; and<br \/>\n\u8a72\u5de5\u4f5c\u5b88\u5247\u5728\u8a72\u6cd5\u5f8b\u7a0b\u5e8f\u4e2d\u53ef\u88ab\u63a5\u7d0d\u70ba\u8b49\u64da\uff1b\u53ca<\/li>\n<li class=\"hklm_num no_heading_follows\">(b)proof that the person contravened or did not contravene a relevant provision of the code may be relied on by any party to the proceedings as tending to establish or negate that matter.<br \/>\n\u8b49\u660e\u67d0\u4eba\u5df2\u9055\u53cd\u6216\u6c92\u6709\u9055\u53cd\u5b88\u5247\u7684\u6709\u95dc\u689d\u6587\u7684\u8b49\u64da\uff0c\u53ef\u7372\u6cd5\u5f8b\u7a0b\u5e8f\u7684\u4efb\u4f55\u4e00\u65b9\u4f9d\u8cf4\u70ba\u53ef\u78ba\u7acb\u6216\u5426\u5b9a\u8a72\u4e8b\u5b9c\u7684\u8b49\u64da\u3002<\/li>\n<\/ul>\n<\/li>\n<li class=\"hklm_num no_heading_follows\">(3)In any legal proceedings, a document that purports to be a copy of a workplace code of practice is, in the absence of evidence to the contrary, to be presumed to be a true copy of the code.<br \/>\n\u5728\u4efb\u4f55\u6cd5\u5f8b\u7a0b\u5e8f\u4e2d\uff0c\u5728\u6c92\u6709\u76f8\u53cd\u8b49\u64da\u7684\u60c5\u6cc1\u4e0b\uff0c\u4efb\u4f55\u770b\u4f86\u662f\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\u7684\u526f\u672c\u7684\u6587\u4ef6\u9808\u63a8\u5b9a\u70ba\u8a72\u5b88\u5247\u771f\u5be6\u526f\u672c\u3002<\/li>\n<li class=\"hklm_num no_heading_follows\">(4)A workplace code of practice is not subsidiary legislation for the purposes of Part V of the Interpretation and General Clauses Ordinance (<span class=\"hklm_ref \"><a class=\"hklm_ref cross-reference\">Cap. 1<\/a><\/span>).<br \/>\n\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u5b88\u5247\u4e26\u4e0d\u662f\u5c31\u300a\u91cb\u7fa9\u53ca\u901a\u5247\u689d\u4f8b\u300b(<span class=\"hklm_ref \"><a class=\"hklm_ref cross-reference\">\u7b2c1\u7ae0<\/a><\/span>)\u7b2cV\u90e8\u800c\u8a00\u7684\u9644\u5c6c\u6cd5\u4f8b\u3002<\/li>\n<\/ul>\n<\/div>\n<\/blockquote>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>[Ref CAP.59, CAP.509] &#8220;Codes of Practice&#8221;
