Amended <span class=\"hklm_ref nowrap\"><a class=\"hklm_ref source-note nowrap\">54 of 2000 s. 3<\/a><\/span>) \u627f\u5efa\u5546 (contractor)\u5c31\u5efa\u7bc9\u5de5\u7a0b\u800c\u8a00\uff0c\u6307\u4ee5\u7d93\u71df\u751f\u610f\u6216\u696d\u52d9\u65b9\u5f0f\u5f9e\u4e8b\u5efa\u7bc9\u5de5\u7a0b\u7684\u4eba\u6216\u5546\u865f\uff0c\u800c\u8a72\u4eba\u6216\u5546\u865f\u662f\u672c\u8eab\u7368\u7acb\u5f9e\u4e8b\u8a72\u5efa\u7bc9\u5de5\u7a0b\u7684\u6216\u662f\u70ba\u4f9d\u64da\u8207\u5225\u4eba(\u5305\u62ec\u201c\u570b\u5bb6\u201d\u6216\u4efb\u4f55\u516c\u5171\u6a5f\u69cb)\u6240\u8a02\u7684\u5408\u7d04\u6216\u5b89\u6392\u800c\u5f9e\u4e8b\u8a72\u5efa\u7bc9\u5de5\u7a0b\u7684\uff1b(\u7531<span class=\"hklm_ref \"><a class=\"hklm_ref source-note unsupported-ref\">1973\u5e74\u7b2c52\u865f\u7b2c2\u689d<\/a><\/span>\u589e\u88dc\u3002\u7531<span class=\"hklm_ref \"><a class=\"hklm_ref source-note\">2000\u5e74\u7b2c54\u865f\u7b2c3\u689d<\/a><\/span>\u4fee\u8a02)<\/li>\n<\/ul>\n<\/div>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<div><\/div>\n<div>According to <b>Cap.509 3:<\/b><\/div>\n<div>\n<ul>\n<li><b>employer (\u50f1\u4e3b)<\/b> means a person who employs natural persons under contracts of employment or apprenticeship; \u50f1\u4e3b(employer)\u6307\u6839\u64da\u50f1\u50ad\u5408\u7d04\u6216\u5b78\u5f92\u5408\u7d04\u50f1\u7528\u81ea\u7136\u4eba\u7684\u4eba\uff1b<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li><b>occupier (\u4f54\u7528\u4eba)<\/b>, in relation to any <a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-workplace-\u5de5\u4f5c\u5730\u9ede-premises-\u8655\u6240-and-public-place-\u516c\u773e\u5730\u65b9\/\" target=\"_blank\" rel=\"noopener noreferrer\">premises<\/a> or <a href=\"https:\/\/tommykwan.com\/blog\/occupational-health-and-safety-osh\/whats-workplace-\u5de5\u4f5c\u5730\u9ede-premises-\u8655\u6240-and-public-place-\u516c\u773e\u5730\u65b9\/\" target=\"_blank\" rel=\"noopener noreferrer\">workplace<\/a>, includes a person who has any degree of control over the premises or workplace and, in particular, includes a person to whom subsection (5) or (6) applies;\u00a0\u4f54\u7528\u4eba(occupier)\u5c31\u4efb\u4f55\u8655\u6240\u6216\u5de5\u4f5c\u5730\u9ede\u800c\u8a00\uff0c\u5305\u62ec\u5177\u6709\u5c0d\u8a72\u8655\u6240\u6216\u5de5\u4f5c\u5730\u9ede\u6709\u4efb\u4f55\u7a0b\u5ea6\u63a7\u5236\u6b0a\u7684\u4efb\u4f55\u4eba\uff0c\u4e26\u5c24\u5176\u5305\u62ec\u7b2c(5)\u6216(6)\u6b3e\u9069\u7528\u7684\u4eba\uff1b\n<div id=\"ID_1438412860136_013\" class=\"hklm_subsection\"><\/div>\n<ul>\n<li>\n<div class=\"hklm_num no_heading_follows\">(5) A person who, under a lease or contract, has an obligation <span class=\"nowrap\">for\u2014<br \/>\n\u4efb\u4f55\u4eba\u5982\u6839\u64da\u4efb\u4f55\u79df\u5951\u6216\u5408\u7d04\u5c31\u4ee5\u4e0b\u4e8b\u5b9c\u627f\u64d4\u8cac\u4efb\u00a0\u2014\u2014<br \/>\n<\/span><\/div>\n<ul>\n<li>\n<div class=\"hklm_num no_heading_follows\">(a) the maintenance or repair of premises; or<br \/>\n\u8655\u6240\u7684\u7dad\u4fee\u6216\u4fee\u847a\uff1b\u6216<\/div>\n<\/li>\n<li>\n<div class=\"hklm_num no_heading_follows\">(b) the safety of, or the absence of risks to health arising from the condition or