{"id":5963,"date":"2020-10-15T14:47:38","date_gmt":"2020-10-15T06:47:38","guid":{"rendered":"https:\/\/tommykwan.com\/blog\/?p=5963"},"modified":"2020-10-15T15:10:16","modified_gmt":"2020-10-15T07:10:16","slug":"woman-young-person-or-child-who-works-in-an-industrial-undertaking-fiuo-hong-kong","status":"publish","type":"post","link":"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/woman-young-person-or-child-who-works-in-an-industrial-undertaking-fiuo-hong-kong\/","title":{"rendered":"Woman, Young person or Child who works in an industrial undertaking (F&#038;IUO) [Hong Kong]"},"content":{"rendered":"[Ref\u00a0<a href=\"https:\/\/www.elegislation.gov.hk\/hk\/cap59!en-zh-Hant-HK?INDEX_CS=N&amp;xpid=ID_1438403494800_002\" target=\"_blank\" rel=\"noopener noreferrer\">Cap.59<\/a>]\n<p>With reference to Factories and Industrial Undertakings Ordinance (F&amp;IUO) [Cap.59 2 (2) and (3)]:<\/p>\n<p>\u5c31 F&amp;IUO\u300a\u5de5\u5ee0\u53ca\u5de5\u696d\u7d93\u71df\u689d\u4f8b\u300b\u91cb\u7fa9\u4f86\u770b, \u51e1\u5728\u5de5\u696d\u7d93\u71df\u4e2d\u5de5\u4f5c\u7684\u5a66\u5973\u3001\u9752\u5e74\u6216\u5152\u7ae5\uff0c\u4e0d\u8ad6\u662f\u5426\u53d7\u85aa, \u53ea\u8981\u5728<a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-industrial-undertaking-%e5%b7%a5%e6%a5%ad%e7%b6%93%e7%87%9f-factory-%e5%b7%a5%e5%bb%a0-notifiable-workplace-%e6%87%89%e5%91%88%e5%a0%b1%e5%b7%a5%e5%a0%b4\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>\u5de5\u696d\u7d93\u71df\u5834\u6240<\/strong><\/a>\u5de5\u4f5c\u5747\u9808\u7576\u4f5c\u53d7\u50f1\u3002<\/p>\n<blockquote>\n<div class=\"hklm_num no_heading_follows\">(2) A <strong>woman, young person or child who works in an industrial undertaking, whether for wages or not<\/strong>, either in a process or in cleaning any part of the industrial undertaking used for any process, or in cleaning or oiling any part of the machinery or plant, or in any other kind of work whatsoever incidental to or connected with the process, or connected with the article made or otherwise the subject of the process therein,<strong> shall be deemed to be employed<\/strong> therein for the purposes of this Ordinance or any proceedings thereunder. (Added <span class=\"hklm_ref nowrap\"><a class=\"hklm_ref source-note unsupported-ref nowrap\">51 of 1961 s. 2<\/a><\/span>)\u51e1\u5728\u5de5\u696d\u7d93\u71df\u4e2d\u5de5\u4f5c\u7684\u5a66\u5973\u3001\u9752\u5e74\u6216\u5152\u7ae5\uff0c\u4e0d\u8ad6\u662f\u5426\u53d7\u85aa\uff0c\u4ea6\u4e0d\u8ad6\u662f\u8ca0\u8cac\u5de5\u5e8f\u4e2d\u7684\u5de5\u4f5c\u6216\u8ca0\u8cac\u6e05\u6f54\u5de5\u696d\u7d93\u71df\u4e2d\u4efb\u4f55\u4f9b\u5de5\u5e8f\u7528\u7684\u90e8\u5206\uff0c\u6216\u662f\u8ca0\u8cac\u6e05\u6f54\u6216\u6cb9\u6f64\u6a5f\u