use of, any plant or substance located on premises,<br \/>\n\u4efb\u4f55\u7f6e\u65bc\u8655\u6240\u7684\u4f5c\u696d\u88dd\u7f6e\u6216\u7269\u8cea\u7684\u5b89\u5168\u6216\u6c92\u6709\u56e0\u4efb\u4f55\u7f6e\u65bc\u8655\u6240\u7684\u4f5c\u696d\u88dd\u7f6e\u6216\u7269\u8cea\u7684\u72c0\u6cc1\u6216\u4f7f\u7528\u800c\u5c0d\u5065\u5eb7\u7522\u751f\u7684\u5371\u96aa\uff0c<\/div>\n<div class=\"hklm_continued\"><\/div>\n<p>is taken to be an occupier of the premises for the purposes of this Ordinance.<br \/>\n\u5247\u5c31\u672c\u689d\u4f8b\u800c\u8a00\uff0c\u8a72\u4eba\u88ab\u8996\u70ba\u8a72\u8655\u6240\u7684\u4f54\u7528\u4eba\u3002<\/li>\n<\/ul>\n<\/li>\n<li>\n<div class=\"hklm_num no_heading_follows\">(6) A person who, under a lease or contract, has an obligation to provide, maintain or repair a means of access to, or egress from, premises is taken to be an occupier of the premises for the purposes of this Ordinance.<br \/>\n\u4efb\u4f55\u4eba\u5982\u6839\u64da\u4efb\u4f55\u79df\u5951\u6216\u5408\u7d04\u5c31\u63d0\u4f9b\u3001\u7dad\u4fee\u6216\u4fee\u847a\u9032\u51fa\u8655\u6240\u7684\u9014\u5f91\u800c\u627f\u64d4\u8cac\u4efb\uff0c\u5247\u5c31\u672c\u689d\u4f8b\u800c\u8a00\uff0c\u8a72\u4eba\u88ab\u8996\u70ba\u8a72\u8655\u6240\u7684\u4f54\u7528\u4eba\u3002<\/div>\n<\/li>\n<li>(7) Subsections (5) and (6) do not apply to persons in their capacity as occupiers of domestic premises.<br \/>\n\u7b2c(5)\u53ca(6)\u6b3e\u4e0d\u9069\u7528\u65bc\u5c6c\u4f4f\u5b85\u8655\u6240\u4f54\u7528\u4eba\u8eab\u5206\u7684\u4eba\u3002<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<div>\n<div>\n<div class=\"hklm_term\">\n<ul>\n<li><b>person responsible (\u8ca0\u8cac\u4eba)<\/b>, in relation to a workplace, has the meaning given by subsection (2);\u00a0\u8ca0\u8cac\u4eba(person responsible)\u5c31\u4efb\u4f55\u5de5\u4f5c\u5730\u9ede\u800c\u8a00\uff0c\u5177\u6709\u7b2c(2)\u6b3e\u7d66\u4e88\u8a72\u8a5e\u7684\u6db5\u7fa9\uff1b<br \/>\n<em>Subsection (2) : For the purposes of this Ordinance, the person responsible for a workplace is the<strong> employer<\/strong> of the employees who are employed to carry out work there,<strong> or<\/strong> if the employer does not exercise any degree of control over the relevant part or aspect of the workplace, means the<strong> occupier<\/strong> of the workplace.<\/em><br \/>\n<em>\u5c31\u672c\u689d\u4f8b\u800c\u8a00\uff0c\u5de5\u4f5c\u5730\u9ede\u7684\u8ca0\u8cac\u4eba\u662f\u53d7\u50f1\u65bc\u8a72\u5de5\u4f5c\u5730\u9ede\u5de5\u4f5c\u7684\u50f1\u54e1\u7684\u50f1\u4e3b\uff1b\u5982\u8a72\u50f1\u4e3b\u4e26\u6c92\u6709\u5c0d\u8a72\u5de5\u4f5c\u5730\u9ede\u7684\u6709<\/em><br \/>\n<em>\u95dc\u90e8\u5206\u6216\u65b9\u9762\u884c\u4f7f\u4efb\u4f55\u7a0b\u5ea6\u7684\u63a7\u5236\u6b0a\uff0c\u5247\u5de5\u4f5c\u5730\u9ede\u7684\u8ca0\u8cac\u4eba\u6307\u8a72\u5de5\u4f5c\u5730\u9ede\u7684\u4f54\u7528\u4eba\u3002<\/em><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<div><\/div>\n<\/div>\n<div>\n<div><\/div>\n<\/div>\n<div><\/div>\n<div><\/div>\n","protected":false},"excerpt":{"rendered":"<p>[Ref Cap.59, Cap.509] proprietor (\u6771\u4e3b),\u00a0contractor (\u627f\u5efa\u5546) \u662fF&amp;IUO [Cap.59 2] \u91cb\u7fa9\u4e2d\u7684\u7528\u8a5e;