68b0\u6216\u5de5\u696d\u88dd\u7f6e\u7684\u4efb\u4f55\u90e8\u5206\uff0c\u4ea6\u4e0d\u8ad6\u662f\u8ca0\u8cac\u7531\u5de5\u5e8f\u6240\u9023\u5e36\u5f15\u8d77\u7684\u6216\u8207\u5de5\u5e8f\u6709\u95dc\u7684\u4efb\u4f55\u5176\u4ed6\u985e\u578b\u5de5\u4f5c\uff0c\u6216\u662f\u8ca0\u8cac\u8207\u88fd\u6210\u7684\u7269\u54c1\u6709\u95dc\u7684\u6216\u5728\u5176\u4ed6\u65b9\u9762\u8207\u5de5\u5e8f\u6a19\u7684\u6709\u95dc\u7684\u4efb\u4f55\u5176\u4ed6\u985e\u578b\u5de5\u4f5c\uff0c\u5c31\u672c\u689d\u4f8b\u800c\u8a00\u6216\u5c31\u6839\u64da\u672c\u689d\u4f8b\u63d0\u8d77\u7684\u6cd5\u5f8b\u7a0b\u5e8f\u800c\u8a00\uff0c\u5747\u9808\u7576\u4f5c\u53d7\u50f1\u65bc\u8a72\u8655\u3002(\u7531<span class=\"hklm_ref \"><a class=\"hklm_ref source-note unsupported-ref\">1961\u5e74\u7b2c51\u865f\u7b2c2\u689d<\/a><\/span>\u589e\u88dc)<\/div>\n<\/blockquote>\n<div><\/div>\n<div><\/div>\n<div>\u5c31 F&amp;IUO\u300a\u5de5\u5ee0\u53ca\u5de5\u696d\u7d93\u71df\u689d\u4f8b\u300b\u91cb\u7fa9\u4f86\u770b, \u9019\u689d\u4f8b\u5167\u5bb9\u4e26<strong>\u4e0d\u9069\u7528<\/strong><span class=\"nowrap\"><strong>\u65bc<\/strong>\u5728<strong><a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-industrial-undertaking-%e5%b7%a5%e6%a5%ad%e7%b6%93%e7%87%9f-factory-%e5%b7%a5%e5%bb%a0-notifiable-workplace-%e6%87%89%e5%91%88%e5%a0%b1%e5%b7%a5%e5%a0%b4\/\" target=\"_blank\" rel=\"noopener noreferrer\">\u5de5\u696d\u7d93\u71df\u5834\u6240<\/a><\/strong>\u7684<strong>NGO <\/strong>\u6216<strong> \u8fb2\u5834<\/strong>\u3002<\/span><\/div>\n<div><\/div>\n<div><\/div>\n<div>\n<blockquote>\n<div class=\"hklm_num no_heading_follows\">(3) <strong>None of the provisions of this Ordinance shall apply\u00a0<\/strong><span class=\"nowrap\"><strong>to<\/strong>\u2014<\/span>\u00a0 (Amended <span class=\"hklm_ref nowrap\"><a class=\"hklm_ref source-note unsupported-ref nowrap\">73 of 1977 s. 2<\/a><\/span>;\u00a0<span class=\"hklm_ref nowrap\"><a class=\"hklm_ref source-note unsupported-ref nowrap\">11 of 1980 s. 2<\/a><\/span>)<\/div>\n<div class=\"hklm_leadIn\">\n<div class=\"hklm_sourceNote\">\u672c\u689d\u4f8b\u689d\u6587\u4e26\u4e0d\u9069\u7528<span class=\"nowrap\">\u65bc\u00a0\u2014<\/span>\u2014\u00a0 (\u7531<span class=\"hklm_ref \"><a class=\"hklm_ref source-note unsupported-ref\">1977\u5e74\u7b2c73\u865f\u7b2c2\u689d<\/a><\/span>\u4fee\u8a02\uff1b\u7531<span class=\"hklm_ref \"><a class=\"hklm_ref source-note unsupported-ref\">1980\u5e74\u7b2c11\u865f\u7b2c2\u689d<\/a><\/span>\u4fee\u8a02<\/div>\n<\/div>\n<div id=\"ID_1438413602892_013\" class=\"hklm_paragraph\">\n<div class=\"hklm_num no_heading_follows\">(a) any <strong>undertaking which is not<\/strong> carried on by way of trade or<strong> for purposes of gain<\/strong>;
